The first Sexual Assault Nurse Examiner witness in our court was from San Arrtonio and testified in 1996. She was indirectly responsible for the first Kerr County nurses receiving sexual assault training Sap Antonio. As the nurses in Kerr County worked to establish a SANE program and to obtain their certifications, our office both worked with them and benefited from their expertise. As you know, sexual assault examinations are critical in many sexual assault cases, especially those irrvolving children. Most doctors lack the expertise and the desire to do those exams. It is a rare doctor to wants to appear and testify in court about arty patient. Because the extensive training of the SANI s includes medical, forensic and psychological aspects, a SANE is allowed to testify to the medical history as given by the patient (or by the adult caregiver when a child is essentially non- verbal) as wet[ as to the results of the physical examination and the more specialized sexual assault exam. A SANE functions as an evidence gatherer in completing rape kits for DNA and hair and fiber samples and in using the colposcope, an expensive piece of magnifying equipmerrt which allows examination of the sexual organs of a child in a way that is both less traumatic to the child and recordable. In addition to testifying to those results, a SANE is qualified to testify about the statistics of varies kinds of evidence that is or is not usually found in sexual abuse cases. To maintain their expertise and certifications, SANEs are required to do a given number of examinations each year, to attend trainings, and to watch court proceedings. So far as we knew, the SANE program in Kerr County was functioning well. We had numerous cases each year in which Sexual Assault Nurse Examiners were subpoenaed to testify and many more cases in which a defendant accepted a plea bargain in part because of the potential testimony of a SANE at trial. Our Kerrville SANEs have come to court in four of the five counties in the 198' district. Since the establishment of the SANE program in Kerr County in the late 90's, a SANE had been on-ca1124/7, on-~all time that was volunteered by the SANEs. Sid Peterson Hospital had supported and primarily funded the program, so it came as a swprise to ow office when the program was shut down and the colposcope was put urto storage. Not having a SANE program in Kerr County means that victims must travel all the way to San Antonio. Most sexual assault victims, adults and children, are reluctant to disclose their assaults and many will not or cannot make the additional trip into San Antonio for an examination. A delay in examination can result in the loss of forensic evidence. Because we handle almost all sexual assaults in Kerr County as well as all ofthose in ow other fow counties, the SANE program is very important to us in suG~,essfully prosecuting cases of sexual abuse. The medical component is comprised of referrals for sexual assauh exams. Specially trained Sexual Assault Nurse Examiners should perform all sexual assault exams. Until June of 2002, sexual assault victims were refereed to Sid Peterson Memorial Hospital for S.A.N,E. exams. Because of funding issues the S.A.N.E. program has been put on hold and all sexual assault victims have been refereed to San Antonio. The additional trauma for sexual assault victims to be transported to San Antonio is tremendous. Our community has the resources and trained personnel to operate a S.A.N. E. program locally but we have a desperate need for funding. Kids' Advocacy Place fully supports the Kerr County's Sheriffs Office's application for funds. The S.A.N.E. program is a very important community service that benefits victims of sexual abuse and their families. This funding application will not conflict or compete with airy of Kids' Advocacy Place's support grants. Please give careful consideration to this much-needed program. The majority of the victimized women, men, teens and children have been residents of Ken- County, although Bandera, Kendall, and Gillespie County residents are also served through outreach offices of the Crisis Council. One of the most crucial elements of providing effective services for sexual assault victims is early intervention. The experience of sexual assault has been described as "surviving one's own murder." The trauma does not stop after the victim reaches what appears to others as a safe place. The window of time immediately following the assault, or after the victimization becomes known, is extremely traumatic and chaotic for the survivors and their families. It is crucial to the healing of the victim and loved ones that trained personnel intervene quickly in the most non-threatening environment. The Crisis Council provides trained staff and volunteers on call 24 hours a day, 365 days of the year to respond to the needs of victims and families - at no charge. But without the Sexual Assault Nurse Examiner (SANE) program functioning at Sid Peterson Hospital, these vital services are not available to help victims and their families in their time of immediate need. The Sexual Assault Response Team (BART) approach is recognized nationally as best practices for response to sexual assaults and for protecting the community. A local SANE program is crucial to this team approach. With local SANE personnel as a part of the crisis response, victims' advocates connect with victims immediately and can work effectively with law enforcement and prosecution in a unified response.
