Lessee agrees that each Unit, upon its return, shall:
MAINTENANCE AND GENERAL REQUIREMENTS:
• Give the Lessor sixty (60) days notice pdor to the Lease termination date of Lessee's
intention to return any and all units to the Lessor,
• Return the units in Ne same con(guration, with all attachments, as when delivered at
lease inception. Lessee is responsible for costs, inludirg but not limited to, fees,
taxes and duties assolated with tear down, loading, shipping and unbading of units to
a site designated by the Lessor.
• Ensure the units upon reNm are thoroughly leaned, steam leaned tt available, and
free from all oil, hydraulic and fuel leaks.
• Operate and maintain all units in accordance with Caterpillar Lubdcation and
Maintenance and Operators guide books, and insure all maintenance is pedormed at
recommended intervals and ony genuine Caterpillar filters and pads are used for all
maintenance and repairs. All units must be in good operating condition and be able
to perform all tasks under rated load.
• Enroll all units in a Cateryillar dealer Scheduled Oil Sampling (SOS) or comparable
program, where available, for the entire term of the lease, and insure all fuels,
lubricants, additives, and radiator water is dean and complies with Caterpillar
recommended standards.
• Ensure all units are operated onty in the applications for which they were designed and
manufactured.
• Maintain a working engine hour meter at all times. Keep complete recerds of all hour
meter dranges akxg with major component change outs and routine maintenance aM
repair records.
• Ensure all service contracts are fully implemented and atl maintenance and repairs are
made on schedule. Product Improvement Programs (PIP'S) must be complete before
units are returned. ATTACH A COPY OF ANY AND ALL REPAIR AND
MAINTENANCE CONTRACTS AND PLANNED COMPONENT REPLACEMENT
PROGRAMS.
• Provide a secured place to store off-lease units upon request from the Lessor
Provide access to the units for purposes of maintenance or demonstration to
prospective buyers at Lessors request
SPECIFIC TINWARE AND SAFETY REQUIREMENTS:
• Ensure the operators compartment is clean, and all switches, monitodng systems
(EMS, VIMS, VIDS), gages, control levers, pedals, mda, minors, seats, insulation and
all other contents are complete and in goad working order.
• Ensura all window glass is c gar, and free from cracks and major pits, au wmdr~w
frames, doors and weathe stnppmg are complete, and all service accsss
companment covers and door.;, fenders, and other flat metal or plastic surfaces are in
good working order and hee from dents and cracks.
• Ensure all standaM Caterpillar and non-Catepillar safety items are complete and in
good working order, including but not limited to, roll over protection CROPS) and falling
object protection (FOPS) systems, seal belts, steps, safety rails, grab irons, cat walks,
fre suppression systems, warning alarms, cameras and monitors.
• Ensure all electrical components, including but not limited to, wiring harness, batteries,
attemators, drive belts, lighting and air conditioning systems are complete and in good
working order.
• Ensure all repairs made to m;~in structures, including but not limited lo, main frames,
roller frames, car bodies, swing gears, drawbars, circles, cromponent housings, loader
arms, booms, slicks, tag lino;, loader linkages. Vuck bodies, buckets, rippers, a~~~d
arches must be accomplished m accormance wnh. factory recommended materials a.~d
repair procedures.
REMAINING LIFE REQUIREMENTS:
• Ensure all ground engaging tools, including but not limited to, buckets, dozer blades,
base cutdng edges, dppers, scadfers, drums, feet, tines, weeds, elevator Rights,
forks, and top clamps have good structural integrity and have ffty percent (50%)
minimum remaining I'rfe.
• Rehm all track and rubber belled units with a minimum of fifty percent (50%)
remaining Irfe on each and every component including but not limited to, trade shoes,
links, pins, bushings, idlers, bogies, sprockets, Gamier rollers, and tmdc milers Belts
can not have any ats that extend into the cords and must not be missing guide
blocks orgrouser bars (lugs). Charges will be assessed for each component not
meeting the requirement.
• Return all rubber lire units with a minimum of fifty percent (6G %) remaining lile of the
original tread life of each tire. Recapped tires are not acceptable substitutes. All tires
must be a matched set with tha same Vead type and pattern and have nro significant
cuts or chunking of the tread or side walls. Skid Steer tires am exempt from this
provision.
LESSOR RETAINS THE RIGHT TO ASK FOR ANY AND ALL REPAIR AND MAINTENANCE RECORDS DURING THE LEASE TERM
AND/OR LEASE TERMINATION. A FULL MACHINE INSPECTION MAY BE CONDUCTED AT LESSEE'S EXPENSE ANY TIME
EVIDENCE DEMONSTRATES MACHINES ARE BEING ABUSED FROM NEGLECT OR MISAPPLICATION.
REMEDY FOR RETURN CONDITIONS:
Lessee will be invoiced for the parts and labor based on your local Caterpillar dealer's retail prices and retail labor rates to replace tires, undercarriage
components, belts and all other non-conforming components as outlined in the "REMAINING LIFE REQUIREr11ENTS" section of the Mandatory
Condition of Equipment Upon Remm. The invoiced amounts will be based on the following percentages of remaining life and is payable upon receipt of
invoice:

MAXIMUM USAGE:
The model listed and equipped as stated above will be operated an estimated total of hours per month aver a term of months for total usage
during the leasing term of hours. This total usage combined with any accumulated hours prior to the Le ise inception date as stored above under
current hours, will be the total allowable machine hours for [he life of [he Lease and the basis for any overuse ch,uges.

