INTERAGENCY AGREEMENT This Agreement is entered into by and among Kerr County, Gillespie County, Kendall County and Bandera County, political subdivisions of the state of Texas, hereinafter referred to as "Counties", and the City of Kerrville, Texas, the City of Ingram, Texas, tbe City of Fredericksburg, Texas, the City of Boerne, Texas, and tbe City of Bandera, municipal corporations situated in 216'h Judicial District of the State of Texas, hereinafter called "Cities", pursuant to chapter 791 of the Texas Government Code, concerning inter-local cooperation contracts. WITNESSETH WHEREAS, the Counties and Cities wish to file a joint grant application with the Criminal Justice Division of the Office of the Governor, State of Texas, for funding in the amount of $722,231.00 for the 216m Judicial District Narcotics Task Force, and WHEREAS, the Counties and Cities have agreed to contribute the total of $180,557.75 in matching funds if said joint application is approved; and WHEREAS, the source of funds would not normally be used for this purpose; and WHEREAS, the Counties and Cities believe it to be in their best interests to join in the application to develop a Regional Narcotics Task Force; and WHEREAS, the Counties and Cities agree to each accept the responsibility to adhere to all pertinent federal state and local laws or regulations. NOW THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: ARTICLE I PURPOSE I.OI The purpose of this Agreement is to allow Counties and Cities to file a joint application for a Narcotics Task Force Grant with the Criminal Justice Division, of the Govemoc's Office of the State of Texas, for funding for the 216's Judicial District Narcotics Task Force, a copy of which application is attached hereto as Exhibit "A" and made a part hereof for all purposes. ARTICLE II TERM 2.01 The term of this Agreement is to commence on the execution of this Agreement and to end May 31, 2003. ARTICLE V OWNERSHIP OF EQUIPMENT 5.01 Upon termination of this agreement, ownership of equipment, hardware, and other non-expendable items will revert to tbe applicant for which it was acquired, subject to the approval of the Criminal Justice Division of the Governor's Office. ARTICLE VI AMENDMENTS 6.01 This agreement may be amended by the mutual agreement of the parties hereto in writing to be attached to and incorporated into this agreement. ARTICLE VII LEGAL CONSTRUCTION 7.01 In case any one or more of the provisions contained in this agreement shall be held to be invalid, illegal, or unenforceable in any respect such an invalidity, illegality, or unenforceability shall not affect any other provision thereof; and this agreement shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein. (as ot6nnt appltcalmo submission) , V I $ 72,338.06 Kerr County, Texas Resolution No. ~ ~~.~ f WHEREAS, The Ken County Commissioners Court fords it in the best interest of the citizens of Ken County, that the 216' Judicial District Nazcotics Task Force be operated for the 2002 - 2003 year; and WHEREAS, Ken County Commissioners Court has considered the proposed application for State and Federal Assistance for said project, in the amount of $722,231.00 to be submitted to the Office of the Govemor, Criminal Justice Division WHEREAS, Ken County Commissioners Court has agreed to provide matching moneys for the said project in the amount of $44,962.19, or an amount equal to one-fourth of the total project cost, as required by the grant application; and WHEREAS, Kerr County Commissioners Court has agreed that in the event of loss or misuse of the Criminal Justice Division funds, Ken County Commissioners Court assures that the funds will be returned to the Criminal Justice Division in full. NOW THEREFORE, BE IT RESOLVED that Kerr County Commissioners Court approves submission of the grant application for the 216s' Judicial District Nazcotics Task Force to the Office of the Governor, Criminal Justice Division, Narcotics Task Force Program in the amount of $722,231.00.
