Burney Commissioner Precinct 2 Roger Stone Commissioner Precinct 4 and the Court having duly opened, the following proceedings were had: N0. 11087 ORDER CONCURRING WITH THE CITY OF KERRVILLE IN THE MAT'1'ER OF CREA'1'ING A JOINT AIRPORT BOARD TO OPERATE LOUIS SCHREINER MUNICIPAL AIRPORT On this the 25th day of February, 1970, came on to be heard and considered by the Court the matter of joining and concurring with the City of Kerrville in the matter of creating a joint airport board pursuant to provisions of the Texas Municipal Airport Act codified as Article 46d-1, Vernons Texas Civil St atutea, and it appearing to the Court that the City of Kerrville has heretofore adopted a resolution to create such a board which resolution reads as follows; "That the City Council, acting under authority vested in it under the Texas Municipal Airport Act, appoint a five-member Airport Board to assume the powers specified for an Airport Board under the Texas Municipal Airport Act; that concurrence of the Kerr County Commissioners Court be required for confirmation of the appointments; that terms of the members of the Airport Board be set at two years for three members and one year for two members, with subsequent appointments to be for two-year terms; that the five members of the Airport Bcard appoint their own chairman, and that such authority be and hereby is granted by the City Council of the City of Kerrville to said Airport Board as delineated by the Texas Municipal Airport Act." And it further appearing to the Court that the creation of such a joint board is in the public interest, it is ordered on motion by Commissioner Schwethelm, seconded by Commissioner Burney and unanimously approved by the Court that Kerr County concurs with the actions of the City of Kerrville in this matter and that Kerr County does hereby adopt the provisions of the hereinabove set forth resolution insofar as they are applicable to Kerr County and that authority be and is hereby granted to the said Airport Board as delineated by the Texas Municipal Airport Act and that the ownership of the said airport and its associated facilities as now exist or as hereafter constructed shall remain jointly and equally that of the City of Kerrville and of Kerr County with the costs of operation to be shared accordingly as they have been in the past. o-o-o-o-o-o-o-o-o-o N0. 11088 RE: TAX ASSESSOR-COLLECTOR AND RAISE IN VALUATIONS On this the 25th day of February 1970, a motion was made by Commissioner Stone that the Court ask the Tax Assessor/Collector, Juanita Reeves not to raise any more valuations in Kerr County until the Bcard of Equalization meets and further, that the proposed increase in valuations be brought before the Board. The City Council approved this item at their regular City Council Meeting on January 27, 1987. It is my understanding that this is the slightly revised contract as discussed by the County and City Attorneys. K CITY OF KERRVlLLE. TEXAS Also, for your general information, I have attached a copy of Ordinance No. 87-03, affirming the status of the Kerrville-Kerr County Joint Airport Advisory Board. The need for the ordinance was recognized several weeks ago while reviewing a lease with Gibson Products for Airport premises. At that time, the City Attorney and I discovered that the City Council and the County Commissioners granted the Airport Board the authority to contract on behalf of the City and County in the early 1970's. Apparently, that authority has never been revoked by either governing body. The Airport Board in recent times has only functioned as an advisory board, as have most other City appointed boards and commissions. Therefore, we have begun proceedings to correct this situation. At their meeting on January 21st, 1987, the Airport Board members were informed on the action that the City was expected to take. The Airport Board members agreed that they had no desire to be anything other than an advisory board; and they had no problem with the ordinance reaffirming their status. Commissioner Ray was also present at this meeting and is knowledgeable on this subject. It has no authority, acting alone, to lease, contract, convey or sell land. Any prior authority to the contrary is hereby revoked.
