County Judge and Commissioners: There is some confusion over the length of Clark Ranch Road that is maintained by the County. It appears that length of County maintenance of the road changed from 2.4 miles to 1.6 miles in 1999 without a request to abandon the road or a Court Order. I propose to restore the County maintenance to 2.4 miles. The road was maintained, from FM1340 to the Schumacher residence, by the County as far back as anyone can remember. 2. Sometime arround 1970 a portion of the road was rerouted over the objections of some land owners. The new route, like the old route, crossed the Gray Ranch and terminated at the Schmacher residence. Caliche for the re- routed portion was taken from the Gray Ranch. 3. In the 1980's the Schumachers were using "Schumacher Road" through the Kerr Experimental Station to access FM1340. At that time the County discontinued maintaining Clark Ranch Road from the Gray Residence to the Schumacher residence. There was no Commissioners' Court order to abandon this portion of the road. 4. In the early 1990's the County re-surtaced Clark Ranch Road using caliche from the Gray Ranch. The resurtacing stopped 100 yards short of the Gray residence. The County cited "possible water lines" as the reason for the change. There was no Commissioners' Court order to shorten the county-maintained portion of the road. 5. Maintenance of the portion of the road on the Gray Ranch declined in the 1990's. 6. In 1999 Ron Gray was told that the County Engineer had shortened to county-maintained part of the road from 2.4 miles to 1.6 miles stopping at the Gray Ranch property line. There was no request from land-owners to abandon that portion of the road and no Commissioners' Court order. Based on these findings, I believe that the County is obligated to maintain 2.4 miles of Clark Ranch Road. I will schedule this for the May 9th Commissioners' Court meeting. Dave Nicholson 5/ 1 /2005
