TEXAS WORKFORCE C E N T E R Operated by Alamo Area Development Corporation NON -FINANCIAL COOPERATIVE AGREEMENT FOR WORKFARE (FOOD STAMP, EMPLOYMENT and TRAINING) 1 AUTHORITY The parties hereto are authorized to enter into this non-financial agreement by 7 U.S.C., §2029, which creates Workfare. The parties entering into this agreement are the Alamo Area Development Corporation, hereafter referred to as AADC and KERR County. Food Stamp, Employment and Training (FS, E&T) recipients, for whom this agreement is developed, are hereafter referred to as participants. 2 AGREEMENT PERIOD 2.1 This agreement becomes effective on the date signed by both parties and will continue in effect until terminated by: 2.1.1 mutual agreement of both parties on the agreed upon date. 2.1.2 either party giving 30 days' prior notice to the other party. Evidence of written notice may include mail, return receipt, or other acceptable third party documentation. 2.1.3 AADC, immediately and without prior written or verbal notice to KERR County for violations of the terms and provisions herein or any applicable law, regulation or policy. 3 PURPOSE AND GOAL 3.1 The purpose of this agreement is to establish worksites FS, E&T participants so as to refer and engage in workfare activities with KERR County. 3.1.1 KERR County has the following sites from which WEP participants may select: Name: KERR County Address: 700 Main, Kerrville, Texas 75028 Phone: 830.792.2200 Contact: Bill Williams, County Commissioner 3.2 The goal of workfare is to improve employability and enable participants to move into regulaz employment. 4 OUTCOMES 4.1 Successful implementation and practice of this agreement will result in FS, E6iT participants obtaining valuable training in a controlled work environment. 4. 2 Participants who successfully participate under this agreement will have greater potential for employment in a stable job with benefits. 4. 3 While activities under this agreement may prepare participants for employment with KERR County, no guarantee of employment is made. 4.4 KERR County may expect: 4.4.1 To receive the assistance for a predetermined amount of time, of an able• bodied, motivated participant, that has limited work experience and job retention skills (dependability, reliability, and interpersonal skills) but is in need of accessing the opportunity to practice and further develop those skills 4.4.2 To share in the satisfaction gained in helping participants realize their goal of achieving selfsufficiency. REFERRAL AND TRACKING PARTICIPATION 5.1 Referral 5.1.1 If determined appropriate, as per the participant's work plan, he/she maybe referred to KERR County for participation in workfare activities under the terms of this agreement. 5.1.2 The participant is referred to the worksite using referral form provided by the participant's Career Counselor. 5.2 Tracking 5.2.1 The participant will be provided with a form to record weekly hours of work participation. 5.2.2 The form will be kept by the participant and reviewed weekly by the designated KERR County supervisor to ensure accuracy. The designated supervisor will initial the record. 5.2.3 The participant will return the record weekly to his/her Career Counselor. 6 MEETINGS AND COORDINATION 6.1 Representatives of KERR County and AADC will meet quarterly to assess the activities conducted under this agreement and to make adjustments to improve the results of this agreement. 6.2 The contact people for this agreement are: (KERR County) Name: Bill Williams, County Commissioner Address: 700 Main Kerrville, Texas 78028 Phone Number: (830) 792.2200 (Alamo Area Development Corporation) Name: Susan Lodge, Workforce Center Coordinator Texas Workforce Centers Address: 8700 Tesoro Drive Suite 700 San Antonio, TX 78217 Phone Number (210) 362-5230 7 MUTUAL AGREEMENTS 7.1 Both parties will coordinate development and implementation of this agreement with appropriate site staff. 7.2 The workfare activity must be related to the capability of the participant to perform the task on a regular basis including physical capacity, skills, experience, family responsibilities and accessibility. 7.3 The total daily commuting time to and from the workfare work site to which the participant is assigned must not exceed 2 hours. 7.4 The total hours of participation will not exceed 30 hours per week and the participation period will not exceed 3 months. 7.5 All participants have the rights available under federal, state, and local law prohibiting discrimination on the basis of race, sex, national origin, religion or a handicap condition. Individuals alleging discrimination may choose to have their complaints processed as an FS, E6iT dispute, as a violation of other applicable state and local laws prohibiting discrimination in employment or as a violation of 45 CFR parts 80,84, and 91. 8. KERR County AGREEMENTS S.1 KERR County will identify position (s) that will enable the workfare participant to gain skills and experience necessary to compete in the labor market for comparable position(s). Job descriptions for each position covered under this agreement will be prepared. As a minimum, the job description will include type of work to be performed, minimum qualifications required to perform the job, and work rules and hours. 8.2 Workfare participants engaged in activities at KERR County worksite(s) are subject to the same health and safety standards established under state and federal law that apply to paid employees in similar activities at the KERR County worksite(s). 8.3 The workfare activity must not result in the displacement of any current worker or position, including partial displacement. 8.4 The workfare activity must not impair existing contracts for services or collective bargaining agreements. It must not result in the employment or assignment of a participant or the filling of a position when any other person is on layoff from the same or substantially equivalent job within the same organizational unit or when an employer has terminated or otherwise reduced its workforce. The activity must not infringe in any way on promotional opportunities of any currently employed individual. 8.5 KERR County shall comply with the work plan developed for each participant by Career Counselor staff and provide regular performance evaluations of participants. 9. AADC AGREEMENTS 9.1 The conditions of participation must be reasonable, taking into account in each case the proficiency of the participant. AADC will respond, in a timely manner, to KERR County concerns addressing participant employability goals. If determined not suitable for the workfare activity, participants will be removed from such activity. 9.2 Grievances (excluding complaints alleging discrimination) that cannot be resolved at the local level will be forwarded to the appropriate TWC State Office for resolution, as outlined in 40TAC, Chapter 823. 9.3 Grievances regarding nondiscrimination compliance may be filed with TWC, as outlined in 40TAC, Chapter 823 or with the Secretary of the Administrator, FCS, Washington, DC. 20250, as outlined in 7 CFR, 272.6.
