County Judge Memorandum To: Ken County Commissioners Court From: David Motley Date: December 21, 2001 Subject: Purchase of right-of -way with tax credits I can find no specific authority in the Texas Constitution or statutes for a county to exchange tax credits for an interest in realty, specifically, county road right-of--way. Under the authority of the Canales case, a county may not act unless empowered to do so by statute or by the Constitution. I advise payment of an amount of money in a lump sum which represents fair market value for the land in question. Kerr County has the right of eminent domain as set out in Chapter 261 of the Texas Local Government Code and Chapter 21 of the Texas Property Code, in particular §§21.012- 21.015, 21.018 & 21.021.
