As you are aware, we have filed most of our paperwork for all three phases for the Kerr County
Courthouse & Annex, including the Contractor's Final Application and Certificate for Payment.
There are a few issues which need explanation and resolution:
1. There remains an important life safety issue with Door X18, which is a required exit for
the Second Floor Annex. The Contractor fulfilled his duties to have the door lock release
upon alarm after a delay. Unfortunately, the type of existing lock re-engages after the
first exit occurrence, which is not incompliance with applicable codes or safe for a
public exit. In a compromise with the Fire Marshal and Sheriff s Office, it was agreed
that there would be a delay in release of the lock. This would help insure temporary
containment of any prisoners, but not encumber the other occupants in excess of one
minute for egress from the building in the event of fire, if deputies had key-locked the
common exit Door X 18. Mr. Holekamp is pursuing with a separate contractor/
consultant the change-out of lock types to provide the required operation. In the interim,
we highly recommend that the Door X18 lock he temporarily disabled to prevent kev-
lockine until the lockset can be replaced wrath the properly operatinC unit.
2. Warranty issues. At no additional fees, your consultants conducted an inspection on
February 19, 2002, and submitted a separate attached report to the Owner dated February
21, 2002, of currently observed Warranty items, as the General Contractor's Warranty
period is set to expire by mutual agreement on March 1, 2002.
3. I reiterate our cautioning in my attached letter of February 1 I, 2002, concerning the
absence of emergency power to operate sewers and other critical circuits in case of heavy
rains, if coupled with an electrical power failure.
4. Similarly, please know that we are unawaze of what the existing status of the designated
"X" or Emergency Panel in the Main Electrical Room on the Lower Level is. The
County contracted independently to change out some emergency lighting and power
circuits. We were not made aware of the details of these modifications. Therefore, these

modifications were not furnished to us and are not reflected in the Record Documents
which we famished to the County. This circumvention partially defeats the purpose of
having the comprehensive record as-builts, as everything is not reflected on the current
Record Documents. This architect and his consultants take no responsibility for the
status of Panel X, nor the emergency circuits handled outside our purview, nor the lack
of emergency power to critical circuits and equipment.
5. On our recent inspection, we noticed that some party (not under this Contract) had
erected a large rack on the roof for electrical equipment, apparently for Seasonal
Lighting. This rack was installed in a very unworkmanlike manner by simply bolting
through, the roofing surface, and attempting to seal this damage with substandard
methods. This work will undoubtedly damage the roofing, cause leaks into the substrate,
and endanger the status of the 20-year roofing warranty.
6. The County is also cautioned about the hooks mounted to the back side of cast stone
parapet caps for anchoring seasonal lighting on steel cables extended to the ground, that I
witnessed this past season. Those caps were never intended to have such torsional loads
imposed on them. Given the apparent load of the cables and lights, plus whatever
additional impact point loads that might be imposed (e. g. struck by a vehicle or climbed
on by children), this could result in caps falling, causing serious property damage, injury,
or death. We strongly recommend that this mounting practice never be allowed to exist
again. This is in addition to the apparent dangerous conditions which were witnessed
concerning electrical shock potential and aesthetic issues. On numerous occasions
during the 3 phases and almost 6 years of working on the project, we requested a list of
requirements for seasonal lighting and decorating group through Commissioners' Court,
so rhat we could incorporate same into the design on a timely basis. We did not receive
any requirements on the Annex or Courthouse, other than a few items for the grounds in
Phase I. The uncoordinated approach of this well-meaning group(s) has persistently
resulted in the unnecessary detriment of the taxpayer's 3. Smillion dollar investment, as
well as numerous life safety issues.
7. There is the issue of achieving final approval and inspection for Texas Accessibility
Standards from the Texas Department of Licensing and Regulation. Our firm's name is
on all the TDLR Applications; however, apparently the County wanted to remove that
responsibility from our Contract without notice. I cooperatively forwarded all the EAB
Project reference numbers to Mr. Longnecker, as your representative, to pursue those
inspections. Also, I discussed my liability for compliance with TDLR representatives.
They indicated that my responsibility ended with design compliance. My concern is that
there were rejections on our TDLR Review Responses forms for the sitework non-
compliances, which were removed by the Owner from our design purview in Phase 1 and
3. These may have been addressed by others, but I am not aware of these issues being

