by Commissioner Nicholson, seconded by Commissioner Baldwin. The

Approve the execution of the written Agreement authorizing Special
Prosecutor's Office to utilize office space in the County Attorney's Office
during grant period, and establishing value of leased space for purposes of
in-kind match for Grant #WF-OS-V30-17590-01.

AGREEMENT TO PROVIDE OFFICE SPACE
WHEREAS, the Kerr County Attorney, the 216s' Judicial District .Attorney and
the 198a' Judicial District Attorney have combined their efforts and cooperated in order to
obtain grant funding from the Office of the Governor, Criminal Justice Division, through
the federal Violence Against Women Act for establishment of the Office of Special
Prosecutor for Violent Crimes Against Women in Kerr County (misdemeanor and
felony); and
WHEREAS, the Kerr County Judge and Commissioners Couri have approved
Commissioners Court Order No 29023, approving a resolution in support of
establishment of this Office, and the Kerr County Judge is the Authorized Official to act
on behalf of the County (Grantee Agency) in this matter; and
WHEREAS, the Office of the Governor has approved The referenced application
for funding in Grant #WF-05-V30-17590-01; and
WHEREAS, the parties have agreed that the Kerr County Attorney (Grant
Project Manager) will provide 144 + square feet within his office suite for use by the
Special Arosecutor funded by this grant as part of the in-kind match required by the grant;
and
WHEREAS, the parties agree that the fair market value for teased office space in
this community is approximately $1.25 per square foot per month, making the in-kind
match for office space $180.00 per month; and
WHEREAS, the parties ftnd that it is in the best interest of the citizens of Kerr
County fur the Kerr County Attorney to provide this space to the Special Prosecutor for
the purposes set out in Grant # WF-OS-V30.I 7590-01;
NOW THEREFORE, in consideration of the mutual covenants and agreements
herein expressed, it is agreed as follows:
I. TERM
fhe term of this Agreement steal! be from Oetober 1, 2005 through September 30, 2006
("Ieritiat Term°}_ This Agreement shall remain in full force and effect through its Initial
Term. This Agreement may be terminated by mutual agreement of the parties at any time
upon such terms and conditions as the parties agree.
fl. LEASEb SPACE
The Kerr County Commissioners Court hereby approves and authorizes the use of I44+
square feet in the County Attorney's Office in the Kerr County Courthouse by the Special
Prosecutor's Office established by Grant # WF-OS-V30. 1 7590-0 1 during the initial grant
period, for $ I8U.00 per month, which amount will be considered part of the Grantee
agency~s in-kind match for the Cirant Year 2005-2006.
III. RENEWAL
The Court further finds and approves an automatic renewal for successive one-year
periods following the initial year, subject to the continuation of the Grant and the
agreement by the Project Director that the space is appropriate and adequate for the
purposes stated herein. All terms and covenants of this Agreement shat! apply to all
renewal periods unless made in writing and approved by the Kerr County Commissioners
