Therefore, you would need to revisit the Commissioners Court to determine what would have to be done for it to be accepted, not Road & Bridge. I can not give an estimate on the cost of upgrading a privately maintained road without Commissioners Court approval and until the Court has determined what they will accept. Will they accept a 40' right of way, and if so does it need to be a 14 or 16 ft. surface? How do we address the fact that Kerr County would not have any responsibility on drainage on the road or the runoff to the rest of the subdivision? Does the road include the cul-de-sac? Do the property owners at the end of the road have to plat their property to make the cul-de-sac a public right of way? KEFPVILLE TE%p$ )0028. 836293313 DATE; April 25, 2005 MEMO TO; Jim Alford FROM: Lee C.Voelkel SUBJECT: Scenic Ridge Road Hills 'n Dales Subdivision Jun: Last Monday, April 18`", 1 met with Commissioner Nicholson and Len Odom at the courthouse to determine what needed to be done for the above referenced road to be taken over by Kerr County for maintenance. Commissioner Nicholson and Len Odom agreed to the following: 1. The land owners along the road would have to make the request in writing and the request has to be unanimous. 2. An additional ten (10) ft. of right-of-way will need to be dedicated to Ken County (preferably five ft. on each side). Each landowner will convey to the county their section ofright-of--way, 3. The landowners will pay for materials to up-grade the present road. Mr. Odom is to provide me with an estimate of cost for the materials. 4. The county will disclaim itself from any liability relating to drainage problerns created by cleazing the right-of--way and widening the roadway, Please keep in mind that these are the same conditions the county imposed upon West Hi-Line property owners when their road was taken over for maintenance. Also note that these conditions for road improvement do not include the cul-de-sac at the end of the road. The cul-de-sac is a "platting" issue that should crone before the court to rectify an "illegal" subdivision of Tract 6 (the division of Trac[ 6 without filing an approved replat).
