KERR COUNTY RULES AND REGULATIONS FOR PARK AND RECREATION AREAS SECTION I. GENERAL AUTHORITY The County of Kerr shall have and shall exercise the power to control all activities, hours of visitation, and days and times of opening to the public all County Parks in order to properly serve and protect the citizens of this community. The said Pazks shall be under the direct supervision of the Facilities and Use Department and the Kerr County Sheriff. The Facilities and Use Department is chazged with the responsibility of scheduling and supervising the use of County Pazks in accordance with policy and procedures approved by the Commissioners Court. These officials shall have the authority to delegate their power of supervision to other employees of their respective departments. The Sheriffs Department of Kerr County is chazged with the responsibility of maintaining law and order in all of the County Pazks. To protect the peace, health, safety and general welfare of the public. In order to carry out this provision, the Sheriffs Department, and any and all officers therein, shall have the authority to make arrests for violation of any state law or Kerr County Commissioners Court Order pertaining to these Rules and Regulations. SECTION 2. APPROVAL AND SCHEDULING OF EVENTS All Events must be approved and scheduled in advance by making application for such use at the Facilities and Use Department. Events must conform to the permitted uses described in the Kerr County Facilities Use Policy Manual. Special Events or activities not permitted in the Kerr County Pazks and Recreation Department Policy Manual, must, by application, be submitted to the Kerr County Commissioners Court for prior approval. SECTION 3. CLOSING HOURS All County Pazks, Dams, and Recreation azeas shall be open to the public daily during the hours of 7:30 a.m and 10:00 p.m., except as provided hereafter. Pazks shall be closed to the public from 10:00 p.m. to 7:30 a.m. Access to all boat ramps and the immediate azeas adjacent thereto shall be open 24 hours per day for the purpose of launching and retrieving boats. All azeas may from time to time be closed by orders of the Commissioners' Court, through the Facilities and Use Department or Sheriff for the purpose of rehabilitation, cleaning, general supervision, or to protect the health, safety and general welfaze of the public. Requests prior to use, for any Pazk or Recreation Areas during the hours they aze normally closed must be obtained by submitting an application for approval to the Ken County Commissioners' Court. It shall be unlawful for any person to enter or remain in a County Pazk, Dam, or Recreation area during hours when they aze closed as set out above without prior approval of the Kerr County Commissioners Court. 1 For the purposes of this Section, "Kerr County Park and Recreation azeas" includes all azeas of the same used for parking of vehicles. Such pazking azeas shall be defined as County Roads and shall be supervised and regulated by the Sheriffs Department of Kerr County as all county roads aze. Further, the prohibition in this Section includes individuals who aze sitting inside their vehicles while pazked in any of the pazking areas. SECTION 4. SAFETY It shall be unlawful for any person to: 1. Act in any dangerous or unsafe manner in any Pazk, Dam, or Recreation azea. 2. Use or ignite fireworks of any description in or from a County Pazk or Dam. SECTION 5. OVERNIGHT CAMPING, PARKING, ETC. It shall be unlawful within any County owned Pazk, Dam, or Recreation azea to: 1. Camp overnight, or 2. Pazk any portable buflding, camping unit of any type, or motor vehicle overnight without special permission, or 3. Allow use of any equipment or activity between the hours of 10:00 p.m. and 7:30 a.m. each day; and 4. Fail to take notice the activity was forbidden or received notice to cease or remove the violation and failed to do so. Notice shall be defined in Section 3 above. Exception to this Section shall only be granted by prior written approval of the Ken County Commissioners' Court, through the Facilities and Use Department. SECTION 6. VEHICLES A. It shall be unlawful in a County Pazk or Recreation azea for any person to: 1. Drive any motor driven vehicle into, along or across any grassy azea unless it is a public roadway maintained by Ken County for the operation of such vehicles. 2. To drive upon any hike-bike trail, footpath or footbridge spanning a creek or stream located therein. 3. Self-contained Recreational Vehicles that are part of an approved, organized event may be allowed overnight in a Park during the event only with prior written approval of Kerr County Commissioners Court obtained through the Facilities and Use Department. 2 This Section 6A shall not apply to powered golf carts, wheelchairs, or vehicles being used strictly for the purpose of loading or unloading freight therein or in the construction, maintenance or repair of said public Pazks or Recreation azeas which aze owned or maintained by Kerr County or with the prior written approval of the Kerr County Commissioners' Court, through the Facihties and Use Department. B. It shall be unlawful for any person to operate any vehicle on any street, drive, roadway, or surface within any County Pazk or Recreations azea at a speed greater than twenty (20) miles per hour. C. No person shall park a vehicle upon any County-owned or maintained park lands, or public recreation areas for the principal purpose of: 1. Displaying such vehicles for sale, or 2. Washing, greasing, or repairing such vehicles except repairs necessitated by an emergency. SECTION 7. MISCELLANEOUS PROVISIONS It shall be unlawful in a Pazk, Dam, or Recreation area for any person to: 1. Pick, pull, pull up, tear up, dig up or out, mutilate, break, bruise, injure, burn, remove, carry away, or destroy any tree, shrub, plant, vine, flower, moss or vegetation, or portion thereof, including but not limited to leaf, mold, foliage, berries, fruit, grass, turf, humus, cones, dead or downed wood, except by prior written approval issued by the Kerr County Commissioners' Court for scientific or educational purposes, through the Facilities and Use Department. 2. Build ground fires except in designated fire rings, pits, or grills. 3. Climb trees. 4. Maintain noise and sound levels of groups, individuals, radios, or any sound equipment at a level considered to be a nuisance as deemed by Kerr County. 5. Engage in any commercial venture without the written permission of the Kerr County Commissioners' Court, through the Facilities and Use Department. SECTION 8. LITTERING It shall be unlawful for any person to: I. Bring, use, carry or dispose of a glass container in any County Park, Dam, or Recreation area. 2. Throw, deposit, place or drop loose paper, cans, bottles, sacks, boxes, cloths, waste materials, or any kind of rubbish on or alongside any 3 street, alley sidewalk, body of water, playground, or recreation azea of County Pazk land within the County of Kerr. SECTION 9. PETS It shall be unlawful for any person to have any pet unleashed in a Ken County Park, Dam, or Recreation Area. SECTION 10. PENALTY A violation of any of the provisions of Sections 3 through 7 herein shall be deemed a misdemeanor and upon conviction thereof a person shall be fined pursuant to the Texas Penal Code and other applicable laws. SECTION 11. All other Orders or parts of Orders in conflict herewith are hereby repealed to the extent that they are in conflict. SECTION 12. If any provision of this Kerr County Commissioners' Court Order shall be held void or unconstitutional, all other parts which aze not held void or unconstitutional shall remain in full force and effect. 4 Backup Material for Ageuda Item With summer approaching, and useage of County-owned facilities rising, it is timely for Commissioners Court to discuss and adopt a set of Rules and Regulations governing use and activity at or in Pazks, Dams, and Recreational Areas. Kerr County Sheriff s Department has limited authority to stop unwanted activities absent the adoption of Rules and Regulations. There is considerable activity that disturbs the peace taking place at Center Point Riverside Pazk of which the community complains. Enactment of Rules and Regulations will enable Kerr County Law Enforcement personnel to have a basis upon which to regulate this type of activity.
