MEMORANDUM OF UNDERSTANDING BETWEEN THE ALAMO AREA COUNCIL OF GOVERNMENTS And The Kerr County Sheriff s Department AND The KERB COUNTY COMMISSIONERS COURT EXECUTIVE SUMMARY This Memorandum of Understanding is between the Alamo Area Council of Governments (AACOG), a regional planning commission established by Texas by the Regional Planning Act of 1965 as a political subdivision of the state, Kerr County Commissioners Court, and the Kerr County Sheriff's Department. The AACOG Regional Law Enforcement Academy, the Kerr County Sheriff's Department, and the Kerr County Commissioners Court are entering into this Memorandum of Understanding to establish operating, maintenance, training, and security guidelines for the AACOG Regional Law Enforcement Academy Distance Learning Site. AACOG is seeking to establish a distance-learning center utilizing video teleconferencing equipment, in the Kerr County Sheriff's Department training room. The distance-learning center will p rovide T CLEOSE i n-service t raining t o l aw a nforcement agencies within the Texas Hill Country Region. WITNESSETH: WHEREAS, the Alamo Area Council of Governments, the Kerr County Sheriff's Department, and the Kerr County Commissioners Court agree to the following: Alamo Area Council of Governments will: 1. Purchase and install the required video teleconferencing equipment. 2. Be responsible for the maintenance of the video teleconferencing equipment. 3. Provide training by AACOG's approved contractor, Visual Innovations Company. The contractor will train designated AACOG and Kerr County Sheriff's Department personnel in aTrain-the-Trainer program that covers equipment usage and distance learning instructional techniques. 4. Establish Standard Operating Procedures for use of the distance learning equipment. 5. Allow only AACOG approved usage of the video teleconferencing equipment. 6. Abide by all Kerr County Sheriff's Department rules governing student dress, behavior, and officer bearing. 7. Coordinate all training in which the video teleconferencing equipment is used. 8. Insure the video teleconferencing equipment against theft or destruction. 9. Reserve the right to terminate the MOU and withdraw the equipment with 30 days written notice to the Sheriff's Department. The Kerr County Sheriff's Department will: 1. Provide an adequate training room for the installation of the AACOG distance learning equipment. 2. Provide a dedicated T-1, or an equivalent speed line, for connectivity at all times at the cost of the Kerr County Sheriff's Department. 3. Provide AACOG with a minimum of 30 days notice to remove or move the equipment if necessary. 4. Retain the right to have the equipment removed or moved with 30-days notice. 5. Allow AACOG reasonable access to the equipment at all times. 6. Obtain written approval for use of the equipment by the Regional Law Enforcement Academy Coordinator or his designee. 7. Retain the right to use the training room only at all times when not being used by AACOG for in-service video teleconferencing training. 8. Abide by the schedule set for use of the room as set by the Alamo Area Council of Governments and the Kerr County Sheriff's Department. 9. Allow AACOG's contractor access to the equipment for maintenance at all times. 10. Provide security for the equipment such as limited access to the room and a lock on the door to the room. The Kerr County Sheriff's Department will not: 1. Be an insurer of the video teleconferencing equipment. 2. Be held responsible for loss or liability associated with the storage of the equipment. NOW THEREFORE AACOG AND THE KERR COUNTY SHERIFF'S DEPARTMENT, ACTING INDEPENDENTLY, DO ENTER INTO AGREEMENT AND UNDERSTANDING OF THE ABOVE MENTIONED CONDITIONS.
