passed by the Court on June 13t in writing, I have received repeated assurances
from Julia Bartley, the regional coordinator for your region, that it vi I t>e formally
approved by ORCA. 1 have asked her to notify me before Wednesday, July 6t", if
anything comes up, sa I will have time to strike this agenda item. Again, she said it
would pass (then she told me to relax about it).

The undersigned, as bidder, declares that the only person or parties interested in this proposal as
principals are those named herein; that this proposal is made without collusion with any other
person, form, corporation; [hat Bidder has carefully examined the form of contract, instructions to
bidders, spec cations, and agrees that Bidder will provide all the necessary labor, materials and
equipment called for in the contract and specifications in the manner prescribed therein and according to

the Community Development contract mentioned above.
In order to reduce costs, the County, in cooperation with our Consulting
Engineer, decided to receive bids for this project and our 2003 Colonic project
(TCDP # 723095) simultaneously. While distinct, the two projects are
geographically adjacent and were to be connected to each other in order to
efFciently process the resultant wastewater. A bid opening was held on April
25"', 2005, and no bids were received. The County performed a second bid
opening on May 23'x, 2005, and advertised the opening in the San Antonio
Express-News to increase the potential number of bidders. A single bid was
received totaling $805,989.65. This is approximately $213,000 over the
combined match and grant funds for construction.
In order to complete this project, we must adjust the quantities described under
Exhibit A - Performance Statement. Please see the attached revised
Performance Statement reflecting those changes.
Significantly, the beneficiaries on this project are not being reduced.

which has not been advertised for bids at this time. This project was originally
intended to provide first time sewer service to seventeen households on
Ranchero Road, which is also adjacent to the two project mentioned above.

The County considers the completion of the activities described on the
performance statements of contracts numbered 722411 and 723095 to be a
higher priority than the activities described under contract number 724441. The
beneficiaries described under contracts numbered 722411 and 723095 are
typically of a lower income and are more in need of first time sewer service than
those under contract number 724441. Therefore, we are requesting that the
beneficiaries listed under contract number 724441 be removed, and those funds
dedicated to the completion of contract number 723095. Simply, the funds under
contract 724441 will be utilized to complete contract number 723095. The
beneficiaries originally described under contract number 723095 will be divided
among contracts numbered 723095 and 724441.
Therefore, the number of beneficiaries under this contract, 723095, will be
reduced. All beneficiaries removed from this contract will receive benefd from the
revised contract number 724441.
A map (Kerrville South Amendment -Original) is attached showing the original
locations of sewer line installation for all three projects, 722411, 723095 and
724441. A second map (Kerrville South Amendment -Revised) is attached
showing how the funds will be distributed after this amendment.
Please refer to the Performance Statement Amendment the County is submitting
for our project numbered 724441 and the Performance Statement Modification
we are submitting under contract 722411 to place this request in context.
This modification does not affect the Environmental Assessment because it is a
reduction in scope, not an increase. The reduction in beneficiaries is reflected on
the attached Survey Tabulation Form. The adjustment in quantities installed is
described on the attached "Exhibft A -Revised".

single bid was received totaling $805,989.65. This is approximately $213,000
over the combined match and grant funds for construction.
The County has resolved to authorize me to submit a request to utilize grant
funds under contract number 724441 to complete the activities described under
contracts numbered 722411 and 723095.

The County considers the completion of the activities described on the
performance statements of contracts numbered 722411 and 723095 to be a
higher priority than the activities described under this contract, 724441. The
beneficiaries described under contracts numbered 722411 and 723095 are
typically of a lower income and are more in need of first time sewer service than
those under contract number 724441. Therefore, we are requesting that the
beneficiaries listed under contract number 724441 be removed, and those funds
dedicated to the completion of contract number 723095. The funds originally
dedicated to provide first time sewer service to the Ranchero Road area will now
be utilized to provide first time sewer service the beneficiaries removed from
contract number 723095. The amendment to remove those beneficiaries from
contract number 723095 is submitted with this request as well.
A map (Kerrville South Amendment -Original) is attached showing the original
locations of sewer line installation for all three projects, 722411, 723095 and
724441. A second map (Kemille South Amendment -Revised) is attached
showing how the funds will be distributed after this amendment.
Please refer to the Performance Statement Amendment the County is submitting
for our project numbered 723095 and the Performance Statement Modfication
we are submitting under contract 722411 to place this request in context.
The Environmental Assessment under contract number 724441 will no longer be
valid, but all activities to be undertaken by this project were described with the
Environmental Assessment for contract number 723095 that was approved by
ORCA and all relevant agencies. The reduction in beneficiaries is reflected on
the attached Survey Tabulation Form. The adjustment in quantities installed is
described on the attached "Exhibit A -Revised".

Dear Mr. Negrete:
The Office of Rural Community Affairs (ORCA) has approved Amendment # 1 to the
TCDP contract referenced above. The nature of that amendment was to eliminate the original
scope of work for contract number 724441, and instead to use those funds to complete the
entire scope of work described under contract number 723095.
ORCA stated that the Special Conditions regarding environmental clearance
requirements for TCDP contrail number 724441 had been met on June 22n0, 2004. Previously,
stated that the Special Conditions regarding environmental clearance requirements for TCDP
contract number 723095 had been met on September 29'", 2003. In our Amendment request
referenced above, we stated that there was not change to the Environmental Assessment. This
is because the activities that ane now described under Exhibit A for contract number 724441 had
already been approved for construction under the Environmental Clearance letter issued by
ORCA for contract number 723095. Thus all activities that will now be performed under contrail
number 724441 have already received approval from ORCA. Further, those specific activities
have also received no comment, or specific approval, from the Texas Historical Commission,
the Texas Commission on Environmental Quality, US Fish and Wildlife Service, and Texas
Department of Parks and Wildlife.
We are requesting that ORCA acknowledge that in light of the fact that all construction
ailivities to be undertaken have been met environmental clearance requirements, and that the
amendment request referenced above necessitates no change to our present Environmental
Assessment for contract number 724441.
