TAX COLLECTION AGREEMENT

Whereas, the UPPER GUADALUPE RIVER AUTHORITY (UGRA) and the
COMMISSIONERS' COURT OF KERB COUNTY have the power and authority with
reference to the terms ofArticle 4413, (32c), Vernon's Texas Civil Statutes, as amended, and
Section 6.24, Texas Property Tax Code, to authorize the KERB COUNTY TAX
ASSESSOR-COLLECTOR to act as the Tax Assessor/Collector for the UPPER
GUADALUPE RIVER AUTHORITY.
Now, therefore, for the consideration hereinafter expressed and the mutual conditions
hereof, it is mutually agreed by and between the UPPER GUADALUPE RIVER
AUTHORITY, a political subdivision duly organized and existing under the laws of the State
of Texas, and KERB COUNTY, as follows:
TERM. This contract shall begin on October 1, 2002, and shall remain in effect unless
terminated as provided herein below.
TAX COLLECTIONS. The KERB COUNTY TAX ASSESSOR-COLLECTOR agrees to
collect on behalf of the UPPER GUADALUPE RIVER AUTHORITY, all ad valorem taxes,
penalties and interest due, or which may become due, or which may become due to the
UPPER GUADALUPE RIVER AUTHORITY during the time this contract is in effect, and,
in addition, delinquent taxes, penalties and interest for taxes assessed prior to this contract.
THE KERB COUNTY TAX ASSESSOR-COLLECTOR shall prepare and mail all tax
statements; provide monthly collection reports as well as daily and weekly reports upon
request to the UPPER GUADALUPE RIVER AUTHORITY; maintain both current and
delinquent tax rolls; and develop and maintain such other records and forms as are necessary
or required by law or State rules and regulations.
RECORDS. The UPPER GUADALUPE RIVER AUTHORITY, without further cost, shall
at any time be permitted to inspect and copy all records, including appraisals, assessments,
bills, statements, computer tapes, and any and all other material in the possession of the
KERB COUNTY TAX ASSESSOR-COLLECTOR in any way pertaining to the billing and
collecting of UPPER GUADALUPE RIVER AUTHORITY taxes, penalties and interest. In
the event of the termination of this Contract, the UPPER GUADALUPE RIVER
AUTHORITY shall be entitled to have all such records and materials, or copies thereof,
turned over to UGRA.
TERMINATION. Either party may terminate this Contract as of October I of any calendar
year by giving written notice as such termination prior to July 1 of that calendaz yeaz.
COMPENSATION. The County, as compensation for the obligation assumed hereunder,
shall be paid one percent (1%) of the current and delinquent ad valorem UGRA taxes,
penalty and interest actually collected on behalf of the UPPER GUADALUPE RIVER
AUTHORITY.
REMITTANCE OF COLLECTIONS. The Kerr County Tax Assessor-Collector shall remit
all taxes, penalties and interest collected for the UPPER GUADALUPE RIVER
AUTHORITY, less compensation to the County to the offices ofthe UPPER GUADALUPE
RIVER AUTHORITY. The County shall provide an itemization showing all collections and
adjustments with the remittance. Remittance shall be made weekly when receipts on hand
exceed $2,500.00. When receipts on hand are less the $2,500.00, remittance will be made
monthly.
DELINQUENT TAXES AFTER TERMINATION. After expiration of this Contract, the
Kerr County Tax Assessor-Collector shall furnish the UPPER GUADALUPE RIVER
AUTHORITY an itemization of all delinquent taxes, penalties and interest, and Kerr County
shall have no further obligation to collect same.
