RE: Advertise for Bid on Town Creek Crossing Improvements
When TXDOT funded the Hermann Sons Bridge, they Waived $110,485 to be paid by Kerr
County, if Kerr County agreed to commit those funds elsewhere for drainage bridge purposes.
At that time we committed to use the funds to upgrade two locations on Town Creek.
Hearne Engineering has done the engineering and bid packets. At this time we ask the Court to
allow us to go out for bids on construction of the first Town Creek Crossing.

Under the provisions of Texas Administrative Code, Title 43, Section 15.55(d), this Local Government
requests waiver of the local match fund participation requirement on the above referenced federal off-
system bridge program project referred to as the "participation-waived" project.
In return for waiver of this participation, it is proposed that our Commissioners Court perform or cause
to be performed, an equivalent dollar amount of structural improvement work on deficient mainlane
cross-drainage structures, referred to as "equivalent-match project(s), within the jurisdiction of Kerr
County.
A copy of the appropriate required resolution and Court Order # 28071 adopted by the Commissioners
Court is attached.

WI-IER.EAS, the federal off-system bridge program is admirristered by the Texas I)opartment of
Transportation (the State} to roplace or rohabilitate structurally deficient and functionally
obsolete (collectively referred to as deficient) bridges located on public roads and streets off the
desi~rated state highway system; and
WIiEREAS, Kerr County hereinafter referred to as the Local Government owns a bridge
located at 1'[ermann Sons Road Crossing 0(khe Guadaluae River on Hermann Sons Road,
National Bridge Inventory (NBI) Structure Number 1S•1,3~-AA0285-OQI, Local Designation
Number 1__5-X33-A~5-0Ql; and
WHEREAS, a project to remedy the bridge is includtd in the currently approved program of
projects as aushotized by Texas Transportation Comrrtission Minute Order Number Ol 865.3.
dated 09-27-O1. Control-Section-]ob (CS]) Number 0915-15-050; and
WHEREAS, the usual fund participation ratio for projects on such program is 80 percent
federal, l0 percent state and 10 percent Local Government; and
WHEREAS, Texas Administrative Code, Title 43, Section IS.SS(d) (43 TAC Section.15.55(d))
provides that under specified conditiors the l0 percent Laval Government match fund
participation requirement may be waived with agreement by file Local Government to perform,
or cause to be perfotmtd, an equivalent dof lar amount of structural itnproveraent work on other
deficient bridges or deficient mairtlane, cross-dta{nage-structures within its jurisdiotion, such a
project of structural improvement work being referred to as an "equivalent-match project"; and
WHEREAS, the esdmazed !oral match fond participation requirement on the approved federal
ofY-system bridge project is 5} L0.485.00 (dollars), hereinafter referred to as the "pazticipation-
waived" project, such participation requirement the Local Government proposes be waived and
in return perform or cause to be performed equivalent-match project structural improvement
work.

ackttow[edges its obligation to conform with all conditions of43 TAC Seetiou 15.55(d}; such
Conditions that include but are not pestricted [o the following:
1. The C,ocal Govemrent must be curttntly incompliance with load posting and closure
regulations as defined in National Bridge Inspection SCandattls wider U5 Code of Federal
Regulations, Title 23, Section 654.343.
2. The equivalent-match project work increases the load capacity of the existing bridge or
other mainiane cross-drainage structure, or uggrades the structure to its original load
capacity with a minimum upgrade to safely carry sehoal bus loading if located on a school
bus routs.
3. In performing, or causing to be perfotmed, Ute equivalent-match projeet(s}, the Local
Government assumes ell responsibilities for engineering and construction, and complying
v:4th all applicable state and federal envirorunental rogulations and permitting requirements
for the sttuctures being improved.
4. The work on the proposed equivalenC-match project(s) has not begun and will not begin
unfit the lose{ match fund participation waiver approval pmcess has bu.n completed.
-- 5. The Local Govem.°ncnt will be allowed throe years after the contract award of the
paticipation-waived project to complete the structural improvement work on the
equivalent- match project(s).
6. Should this waiver request be approved, an appropriate written agreement or amendment to
a previously executed agreement will b.. executes! between the State and Local
Govemment.
