UNION CHURCH USE REGULATIONS Kerr County Facilities Use and Maintenance Department, located at 3805 State Hwy. 27 East, will manage the Union Church Building at 100 Travis Street. 2. This department manages the booking and maintenance of all Kerr County Facilities used for outside meetings and functions. 3. Reservation for facilities use will be booked through this office by Contacting, Jamie at 830-257-7393 or Glenn at 830-896-9016. Key control will also be through this office. 4. No additional tables, chairs or decorations will be allowed without prior approval of Kerr County Facilities Use and Maintenance Dept. 5. Routine maintenance such as electrical, plumbing, air conditioning/heating and yard work will be accomplished the same as the other county facilities. 6. Routine cleaning such dusting, floor cleaning, general pick up of Trash, restroom supply replacement, etc. will be done the same as the other Kerr County buildings. 7. The county will collect all fees and pay all costs to maintain and manage the Union Church including utilities. 8. The Kerr County Historical Commission, an arm of County Government, meets regularly in the Union Church on the third Monday of each month at 11:45 AM to 2:30 PM without charge. 9. The friends of Kerr County Historical Commission meets regularly in the Union Church on the Monday before the Kerr County Historical Commission meets and any special fund raising events, without charge, being the fund raising arm of the Kerr County Historical Commission. Parties The parties to this Agreement are Kerr County, Lessor, and Term of Agreement This Agreement shall begin on expire on to actually use the leased premises beginning Lessee. and Lessee shall be able 3. Premises to be Leased The following area of the Union Church (hereinafter referred to as the Union Church) shall be leased to Lessee: 4. Consideration In exchange of Lessor leasing said premises to Lessee, Lessee agrees to pay the sum of $ to Kerr County. 5. Right to Entry Lessor retains the right to enter the Union Church at all times while Lessee is using the premises. 6. Property Damage Lessee shall be responsible for any and all property damage to the Union Church caused by Lessee, Lessee's agents and successors or whomever Lessee allows to enter said leased premises. Lessee agrees to pay Lessor any and all cost of repair or replacement to said leased premises that is damaged by Lessee, Lessee's agents and successors or whomever Lessee allows to enter said premises. 7. Lessee's Personal Property Lessor shall not responsible for any of Lessee's personal property placed on said leased premises. 8. Assignment /Sublease Lessee may not assign or sublease its interest to anyone. 9. Flammable Products & Fire Hazards Lessor prohibits Lessee or anyone else from using in the Union Church any flammable products such as, but not limited to, gasoline or other fuel, butane bottles, oil flashlights, or any other artificial lighting, or anything else that could possibly cause a fire hazard inside the Union Church. Lessee shall not bring or permit anyone else to bring into the Union Church anything that will cause a fire hazard in the Union Church. 10. Fire Code Lessee is charged with knowing the local fire code and shall do all things necessary to ensure that the provisions of this fire code are met while Lessee is leasing said premises. 11. Local Ordinances Lessee is charged with knowing all local ordinances and shall do all things necessary to ensure that the provisions of the local ordinances are met while Lessee is leasing said premises. 12. Observance of Other Laws Lessee is charged with knowing and complying with the laws of the United States and the State of Texas. 13. Indemnity Lessee agrees to indemnify, save and hold harmless from all and any claims or liability for damages to any person or persons for injuries to persons or personal injuries resulting in the death of any person or loss or damage to property occasioned by or in connection with the use of the said leased premises caused by any source whatsoever. Lessee hereby assumes full responsibility for the character ,acts, conduct and omissions of all persons admitted to the said leased premises. 14. Choice of Law & Forum This Agreement shall be governed, construed and interpreted under the laws of the State of Texas. Kerr County, Texas shall be the proper forum for resolving any and all disputes arising from this Agreement. 15. Modification This Agreement may only be amended or modified by writing executed by Lessor and Lessee. 16. Entire Agreement This Agreement is the total and complete integration of any and all agreements existing between Lessor and Lessee and it supercedes any prior oral or written agreements, promises or representations made by the parties. 17. Severability If any term, covenant or condition of this Agreement or the application thereof to any person or circumstance shall, to any extent, be found invalid or unenforceable, the remainder of this Agreement or application of such term, covenant or condition to persons or circumstances other than those as to which it is invalid or unenforceable, shall not be affected thereby, and each term, covenant or condition of this Agreement shall be valid and enforceable to the fullest extent permitted by law.
