I would suggest the Court consider a variance to the extent that the corrections could
be made and this item could be brought to the court one time for final approval. It is
my understanding that the court is considering a "minor revision of plat" change to
subdivision rules, but [have not seen the exact language. The total change to the lot
size is 0.25 acre.

Reference: Request for exemption concerning a pin change on an existing lot line
(Horizon Subdivision lots 9 and 70)
Dear Kerr County Commissioners,
Please accept this letter as our formal request to be placed on the next regular scheduled
meeting of the Kerr County Commissioner's Court for consideration of a re-plat exemption.
Background Information: Due to an error in locating a comer pin (on lot 10 Horizon
Subdivision) the subsequent buyer purchased the lot thinking he had more frontage on the
cul-de-sac than was platted. Additionally the owner of lot 8 bartered to purchase lot 9, (the
lot 8 owner knew of the slight discrepancy in what the owner of loi 10 bought and what he
originally thought he was buying). The new owner of lot 9 (being the same owner as lot 8)
purchased with the intent of helping resolve this issue. All of the parties are in agreement to
slightly move this cul-de-sac boundary pin to reflect the ne•,v survey (see attached).
In preparing this change we contacted Franklin Johnston and Truby Hardin (830-25i-2993)
at the Kerr County Engineer's Office. After meeting with Truby Hardin and discussing this
issue, we determined that this slight change of boundary line may qualify for a exemption
to the minor re-plat. She suggested that I talk with the phone company and the electric
company to see if they had any problems with any sideline easements. I met with James D.
Riley (Kerrville Telephone Engineering Department 830-257.9129) and he pulled their
maps and said that their lines had already been run in that area. He felt that an exemption
didn't propose a problem but he would get me a letter if I needed one showing their
willingness to exempt a minor re-plat. Addftionally I met with an engineer at the Central
Texas Electric Co-op and he suggested that i talk to Pat Duecker. Since the easement is on
the property line and only one pin on the property line would move we felt like an
exemption would be the most efficient and most equitable way to resolve this issue instead
of a minor re-plat.
Please accept this letter as our formal request to waive tl?e minor re-plat requirement. Please
see attached survey and field notes showing the one pin change and slight variation of the
' e lot lin . Your c nsideration on this matter is deeply appreciated.