resolved. In fact, some appear to have been worsened by recent "improvements." Our
firm does not want to be held responsible for compliance on those sitework items, either
by the County or TDLR. Please issue a written release of our responsibility for sitework
accessability issues for our records. Please see attached TDLR Review sheets (partial).
I commend the courage of this Court and the previous Courts for undertaking the scope and the
complexity of these projects. We aze civically proud and professionally pleased to have
provided architectural services for this ef'f'ort. The Courthouse Square and the services provided
for the public are unquestionably better for everyone's efforts and patience.
We did attempt to hold Additional Services to a minimum, but when unforseen problems were
encountered and the Contractor was over 18 months late finishing, we had no alternative but to
charge minimally on an as needed basis. If you or any County officials wish to discuss any of
these issues, I await your call.

This letter is to inform you that in the professional opinion of this firm and our consultants Work
of Phase 3, Renovations of Ken County Courthouse and Annex, is complete, with noted
exceptions:
1. There is an issue of disrupted electrical service to condensing unit rt5 on the
Courthouse roof, which appears to have no electrical connection to so marked Panel S in
Penthouse. County Auditor Staff corroborates this, stating that they require supplemental
heat operation in their space. This could be considered as warranty work. Otherwise, the
Corrections List has been reasonably fulfilled.
2. Attached is a letter dated. February S, 200? from Vlasek Pump Co., subcontractor for
sanitary and storm sump pumps, outlining an agreement with the Contractor, Stoddard
Construction, promising to complete Work lacking for the specified storm sewer sump
system. Therefore, the storm sump appears resolved, although not fully tested; however,
failure to operate or alarm could be handled as warranty before March I, 2002. I viewed
the recently extricated pumps, which the Contractor was to have matched and were
reportedly existing in the storm sump when Phase 3 began; they are rated at 230/208 dual
voltage. If the County wis;~es to pay approximately $300.00 for the transformers to
correct to the required 208 voltage of the Courthouse, which the Contractor should have
provided correctly, the Owner may do so; however, we do not recommend such payment.
Please find the enclosed Final Certificate and Application for Payment (25), which reflects the
final amount due based on the Contract for Construction, plus Change Orders ]though 9. The
amount due, $311,513.84, includes all retainage amounts prescribed by the Contract Documents.
This office on November 29, 2001, received this application, but withholding submittal was
necessary (with your knowledge of course) until the Contractor completed the Work.
No action is taken by this office on the attached correspondence and legal documentation from
the Contractor concerning interest due on retainage amounts withheld pending completion,
claim for which was refereed directly to you for the County to consider. Such interest possibly

due therefor is a legal question beyond the scope of the Contract Documents, and upon which we
are not professionally empowered to respond. Thus, that interest amount is not represented on

Also, this architect has not reviewed the adequacy of lien releases, which we delivered directly
to you for review. The Owner may consider requiring final release of liens from contractors
after Final Payment.
Again, our firm and our consultants repeat our concern for certain minimum amount of
Emergency Electrical Power, as reflected in the attached copy of our December 3, 2000, letter.
All parties should understand that some emergency circuits are essential to maintain constant
operation of certain equipment for Life Safety Code, public health, and property protection
reasons, beyond daily operation.
Currently, performing the Warranty Inspections that applies to all Work of Phase 3 is timely,
except the interiors of Second Floor Annes, which expired October 1, 2001, and of which you
did not elect to have us inspect. The last of the one-year Warranties expires March 1, 2002. Our
firm will provide this inspection, along with representatives of the Owner, at no additional fees
to the Owner, if no written reports are required from our office.
I await your specitic directions, if there is anyrthing else that our firm(s) may do to expedite
closure of this project. We greatly appreciate the opportunities to provide professional
architectural/engineering services on these vital projects to Kerr County and to work with you on
Phase 3.

