ORDER N0.28420 CHANGE IN FLOOD DAMAGE PREVENTION ORDER # 26463 On this the 24th day of November 2003 upon motion made by Commissioner Letz, Seconded by Commissioner Baldwin, the Court unanimously approved by a vote of 3-0- 1 to approve the changes of #1 & #2 only in the Flood Damage Prevention Order # 26463 as recommended by the Kerr County Engineer/Floodplain Administrator as follows; 1. Article 4, Section B (6): Change TNRCC to TCEQ 2. Article 4, Section B (9) currently states: (9) When a regulatory floodway has not been designated, the Floodplain Administrator must require that no new construction, substantial improvements, or other development (including fill) shall be permitted within Zones Al-3 0 and AE on the community's FIRM unless it is demonstrated that the cumulative effect of the proposed development, when combined with all other existing and anticipated development, will not increase the water surface elevation of the base flood more than one foot at any point within the community. As development progresses in the "A" Zone, the "ultimate base flood elevation" will be one foot higher than the current Flood Insurance Rate Map (FIRM) Base Flood Elevation, BFE. Therefore the base flood elevation in Article 5, Section B from "elevated to or above the base flood elevation" will be changed to "elevated one foot above the base flood elevation." ~~ ~. ~. .~ COMMISSIONERS' COURT AGENDA REQUEST ~~ PLEASE FURNISH ONE ORGINAL AND NINE COPIES OF THIS REQUEST AND DOCUMENTS TO BE REVIEWED BY THE COURT. ROAD & BRIDGE MEMORANDUM TO: Commissioner's Court , FROM: Franklin Johnston, P.E., Kerr County Engineer/Floodplain Administrator DATE: November 18, 2003 SUBJECT: Consider Changes in Flood Damage Prevention Order #26463 1. Article 4, Section B (6): Change TNRCC to TCEQ. 2. Article 4, Section B (9) currently states: (9) When a regulatory floodway has not been designated, the Floodplain Administrator must require that no new construction, substantial improvements, or other development (including fill) shall be permitted within Zones Al -3 0 and AE on the community's FIRM unless it is demonstrated that the cumulative effect of the proposed development, when combined with all other existing and anticipated development, will not increase the water surface elevation of the base flood more than one foot at any point within the community. As development progresses in the "A" Zone, the "ultimate base flood elevation" will be one foot higher than the current Flood Insurance Rate Map (FIRM) Base Flood Elevation, BFE. I would recommend changing the base flood elevation in Article 5, Section B from "elevated to or above the base flood elevation" to "elevated one foot above the base flood elevation." It is my opinion that this change will help Kerr County meet its STATEMENT OF PURPOSE, found in Article 1, Section C & D. 3. Article 5, Section C, add the following to Item 4: "Any lot which is partially located within the flood hazard area shall have a minimum of one (1) acre outside the flood hazard area. No lot shall be entirely within the Area of Special Flood Hazard, as defined in Article 2". Floodplain 111803 Telephone: 830-ZS7-2993 4010 San Antonio Hwy. Flood Hazard Area Area of floodploin that could be used for development by raising ground Flood elevation before encroachment The Floodway is the channel of a river or other watercourse and the adjacent land areas that must be reserved i n order to pass the base flood discharge without increasing flood depths. Computer models of the floodplain are used to simulate "encroachment'' or fill in the flood fringe in order to predict where and how much the base flood elevation would increase if the floodplain is allowed to be filled. For any proposed Hoodway development, before a local flood~ain permit can be issued, the applicant must provide evidence that "no rise" will occur (see page 32). You may need a qualified engineer to make sure your proposed project won't increase flooding on other properties. __ ~~x~s c~v~ci~ ~u~o~ ~o Line t~- ® a Flood Elevation Before Encroachment line O- O =Flood Elevation After Encroachment *Surcharge not to exceed 1.0 foot [FEMA requirement] ~~ Simulated Encroachment ~j~_ IrnPart°nt • ' me time2 . e sa , _ .. • Ce °I mind °t eeqq~~' ave im~'~'n elevafi14n gFE e maney.and ~' er than the mtn feet a~ve ~1e _ ;n S ant t° Save ~m rd t° b°tld ht9S ally one °r ~° 'House ~ ° ~ Z-on ~ n ~e building post FIRM ° W add Freeboa r °I ~,aFety, U "~.'-~"' insurance n ~a ~250rQ00 contents Fheehaard is a Cto $85 r0p0 insurance on ,Wisp pCe ~ ted era _ ' +2 ~ +1 ~ gF~ 27 ' i .~ t, i ~ -r''- 1 i i~ l~t ` 11 - ,~ 'I I ~~ , t~--~ 1 ~ i ~ 1 i ~ ~ 1 t , I .. ~_ t ~ } µa,uy8 ~ a ~ Zo 8 .Nith ~8 building ', 1 ~,,.._ `` '"•!""~ p~250 ~0 insuranc on contents ranee i .' :~ `~"`" ~•: 1 .~ i r y ~i I 1 1t ~ ~_ r~ l ~ I ' _--, i i ~" I i ~ ,4 _ I` ~ ~~ 000 -~,."" .~- ~ Flood -nsurance NptE~ various des rates ae tom time to t- sts For Rohe than speclFure Ives a i~lr~~ce~w ~~~,uch dilterence o can make' dust a Foot or tw e ~$5,Q00 ~nsu w.ls,~c-ce House ~ ,sn Zonte w ~'' gFE Pos00,~ 0 insurang on tontentsdin9 . $40,0 insuranc it-n9s an reinforced p ...-~..
