Dale Crenwelge is requesting a variance for placing the water line in roadbed, not in the 0-4
feet at edge of right-of--way. The request was made after the ditch was already dug. (See
attached photos).
_.,. The reason we have the 0-4 feet from edge ofright-of--way in our Subdivision Rules is if
water line leaks or if a new tap for new service is required, it requires digging a hole in the
completed road. (See photos of recent example in Japonica Hills}
If this were a County Maintained Road, I would not recommend it. I don't see any reason it
could not be moved over.

A DEPOSIT ON BEHALF OF Cypress Springs Estates, LTD. This is an irrevocable letter of credit issued
to you the County of Kerr, Texas, at the request of Dale A Crenwel~e, in accordance with Chapter 5,
V.T.C.A., Texas Business and Commerce Code.
This Bank promises to pay to the order of the Kerr County, Texas, upon presentation of a sight draft, any
amount not exceeding the cumulative total of ($} 250,000.00 on or after June 24, 2002.
This is not a notation credit, and Kerr County, Beneficiary shall be entitled to payment without the
presentation of documents.
In accordance with Section 5.106 if the Texas Business and Commerce Code, this letter of credit may be
modified by the reduction of the total outstanding and unused amount of this credit, upon the execution and
delivery to issuer of a sworn statement making demand by the County Engineer of Ken County, or by
anyone purporting to be his duly authorized agent, and presenting a document to that effect on Kerr County
letterhead.
This letter of credit shall expire on June 24, 2003
