Agenda Item Backup Statement The Texas Legislature determined not to fund the TWDB Small and Communities Water and Wastewater Programs for the 2006-2008 biennium. This was the program under which Kerr county sought Preliminary Engineering Design Fundmg for the Center Point Wastewater Project. Funds for this program ran out before our application could be considered This means that Kerr County will be required to seek a different approach to funding to get this project underway. At a recent meeting in Austin with representatives of TWDB, Kerr County was encouraged to re-apply for vazious regional wastewater program fimdings. Regional project applications require a significant amount of detail and engineering certifications including an engineering seal not required in our previous application. Expenses to be incurred to satisfy the new application format include an engineer's estimate of cost of the project, boundary certifications, maps, and other drafting requirements, and graphic reproductions. The previously filed application will be used to the extent the information in that format is consistent with the current TWDB requirements; thereby reducing the scope of work required for the new application(s). The cost estimate for these additional services is based on a time requirement and not to exceed $5,000, and can be embodied in an hourly rate contract. TetraTech, who worked with Kerr County, pro bono, to develop the initial application has agreed to revise the original application text to meet requirements without charge to Kerr County, thereby reducing the scope of work and cost to prepare and submit a new application for consideration. To date, the work performed pro bono by TetraTech for Ken County is approximately $7200. Funds are available for this purpose in line item 10-401-486, Professional Services. TEXAS WATER DEVELOPMENT BOARD RESEARCH AND PLANNING FUND REGIONAL WATER SUPPLY AND WASTEWATER FACILITIES PLANNING INSTRUCTION SHEET (Revised 9/12/02) The Texas Water Development Board's Research and Planning Fund offers grants to political subdivisions of the State of Texas for studies and analyses to evaluate and determine the most feasible altematives to meet regional water supply and wastewater facility needs, estimate the costs associated with implementing feasible regional water supply and wastewater facility alternatives, and identify institutional arrangements to provide regional water supply and wastewater services for areas in Texas. The proposed planning must be regional in nature by inclusion of more than one service area or more than one political subdivision. All proposed solutions should be consistent with applicable regional or statewide plans and relevant laws and regulations and evaluation of environmental, social, and cultural factors for possible solutions must be identified in the plan. Activities directly related to the preparation of applications for state or federal permits or other approvals, activities associated with administrative or legal proceedings by regulatory agencies, or preparation of engineering plans and specifications are not eligible for this regional facility planning grant assistance. Development of a water conservation plan must be included as a specific task in the scope of work for proposed planning areas without a Board approved water conservation plan. Texas Water Development Board population and demand projections, must be used to determine future needs in the planning process unless adequate justification is provided for using projections other than the Texas Water Development Board's. Note: Studies related to the development of regional water plans and drought response plans as defined in Senate Bi111, 75th Session, Texas Legislature are not eligible for regional facility planning grant assistance. Rule Change: The Texas Water Development Board may condition grants for regional facility planning to require that the recipients agree in the contract for assistance, and by the execution of any other documents necessary to secure such agreement, to pay back to the board the following specified percentages of the grant if construction on a project described by the regional facility planning grant is not begun within the following specified times: (1) if construction is not begun within six years of the time the executive administrator notifies the grant recipient that the agency has closed the account for the grant, the recipient shall repay to the board 25% of the amount of the grant; (2) if construction is not begun within seven years of the time the executive administrator notifies the grant recipient that the agency has closed the account for the grant, the recipient shall repay to the board an additional 25% of the amount of the grant; (3) if construction is not begun within eight years of the time the executive administrator notifies the grant recipient that the agency has closed the account for the grant, the recipient shall repay to the board an additional 25°~ of the amount of the grant; and (4) if construction is not begun within nine years of the time the executive administrator notifies the grant recipient that the agency has closed the account for the grant, the recipient shall repay to the board an additional 25% of the amount of the grant. For the purposes of repayment, construction will be considered to have begun when: (1) an entity closes a debt issuance that will fund a project that the executive administrator verifies is substantially the same as the project recommended in the regional facility planning grant report; or (2) the effective date of a contract for the construction of a project the executive administrator verifies is substantially the same as the project recommended in the regional facility planning grant report, if the project costs are not funded by a debt issuance. If the regional plan detennines that a regional project is not feasible, repayment will not be required under the provisions of subsection (f) of this section. In addition, the Texas Water Development Board must receive from the applicant one copy of the notice mailed to the affected political subdivisons, a list of political subdivisions to which notice was sent, and the date the notice was sent. The Board may not act on an application before the end of the 30-day notice period unless all political subdivisions to which notice was required to be sent agree in writing to waive the notice period. What Funding Limitations Apply? Grants for regional facility planning are generally limited to 50% of the total cost of the project, except that th board may supply up to 75% of the total cost to political subdivisions which have unemployment rates exceeding the state average by 50% or more, and which have per capita income which is 65% or less of the state average for the last reporting period available. Grants in excess of 75% for regional facility planning wil be provided if authorized by specific legislation or legislative appropriation language. In-kind services may be substituted for any part of the local share, if such services are directly in support of t planning effort, are properly documented, and approved in advance by the board. Funds will be released only as reimbursement of costs actually incurred for approved activities. Activities directly related to the preparation of applications for state or federal permits or other approvals, activities associated with administrative or legal proceedings by regulatory agencies, or preparation of engineering plans and specifications are not eligible for this regional facility planning grant assistance.
