CONTRACTOR shall coordinate with the DEPARTMENT'S representative to address other identified client needs outside the CONTRACTOR'S scope of services. CONTRACTOR shall develop and implement procedures for: a. services or referrals for dual diagnosed clients; b. services for clients with mental and physical disabilities 4. CONTRACTOR shall contact the DEPARTMENT' S representative within 24 hours for issues ofnon-compliance including failure to show for initial appointment or unauthorized departures. CONTRACTOR shall not employ Tom Green County Juvenile Probation clients, Texas Youth Commission, Community Supervision and Corrections Department, or Texas Department of Criminal Justice clients without the written consent of the DEPARTMENT. 6. CONTRACTOR shall provide culturally sensitive programming that is consistent with the Juvenile Justice System population. CONTRACTOR shall document on a weekly basis the client's level of participation and compliance with treatment goals and objectives. A copy of the Discharge Plan and Discharge Summary shall be submitted to the DEPARTMENT within 72 hours of the client's discharge from services. 8. CONTRACTOR shall schedule and conduct a staffing with the client's supervising Juvenile Probation Officer or designee to discuss any additional service needs prior to the client's discharge from the program. EXPECTATIONS FOR RESIDENTIAL TREATMENT SERVICES AT LEVEL OF CARE THREE (III) A. CHILD'S SERVICE NEEDS: The foster caregiver maintains a structured living environment, provides a higher level of supervision than children need at level 02, and receives regular support and direction in functioning as a substitute parent for the child. To those ends, the caregiver: 1. Actively participates in the development, implementation, and periodic review of the child's service plan; and 2. Ensures that everyone in the caregiver's household or facility who is directly responsible for the child's care, custody, and welfare receives support and direction from someone who is qualified to supervise that individual's functioning as a substitute parent. B. MEDICAL CARE: The caregiver and the Texas Department of Protective and Regulatory Services have entered into a plan, agreement, or contract to ensure that: 1. The child receives routine medical and dental services, including annual medical and dental examinations; and 2. The child's medical records reflect the child's receipt of such services. C. RECREATION AND LEISURE: 1. The caregiver arranges structured and supervised recreational activities. To document compliance with this standard, the caregiver develops and maintains a schedule of recreational activities that identifies each activity by its type, its frequency, and the nature of the staff supervision it requires. 2. The caregiver has a structured daily routine that includes leisure-time activities. To document compliance with this standard, the caregiver establishes a written schedule of daily routines and leisure periods with enough flexibility for individual children to manage their time based on their individual goals. D. EDUCATION: 1. Within the limits of state and federal law, the caregiver gives the child access to free, appropriate public education and related services through the local public school district. 2. The caregiver also designates at least one staff member to function as a liaison with the child's school, and the caregiver's records reflect the liaison's involvement in the child's schooling. E. THERAPEUTIC SUPPORT: 1. In an environment designed to improve the child's functioning, the caregiver arranges for the child to receive appropriate therapeutic interventions and treatments. 2. The child's therapeutic interventions and treatments are implemented by professional therapists or counselors, or by paraprofessional staff under the supervision of professional therapists or counselors. 1. PROGRAM INDICATORS: The caregiver: a. Sets forth in writing the philosophy and program model governing the caregiver's therapeutic interventions and treatments. b. Establishes a written schedule of structured daily routines that are consistent with the caregiver's programs of therapeutic support; and c. Ensures that each child's therapeutic program addresses the child's individual needs. 2. PERSONNEL INDICATORS: The caregiver also meets the following personnel requirements: a. The caregiver's staff includes at least one caseworker b. The caregiver's casework and clinical supervisory staff have at least one year of experience in providing services to children who have been removed from their homes. c. Each staff member with primary administrative and clinical responsibility for managing the caregiver's therapeutic interventions and programs: (i) Is a psychiatrist, which is defined here as a licensed physician with advanced training in the diagnosis and treatment of mental and emotional disorders; (ii) Is a psychologist, which is defined here as an individual who is qualified as a psychologist under the Psychologists Certification and Licensing Act (Texas Civil Statutes, Article 4512c); (iii) Has a master's degree in social work or another field of human services; (Iv) Is an appropriately licensed and qualified professional under the program model governing the caregiver's therapeutic interventions and treatments (as set forth pursuant to paragraph (1)(A) of this subsection); (v) Has: I. a bachelor's degree in social work or another field of human services; and II. at least three years of experience in providing care to