To: Mr. Bill Williams, Commissioner Pct. 2 Date: 03/03/03 Subject: Overview ofNon-Financial Worksite Training Agreement This agreement allows persons receiving Temporary Assistance to Needy Families and/or Food Stamps through the Texas Department of Human Services to volunteer for Kerr County up to 30 hours per week for a period of up to 3 months. The goal of the program is to provide hands-on work experience. This experience will help the recipient compete for, and ultimately obtain employment in our community. Kerr County will identify available positions from its current job descriptions. Volunteers will not be paid by the County, but will obtain valuable training in a controlled work environment. Kerr County will determine an appropriate selection process and training of referred participants who would adapt well to the available job activities. If, after meeting, the participant and Kerr County agree to participate, an Individual Agreement form is completed to indicate the hours, duration, and duties of the work activity and is then signed by the Kerr County representative, the participant, and a Workforce Representative. The participant will keep a record of weekly hours to be approved and signed by the Kerr County supervisor. Representatives of Kerr County and Alamo Area Development Corporation will meet quarterly to assess volunteer activities. This training activity must not result in the displacement of any current County employee. Ken County will evaluate each participant through the use of aPost-Volunteer Evaluation Summary. Alamo Area Development Corporation has procedures set-up for resolving complaints or grievances, should they arise. If determined not suitable for the work activity, participants will be removed from the volunteer activity. Alamo Area Development Corporation has coverage under a Special Risk Accidental Insurance policy if a participant is injured while volunteering with the County. n TEXAS WORKFORCE C E N T E R NON-FINANCIAL WORK SITE TRAINING AGREEMENT BETWEEN KERR COUNTY AND ALAMO AREA DEVELOPMENT CORPORATION 1. AUTHORITY 1.1. The parties entering into this agreement are the Alamo Area Development Corporation, here after referred to as AADC, and KERR COUNTY. 1.2. Temporary Assistance (TANF) for Needy Families and Food Stamp, Employment and Training (FS E&T) recipients, for whom this agreement is developed, are hereafter referred to as participants. 1.3. The parties hereto are authorized to enter into this non-financial agreement by Section 31.0125 of the Human Resources Code, which created the community work experience and by 7 U.S.C., § 2029, which creates Workfare. 1.4. In the event that the program authorizing this non-financial agreement transfers from the Alamo Area Development Corporation to another agency or instrument of the State of Texas, this agreement shall also transfer without interruption to that agency or instrument and shall not be diminished or otherwise amended by that transfer. 2. AGREEMENT PERIOD 2.1. This agreement becomes effective on the date signed by both parties and will continue in effect until terminated by: 2.1.1. mutual agreement of both parties on the agreed upon date; 2.1.2. either party giving 30 days' prior notice to the other party. Evidence of written notice may include certified mail return receipt, or other acceptable third party documentation; 2.1.3. AADC, immediately and without prior written or verbal notice to the Kerr County site for violations of the terms and provisions herein or any applicable law, regulation or policy. 3. PURPOSE AND GOAL 3.1. The purpose of this agreement is to establish worksites for FS, E&Tand TANF participants so as to refer and engage in workfare/community service/work experience activities at various locations and positions with Kerr County. While this activity may prepare FS, E&T and TANF participants for employment with this agency, no guarantee of employment is made. 3.1.1. Agencies or entities that enter into this Non-Financial Work-Site Training Agreement will identify positions utilizing job descriptions within their organization. These positions are unpaid but will enable the participant to gain skills and experience necessary to compete in the labor market. 3.3. The primary goal is to improve employability and enable individuals to move into regular employment. 4. OUTCOMES 4.1. Successful implementation and practice of this agreement will result in FS, E&T and TANF participants obtaining valuable training in a controlled work environment. 4.2. Participants who successfully participate under this agreement will have greater potential for employment in a stable job with benefits. 4.3. While activities under this agreement may prepare participants for employment with Kerr County, no guarantee of employment is made. 4.4. Kerr County may expect: 4.4.1. To receive the assistance for a predetermined amount of time, of an FS E&T and TANF Participant, that has limited work experience and job retention skills (dependability, reliability, and interpersonal skills) but is in need of accessing the opportunity to practice and further develop those skills. 4.4.2. To share in the satisfaction gained in helping participants realize their goal of achieving self- sufficiency. 