The specific hazardous waste to be collected and disposed will be motor oils, batteries, and paints. Reduce illegal dumping through increased public awareness and education which will improve the recovery of landscape resources by halting illegal dumping: 1. Financial Management Applicant provides assurances that, if funded, the Applicant will comply with contract provisions and requirements necessary to ensure that expenses are reasonable and necessary, and to adhere to financial administration and reimbursement procedures and provide financial reports on a schedule established by the AACOG. 5. Compliance with Americans with Disabilities Act Applicant provides assurances that, if funded, the Applicant will comply with all the applicable requirements of the Americans with Disabilities Act of 1990, 42 U.S.C. §§ 12101- 12213 (Pamph.1995). 6. INSTRUCTION FOR FY2004 REQUEST FOR PROJECT APPLICATION Authorized Project Categories For FY2004, authorized grant categories are as follows: • Local Enforcement • Source Reduction and Recycling • Citizens Collection Stations and Small Registered Transfer Stations and Community Collection Events • Household Hazardous Waste Management: First-time applicants may request disposal costs. Disposal costs for second-time applicants at the discretion of the SWAC. • Technical Studies • Litter and Illegal Dumping Cleanup: New category, replaces old Cleanup category. • Education and Training • Other: Requires approval of TCEQ. May fund construction and demolition debris management, biosolids management, remediation of abandoned landfills, liquid wastes, oil, filters, antifreeze and batteries. Supplemental Funding Standards For FY04, the new standards are as follows: Funds may not be provided through apass-through grant or subcontract to any public or private entity that is barred from participating in state contracts by the Texas Building and Procurement Commission, under the provisions of §2155.077, Government Code, and I T AC § 113.02, GSC Regulations. All equipment and facilities purchased or constructed with funds provided under this program shall be used for the purposes intended in the funding agreement. Equipment purchases must be for either Page 29 first-time equipment purchases or for enhancemendexpansion purposes. Grant funds may not be used to replace equipment previously purchased with grant funds unless the equipment replacement is for enhancement and/or expansion purposes. Personnel funding is limited to no more than 2 years; however, second year funding is not guaranteed. All second year funding requests will need to compete in the overall grant process as any other grant applicant would need to compete. Also, grant funds cannot supplant existing salaries and overtime is treated the same as salary. Funds may not be used for employment or otherwise contracts for services of a lobbyist or for dues to an organization that employs or otherwise contracts for the services of a lobbyist. Funds may not be used to assist an entity or individual to comply with an existing or pending federal, state, or local judgment or enforcement action. This restriction includes assistance to an entity to comply with an order to clean up and/or remediate problems at an illegal dumpsite. However, the TCEQ may waive this restriction, at its discretion and on a limited case-by- case basis, to address immediate threats to human health or the environment, and where it is demonstrated that the responsible party does not have the resources to comply with the order. Funds may not be used to pay penalties imposed on an entity for violation of federal, state, or local laws and regulations. This restriction includes expenses for conducting a supplemental environmental project (SEP) under a federal or state order or penalty. Funds may be used in conjunction with SEP funds to support the same project. Funds may not be used to supplant equipment already being used by grantee. Funds may not be used to supplant salaries paid or services offered by grantee. Noti£cation of Private Industry Required This notification requirement is not new for FY04, but it has been placed into a separate section to alert the grant applicant of its need. Failure to notify will result in failure to compete. According to state law, a project or service funded under this grant program must promote cooperation between public and private entities, and the grant-funded project or service may not be otherwise readily available or create a competitive advantage over a private industry that provides recycling or solid waste services.
