RESOLUTION
A RESOLUTION OF THE COMMISSIONER'S COURT OF KERR COUNTY, TX, AUTHORIZING THE
SUBMISSION OF A CONTRACT AMENDMENT REQUEST FOR THE TEXAS COMMUNITY DEVELOPMENT
FUND AND COLONIA CONSTRUCTION FUND CONTRACTS NUMBERED 722411, 723095, AND 724441
BETWEEN KERB COUNTY AND THE OFFICE OF RURAL COMMUNITY AFFAL2S (THE OFFICE).
WHEREAS Kerr County entered into three contracts, TCDP numbers 722411, 723095 and 724441 with the State
of Texas to make fnst time sewer connections in the Kerrville South area; and
WHEREAS The County performed a bid opening for contracts numbered 722411 and 723095; and
WHEREAS The bid the County received to perform these activities was approximately $213,895 over budget; and
WHEREAS This value is sitnilaz to funds for construction available in contrail numbered 724441; and
WHEREAS The County has concluded that funds designated for Construction under contract number 724441
would be better utilized to complete the activities described in those contracts numbered 722411 and
723095.
NOW, THEREFORE, BE IT RESOLVED BY COMMISSIONER'S COURT OF KERB COUNTY, TX:
1. The Court authorizes that three contract amendment requests be submitted to the Office requesting that grant
funds designated for Construction under contract number 724441 be utilized to complete all activities descnbed
under contracts numbered 722411 and 723095.
2. That the beneficiaries described under contract number 724441 will not receive first time sewer service at this
time.
3. That the quantities described in the performance statement under contracts numbered 722411, 723095 and
722441 be modified.
4. That the beneficiaries described under contract number 72241 ]remain unchanged.
5. That the beneficiaries described under contract number 723095 be divided among contracts numbered 723095
and 724441 per the Survey Tabulation Forms, attached.
6. The Court duects and authorizes the County Judge to execute all necessary documents as may be requued to
initiate and process this contract amendment request.

In a nutshell, this is what we will be doing
We have three grants, 722411, 723095, 724441, commonly referred to as Phases
II, IIII and IV; 722411 was the Eastern Portion of Loyal Valley area, 723095
was the Western Portion of Loyal Valley, and 724441 was to be Ranchero Road
area. (Away to look at the contract numbers is to imagine that the third
number in each contract number is the phase number. For example, 722411 is
phase II, 723095 is phase III, etc).
As you know, phases II and III were bid out toghether, and the bid was too
high by about $213,000. You suggested we finish off phases II and III with
phase IV money.
Here is how we will do that, and this is the one-paragraph summazy you asked
me for:
Those that were to benefit from phase IV (724441, Ranchero Road) will no
longer recieve benefit. All sewer line work along Ranchero Road is to be
eliminated. Instead, Phase III (723095) will be divided into two parts: one
part will be paid for with Phase III money, as intended, and the other part
is to be paid for with Phase IV money. Phase III was originally going to
provide first time sewer service to approximately 87 households (give or
take, stay with me). Now, phase III money will pay for about 40 household
connections (as well as the lines in front of those houses}, and phase IV
money will pay for about 47 house connections, totalling the original count
of 87 homes for Phase III (roughly). We aze slightly adjusting the
QUANTITIES to be installed using phase II money, but the beneficiary count
will remain essentially the same.
The attached spreadsheet is a copy of what was bid. Originally, all
quantities to be bid were divided up between phase II and III money. Now,
as illustrated, it will be divided up between phase II, III and IV money.
Refer to the bottom left hand of the page. There is a quick reference point
for all three contracts: 722411 is now the Eastern arm of Loyal Valley Road,
723095 is the Southern Arm of Loyal Valley Road, plus George Muck and
Frederick, and 724441 is now Western Loyal Valley and Frederick.
Am am continuing to work on the beneficiary and map breakdown, which will in
turn dicate the precise wording of the Resolution for the Court to pass,
