No public official shall have an interest in this contract, in accordance with Vernon's Texas Code Annotated Local Government Code, Title 5, Subtitle C, Chapter 171. Confidentiality. All information disclosed by the County to any offerer for the purpose of the work to be done, or information that comes to the attention of the successful offerer during the course of performing such work, is to be kept strictly confidential. This agreement is performable in Kerr County, Texas Termination of Contract. A. The County reserves the right to terminate the contract immediately in the event the successful offerer fails to: 1. meet delivery or completion schedules; or 2. otherwise perform in accordance with the accepted proposal. B. Either party may terminate this contract by giving sixty (60) days' written notice to the other party. The reason for cancellation must be stated in writing. Performance of Contract. The County reserves the right to enforce the performance of this contract in any manner prescribed by law, or deemed to be in the best interest of the County, in the event of breach or default of the contract. Detailed breakdown of all premiums by section and the applicable period of time. Payment. Payment of all premiums for each section of this RFP will be made upon receipt of a valid invoice in accordance with the State of Texas Prompt Payment Act, Article 601f, V.T.C.S. General Information. 1. Alternative Proposals Proposals must be submitted according to specifications; however, a proposer may also submit alternative proposals with recommendations as to why they would be in the best interests of the County. Premium charges for changes in exposures during one-year term are acceptable. 3. Award The County is utilizing the Request for Proposals format and although cost will be the most important consideration in awarding the insurance, the County reserves the right to award the coverage to the proposer who in the opinion of the County will best serve the interests of the County. 4. Specimen Policies Specimen policies and forms including all endorsements that would be attached to the policies must be included with the proposal package. 5. Packaging Please indicate in the proposals whether or not lines of coverage may be individually purchased or if the proposal is a package only. Staff OuaGfications /Experience /Credentials. Offerers shall supply with this proposal: qualification and experience information for the staff assigned to this project; level of organizational responsibility of key project staff members; and headquarters, nearest office and managing office information for the project stated herein. References. Offerers shall supply with this proposal a list of at least three references where like services or similar projects have been performed by their firm. Include name of firm, address, telephone number and name of representative. This step is not necessary for those firms currently providing coverage for the County. Financial Statements. Governmental pools must provide a financial statement and past five years' rate increase/decrease history. Term. The term of all policies shall be from the date coverage commences, January 1.2004. to September 30, 2004 .All policies are subject to an option to renew for up to two additional twelve- month terms at the discretion of the County Commissioners' Court after analysis of adjusted premium. Premiums shall be quoted on an annual basis. Duty ofAgents /Underwriters. In order for proposals to be compared, it is necessary for all portions of the document, including requests for specific information about coverage, ratings, services, forms, and general information regarding the agent and underwriter, be completed and adhered to. Agents participating in this process must guarantee that these specifications will be used in their presentations to underwriters without modification. Fur purposes of comparison, it is important that quotations be submitted on this form. Any amendments or innovations must be submitted by addendum to this specific package, and so noted. Sample policies, including endorsements, must besubmitted with all quotation Page 6 KERR COUNTY REQUEST FOR PROPOSAL - Proposal Specifications - Ijany of the coverages cannot be furnished in the manner requested, please describe in written form as an addendum any variations between the specifications and the quotation_ The County reserves the right to negotiate certain additional or modified coverages and formulas affecting rates. Caveat. Although every effort has been made to provide accurate and up-to-date information regarding property, improvements, equipment and risks to be considered, companies or agents supplying quotations shall not depend solely upon the lists and information contained herein if they are awarded the coverage. Coverage shall include all County property and employees and be so specified, unless otherwise expressly excepted Errors and Omissions. Errors and omissions in the preparation of the specifications and subsequent specifications, reports and/or other documents shall not operate to invalidate this insurance. Such errors and omissions shall be reported promptly when discovered and premiums shall be paid accordingly. Scope of Specifications. The County will entertain proposals on insurance coverage plans. This is anon-accessible pool and costs are guaranteed for 1 year from inception. Kerr County has an active safety program, including safety awards and incentives.