5. REFERRAL AND TRACIIaNNG PARTICIPATION 5.1. Referral 5. l.l. If determined appropriate, as per participant's work plan, he/she maybe referred to Kerr County for participation in workfare/community service/work experience activity under the terms of this agreement. 5.1.2. Kerr County will determine appropriate selection process and training of referred participants who would adapt well to the available job activities. 5.1.3. The participant is referred to the worksite with an Individual Agreement form provided by the participant's Career Counselor. 5.1.4. If, after meeting, the participant and Kerr County agree to participate, the Individual Agreement form is completed to indicate the hours, duration, and duties of the work activity and then signed by the Kerr County representative, the participant, and the Workforce Center Career Counselor. 5.2. Tracking and Follow up 5.2.1. The participant will be provided with a form to record weekly hours of work participation. Kerr County agrees to not exceed the hours and duration stated on the participant's Individual Agreement form. 5.2.2. The participant will keep the form and the designated Kerr County supervisor will review and sign the form weekly to ensure accuracy. 5.2.3. The participant will return the record weekly to his/her Career Counselor. 5.2.4. Periodic contacts with the participant and Kerr County are conducted by the Career Counselor to review the progress and compliance with the participant's plan. 6. MEETINGS AND COORDINATION 6.1. Representatives of Kerr County and AADC will meet quarterly to assess the activities conducted under this agreement and to make necessary adjustments to improve the results of the project. 6.2. MUTUAL AGREEMENTS ~ - 7.1. Both parties will coordinate the development and implementation of this agreement with appropriate site staff. 7.2. The activity must be related to the capability of the participant to perform the tasks on a regular basis, including physical capacity skills, experience, family responsibilities, and accessibility. 7.3. The total daily commuting time to and from the work site to which the participant is assigned must not exceed 2 hours. 7.4. The total hours of participation will not exceed 30 hours per week and the participation period will not exceed 3 months. 7.5. All participants have the rights available under federal, state and local law prohibiting discrimination on the basis of race, sex, national origin; religion or a handicap condition. Individuals alleging discrimination may choose to have their complaints processed as a work-site training dispute, a violation of other applicable state and local laws Prohibiting discrimination, or as a violation of 45 CFR parts 80, 84, and 91. 8. KERR COUNTY AGREEMENTS 8.1. Training must be appropriate, Kerr County will identify position(s) that will enable the participant to gain skills and experience necessary to compete in the labor market for comparable position(s). 8.2. No participant may be required, with or without consent, to remain away from home overnight. 8.3. Participants are subject to the same health and safety standards established under state and federal law that otherwise apply to other individuals in similar activities who are not work site participants. 8.4. The work site training activity must not result in the displacement of any currently employed worker or position, including partial displacement. 8.5. The work site training activity must not impair existing contracts for services or collective bargaining agreements. It must not result in the employment or assignment of a participant or the filling of a position when any other person is on layoff from the same or substantially equivalent job within the same organizational unit or when an employer has terminated or otherwise reduces its workforce. The volunteer activity must not infringe in any way on promotional opportunities of any currently employed individual. 8.6. Kerr County shall comply and not exceed the agreed hours and duration of the work plan developed for each participant. 8.7. Kerr County shall provide regular performance evaluations of each participant. 8.8. Kerr County shall protect the participants' rights of confidentiality. 9. AADC AGREEEMENTS 9.1. The conditions of participation must be reasonable, taking into account in each case the proficiency of the participant. AADC will respond, in a timely manner, to Kerr County concerns addressing participant employability goals. If determined not suitable for the work activity, participants will be removed from such activity. 9.2. AADC has grievance procedures for resolving complaints by or on the behalf of individuals participating in any work-related programs and activities with respect to on-the-job working conditions that violate the applicable federal regulations. Grievances (excluding complaints alleging discrimination) that cannot be resolved at the local level will be forwarded to the appropriated TWC State Office for resolution, as outlined in 40TAC, Chapter 823. 9.3. Grievances regarding nondiscrimination compliance maybe filed with TWC, as outlined in 40TAC, Chapter 823 or with the Secretary of the Administrator, FCS, Washington, DC 20250, as outlined in CFR, 272.6.