children who have been removed from their homes; or (vi) Has: I. a bachelor's degree in a field other than human services; and a II. at least five years of experience in providing care to children who have been removed from their homes, including at least two years of clinical supervisory experience. F. EVERYONE WHO IS DIRECTLY RESPONSIBLE for the care, custody, and welfare of children in the caregiver's facility receives at least 30 hours of training every year on topics that include: 1. the needs and characteristics of children in care at level 03 or higher; and 2. the facility's therapeutic treatment methods and programs. (Note: First-aid and cardiopulmonary-resuscitation training cannot be counted towards meeting the training requirement specified in this subparagraph.) G. STAFF-TO-CHILD RATIO. The caregiver's staff-to-child ratio meets applicable licensing, certification, or monitoring standards. (EXPECTATIONS FOR RESIDENTIAL TREATMENT SERVICES AT LEVEL OF CARE FOUR (IV) MEDICAL/DENTAL: • Clients shall receive routine and emergency medical and dental care while in placement. • All incidents involving medical/dental injuries and/or illness requiring professional medical attention, shall be treated promptly and documented by the SERVICE AGENCY. In the event of professional medical treatment, the assigned probation officer and parent(s) shall be notified offhe nature of the injury/illness promptly. • If the client requires psychotropic medications, [he SERVICE AGENCY shall establish contracted services with a licensed psychiatrist to monitor and assist with the client's medication/care as needed. SUPERVISION, SAFETY & SECURITY: • The SERVICE AGENCY shall meet Texas Department of Protective and Regulatory Services (TDPRS) licensing requirements and guidelines for Level Four (4) clients, including appropriate staff/resident ratios. • Al] incidents requiring use of force by staff [o manage the client shall be documented by the SERVICE AGENCY. Copies of incidents reports concerning use of force shall be made available to assigned probation officer upon request. • The SERVICE AGENCY shall provide 24 hour supervision for the client, including availability of awake staff during sleeping hours. RECREATIONAL: • Clients shall be provided a vane of recreational activities while in placement. EDUCATIONAL The client shall earn full school credit under the local Independent School District where the facility is located. The academic credit must be documented and transferable upon the client's discharge. MENTAL/BEHAVIORAL HEALTH • The SERVICE AGENCY shall utilize a behavioral management level system which emphasizes positive incentives and rewards for anticipated improved client behavior, as well as appropriate consequences for negative client behavior. • The SERVICE AGENCY shall have available counseling services to the client with a therapist possessing Minimum credentials of a Licensed Professional Counselor (LPC) or Masters of Social Work -Advanced Clinical Practitioner (MSW-ACP). Individual counseling services shall be made available on request from the client. The SERVICE AGENCY is not obligated to provide any more than one hour of counseling services per week. INDEPENDENT LIVING SKILLS The SERVICE AGENCY shall Independent Living Skills training to all clients 16 years of age or older. Independent Living Skills training shall cover essential elements as: Basic Money Management, Filling Out Job Applications, Maintaining Appropriate and Positive Working Relationships with Co-workers/Supervisors, Basic Nutrition/Menu Planning. Personal Hygiene and Laundry Skills. SOCIALIZATION & RELATIONSHIPS • The SERVICE AGENCY shall provide peer group meetings as needed and facilitated by qualified staff for the client [o give and receive feedback from peers on daily living issues. The emphasis of these groups shall be to teach clients positive peer relationships and appropriate communication/listening skills. PARENT & CHILD PARTICIPATION • The SERVICE AGENCY will take an active role in facilitating and working towazd improved relationships between the clients and parent(s). • The SERVICE AGENCY shall make available and/or facilitate family counseling services to the client and parent(s) as needed. (EXPECTATIONS FOR RESIDENTIAL TREATMENT SERVICES AT LEVEL OF CARE FIVE (V) MEDICAL: • Clients shall receive routine and emergency medical and dental care while in placement. • All incidents involving medical/ dental injuries and/or illness requiring professional medical attention, shall be treated promptly and documented by the SERVICE AGENCY, and the assigned probation officer and parent(s) shall be notified of the nature of the injury promptly. • If the SERVICE AGENCY does not have an on staff licensed psychiatrist, the SERVICE AGENCY shall maintain contract services with a licensed psychiatrist to monitor and assist with the client's care as needed. If the client requires psychotropic medications, the licensed psychiatrist shall meet with and monitor the clients medication no less than every 30 days. SUPERVISION, SAFETY & SECURITY: • The SERVICE AGENCY shall meet Texas Department of Protective and Regulatory Services (TDPRS) licensing requirements and guidelines for Level Five (5) clients, including appropriate staff/resident ratios of 1:5. • All incidents requiring use of force by staff to manage the client shall be documented by the SERVICE AGENCY • The SERVICE AGENCY shall provide 24 hour supervision for the client, including awake staff during sleeping hours.