7. There is no litigation, action, suit or proceeding pending or, to the best of my knowledge, threatened against or
affecting Lessee in any court or before any governmental commission, board, agency, arbitrator or authority which, if
adversely determined, will Lave an adverse effect on the ability of Lessee to perform its obligations under the Lease. In
addition, I am not aware of :iny facts or circumstances which would give rise to any litigation, action, suit or proceeding

I. General
A. Kerr County Clerk will accept sealed, competitive bids for the lease of one (1) Wheel
Loader.
B. Bids must be submitted no later than 5:00 p.m, Friday, Mazch 8, 2002, at the Kerr
County Clerks Office. Bids will be opened at 10:00 a.m., Monday, Mazch 11, 2002, at
the Kerr County Commissioners Court. Bids must be original and in sealed envelopes
cleazly marked "Sealed Bid 0035-02." Bidders are invited to attend the bid opening.
C. Bids must be submitted on the Bid Forms as provided with this Invitation for Bids, or
a copy thereof. Bidders must provide unit prices for each Item Number on the Bid
Sheet. A "No Bid" or blank quote for any Item Number on the bid Sheet will be
considered a rejection of the entire bid. A "No Chazge" or "Zero" quote will be
considered as incurring no cost to the County.
D. Kerr County is not responsible for late delivery by the United States Postal Service or
any independent carrier. Late bids will be returned unopened without consideration.
Facsimile transmittals aze not acceptable.
E. Bid awazd will be made to the responsible bidder offering equipment meeting
specifications at the lowest total price as shown on the Bid Form.
F. Kerr County reserves the right to accept or reject any or all bids.
G. As this bid is expected to exceed $25,000.00, a bid bond often percent (10%) of the
bid price must accompany each bid. Bonds submitted by unsuccessful bidders will be
returned within ten (10) days of bid opening. The bond submitted by the successful
bidder will be returned upon equipment delivery.
H. All equipment ordered by the County must be delivered, at no cost to the County, to
Ken County Road & Bridge, 4010 San Antonio Hwy., Kerrville, Texas '78028.

II. Guazanteed Total Maximum Repair Costs
A. The bidder shall state on the Bid Form the guaranteed maximum total costs to the County
for repair of the wheel loader specified herein, pursuant to the terms stated herein.
B. The County will assume responsibility for all repair costs resulting from damage due to
fire, windstorm, flood and rising waters, lightning, theft and pilferage, vandalism,
accidents, and operator and mechanic's negligence. Total cost of the repairs due to the
above circumstances will not be included in computing the guazanteed maximum total cost
of repairs covered under the contract.
C. The successful bidder shall pay for all repairs (including parts and labor) to the equipment
covered by the manufacturer's warranty, and these costs shall not be included in the
guaranteed total costs of repairs.
D. The County shall assume, at it's expense, all costs including labor to repair or replace all
parts and components normally consumed in day-to-day operations such as tires, tubes,
fire repairs, lubricating oil, filters of all types, grease fuel, antifreeze, cutting edges,
batteries, headlights, glass breakage, belts, braked lining, cleaning and painting. These
costs will not be included in computing the guaranteed maximum total cost of repairs
under this contract.
E. At the termination ofthe contract, the vendor agrees to pay to the County the cost of
repairs that aze in excess of the amount bid on REPAIR EXPENSE.
F. The County shall maintain the equipment in accordance with manufacturer's
recommendations.
G. The successful bidder has the right to inspect the equipment during normal department
working hours and to make recommendations for repairs and improved maintenance in
keeping with the requirements stated by the manufacturer in the shop manual for the
maintenance and repair of the equipment.
H. Any repairs, other than those covered in subpazagraphs B, C, and D ofthis section, which
exceed $100.00 may be repaired by the vendor, at his option. If the vendor chooses to
repair the equipment, repairs shall commence within one (I) day after notification by the
County.
L The accumulation of charges from County labor and parts, as well as vendor invoices for
repairs, other than those covered in subparagraphs B, C, and D of this section shall be the
basis for computing the guazanteed maximum total cost of repairs under this contract.

J. The vendor shall have the right to examine repair costs at any reasonable time. Should a
dispute occur between the County and the vendor, as to whether a charge should be
included in computing the guaranteed maximum total cost of repairs, then the entire
matter shall become subject to azbitration as set forth in the bid documents.
