Came to be heard this the 9th day of May 2005, with a motion made by Commissioner
Nicholson, seconded by Commissioner Williams. The Court unanimously approved by
vote of 4-0-0 to authorize the Road and Bridge Department to improve/construct a
separate roadway to facility at Kerrville State Hospital to be utilized for acute/civil
commitment patients from Kerr and other counties, contingent upon approval be the State
and approve up to $12,000.00.

Re: Driveway completion at Ken County State Hospital
Deaz Pat:
The enclosed proposal is derived from reviewing the Transportation Code, the
Government Code ,and Attorney General Opinions. In addition I discussed the issue with the
Texas Association of Counties and the Honorable John Fuller at the State Attorney General's
office.
Pursuant to Government Code Section 791.011 the County may through the Interlocal
Cooperation Act contract or agree with a State agency to extend the proposed access driveway
located on Kerrville State Hospital property. The only limiting factor appears to be Section
791.011(e) that requires "payment in an amount that fairly compensates the performing party for
the services or functions performed under the contract." When confronted with the statutes and
facts TAC's legal staff immediately referred me to the Attorney General's "County Government
expert." After discussing the facts of our situation with Attorney John Fuller of the Attorney
General's office, he concurred that in the interlocal cooperation agreement we could state our
consideration as the County's savings incurred by retaining acute care cases in Kerrville. As
always, any interlocal cooperation agreement requires Commissioner's Court approval and
approval by the State Agency.
I discussed the issue with the City Attorney's office and they do not have an interest in this
issue.
Of practical consideration, Leonard Odom needs to Irnow the expected use of the
driveway and the projected width. Leonazd stated his initial survey of the property was cursory
only and he will need to reinspect and measure the area to be paved prior to presenting
Commissioner's Court with a final cost analysis.