At the request of the Owner the following list of items was observed by the Architect and MEP Engineer on an
inspection conducted on February 19, 2002. The Contractor's supervised forces vacated the premises on April
27, 2001, and verbally declared ternrination of supervised on-site Work; however, Work on correction items
continued until earlier this month. This is a report to the Owner of currently observed Warranty items, which
General Contractor's Warranty period is set to expire by mutual ageement on Mazch 1, 2002.
The Owner did not request a Warranty Inspection on the Second Floor .4rtnex Interior Phase 3-A.
The following warranty correction items should be completed as soon as possible. Per Contract Documents all
Work is to be carried out by qualified trades and craftsmen.
GENERAL:
1. Remove efflorescence from brick by approved methods, previously furnished by architect,
protecting all other surfaces.
2. Of noted exception to this inspection is the upper reaches of the First and Second Floor of the
Annex which was largely inaccessible without adequate lifts, ladders, or other safe devices.
Architect and Owner's Representative are concerned that many of the windows remained in a
primed condition for over one year before the Contractor had them finish coated and protected.
Advanced deterioration was detected at Final Inspection. This date we spot checked the lower
portions of 8 first floor windows using a ladder and found 6 in need of remedy for exposed primer
or wood, excessive cracking on the sills, and /or lifting paint. If this ratio is indicative, the current
condition of all windows, control joints and upper walls needs to be re-inspected now, after eight
months of exposure for coating to determine final acceptability.
3. Patch and match minor cracks in exterior Lower Level concrete walls.
EXTERIOR

WEST RAMP
1. Some sealant in expansion joint installation is unacceptable on lower concrete swale -separation
is apparently due to surfaces not being cleaned and prepared properly. At existing courthouse
wall near area drain remove defective sealant and replace per Specifications and manufacturer's
instructions for cleaning, priming, prep, backer rod, asphalt separation, joint dimension, etc.
EAST RAMP

West walls. Also a few holes are open in control joint sealant of cast stone parapet caps.
2. Install 3 (minimum) mounting screws in EF#3 roof top cover which has none.
3. Replace all missing screws removed from access panels of RTU's.
1926 COURTHOUSE ROOF
1. Repair roofing at Southeast roof scupper drain. Air bubbles are visible coming through roofing
when standing on area next to standing water.
2. Repair bubble in roofing of penthouse on North side in the middle about 12" from edge.
3. Some sealant at existing cast stone parapet cap that has failed to bond. Remove sealant and
replace per specifications and manufacturer's instructions for cleaning, priming, prep, backer rod,
asphalt separation, joint dimension, etc., and replace.
4. Remove excess sealant and fill hole in sealant at removed window unit, west end of penthouse
INTERIOR
FIRST FLOOR LOADING DOCK
1. Cccr X20. Replace icc short damaged weatherstrip and install tack adhesive in grcove to
prevent it from sliding down, dragging the floor, and becoming damaged.
MAINTENANCE OFFICE
1. Refrigerant is leaking out of AHU-9; stop leak, clean piping, replace oily insulation.
LOWER LEVEL ANNEX LOBBY
1. Prove locations of, or install, backdraft dampers in exhaust ducts from Ex Mens and Ex Womens.
2. Door 59. Adjust door closer to meet 5 pound ADA/TAS requirements. Adjust door so as not to
scrape jamb and touch up paint; or replace, if not adjustable.
LAW LIBRARY
1. Screw down lower counter to handicap top at South wall, that is loose; re-apply matching sealant.
2. Repair or replace pull cords on blinds in South comer that have broken strings inside mechanism.

2. On north wall counter tops shims in silicone and without fasteners were used to level/mount
counters to steel brackets; some shims have fallen out. Blind-fasten counter up through shims and
brackets (per Law Library). Repair or replace fastener anchor used on middle metal support that
pulled away from wall due to missing shims. Apply matching sealant to counter and wall joint.
MEN 1
1. Repair openings in joints in flooring along exterior wall; clean smeared, discolored sealant from
flooring under lavatory counters.
2. Repair opening in joints in flooring in front of handicap urinal.
WOMENI
1. Replace openings in flooring joint at door threshold, jamb, and in vestibule.
2. Determine source of re-occurring mold on ceiling tife above handicap stall; replace damaged tiles.
STAIR 2
1. Tighten loose handrail bolts.
207 -COURTROOM I, Door 01. Re-install closure plate on bottom drop seal of left-hand reverse leaf
with removable screws into a durable substrate that will readily provide access, but remain in place.
This was actually a Phase 3-A warranty area, but it has never been satisfactorily remedied, since the
initial Corrections List.
