RESOLUTION A RESOLUTION OF KERR COUNTY, TEXAS, AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE OFFICE OF TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS FOR HOME DISASTER ASSISTANCE; AND AUTHORIZING THE COUNTY JUDGE TO ACT AS THE EXECUTIVE OFFICER AND AUTHORIZED REPRESENTATIVE IN ALL MATTERS PERTAINING TO THE COUNTY'S PARTICIPATION IN THE TEXAS COMMUNITY DEVELOPMENT PROGRAM. WHEREAS Kerr County suffered extensive damage to homes within both incorporated and unincorporated azeas; and WHEREAS property owners affected by the recent flooding conditions will need assistance to rebuild or rehabilitate homes damaged or destroyed; and WHEREAS the President of the United States declared Kerr County as part of the Disaster Area eligible for assistance from the Federal Emergency Management Agency and other disaster relief programs; and WHEREAS certain conditions exist in the community which represent a potential threat to public health and safety; now THEREFORE BE IT RESOLVED 1. That a Texas Department of Housing and Community Affairs application is hereby authorized to be filed by GrantWorks on behalf of Ken County for funding consideration in an amount up to $500,000; and 2. Ifapproved for funding, Ken County could begin taking applications no sooner than October 2002, with the understand that approved funds are expected to be released by TDHCA no sooner than eazly 2003. Williams Commissioner, Precinct 1 Commnissioner, Precinct 2 Jonathan i,etz Commissioner, Precinct 3 harry Griffm Cornrnissioner, Precinct 4 PUBLIC HEARING KERR COUNTY, TEXAS TEXAS COMMUNITY DEVELOPMENT PROGRAM OFFICE OF RURAL COMMUNITY AFFAIRS HOME INVESTMENTS PARTNERSHIP FUND TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS JULY 30, 2002 Citizen Participation Plan: The County is required by the TCDP to hold one (1) public hearing for any and all TCDP applications submitted in a given six-month period. This public hearing covers the period July 30, 2002 through January 31, 2003. During this period of time, the TCDP requires that any and all applications for assistance will be publicly announced in the local newspaper before they are officially submitted to the funding agency. The announcement will include the name of the specific grant program, the amount requested, the target area if any, and the uses of the funds. In addition, any and all applications will be available for public review at the County Judge's Office after the public announcement. Local Housing & Community Develonment Needs: Open to public comment. Projects except disaster relief must address the needs of low and moderate income residents in the unincorporated portion of the County. Eligible Activities/Available Funding Amounts: Texas Community Development Program grants are available through several Funds: Community Development-$250,000 with a 5% match, used for water, sewer, streets, drainage, and housing assistance. Available once every two years in a biennial funding competition. Scoring is shared between the region and the state with highest priority given to water and sewer projects. No projects other than water and sewer projects have been funded in the Alamo Area in several years. Next deadline: September 26, 2002. Colonia-$500,000 with required match (depends on the specific project), used primarily for first-time water and sewer facilities in unincorporated communities within 150 miles from the Texas-Mexico border whose residents are at least 51 % low and moderate income. Housing-$250,000 with no required match, used to rehabilitate or reconstruct homes occupied and owned by low and moderate income residents. Available once every two years in a biennial funding competition in lieu of a Community Development grant. Next deadline: September 26, 2002. Disaster Relief-$350,000 with no required match, used to assist with meeting the 25% local match required by FEMA Public Assistance, categories C-G or USDA-NRCS Flood Mitigation. May also be used for housing assistance. One application per event, rolling deadline, first- come, first-served. Other Fund categories: Texas Capital Fund (up to $750,000) for economic development; Housing Infrastructure (up to $500,000) for utilities and infrastructure related to new housing development for low and moderate income residents; Planning/Capacity Building fund (up to $50,000) to provide comprehensive planning for local governments; STEP (self-help, up to $350,000) to provide water and sewer services using volunteer labor. Most HOME Program funds are used for various forms of housing assistance through an annual competition. Up to $500,000 per eligible entity is available to rebuild or rehabilitate homes damaged or destroyed in a federally declared disaster area. Eligible entities include Cities, Counties, and 501(c)(3) non-profit corporations that are in good standing with the Texas Comptroller of Accounts. Assistance of up to $55,000 per unit is available. The program typically targets lower income and elderly residents who do not have any or adequate insurance coverage and have no other means of making their homes livable. If a grant award is made, applications are taken locally, then are ranked and scored based upon criteria adopted by the governing board of the applicant. All homes that receive benefit must (1) have been reported to FEMA (letter required) and (2) be elevated above the 100-year flood elevation. Prior FEMA individual assistance does NOT prevent a home from receiving further assistance if necessary under HOME. The earliest applications will be available for submittal to TDHCA is October 2002. We do not expect funds to be released by TDHCA until early in 2003.
