Kerr County Organization Development Survey Barbara Nemec Treasurer 1 Part-time employee $15.04/Hourly (19.6) Duties mandated by the Texas Constitution or state law: Chief custodian of county finances -duties include, but are not limited to, receiving, keeping and accounting, paying, applying and disbursing all monies belonging to the county from whatever source derived according to law. Other duties include safekeeping of county bank accounts; custodian of the Sheriff's bail bond collaterals; financial manager and coordinator of all revenue bond funds- including initial issuance, establishment of accounts, acceptance of original funds, payment of accounts, etc. Agent for State reports and payments. The above duties have been done by my part-timer for the past 7 years and it takes approximately 32 hours or more per week. Duties performed that are not mandated by the Constitution or state law: Investments Officer- I investment county funds with the auditors approval and the auditor handles all the reports. Personnel Officer -Payroll: New hire paper work, Termination Paper work, prepare monthly, quarterly and annual reports as needed for Social Security, unemployment, retirement, group insurance, workers compensation, W-2, Pebsco, Valic, Aflac, Colonial, Franklin Life, New York Life, TDP, Cobra, Up-date personnel polices, up-date job description, prepare annual vacation and comp time liability report, manage all longevity and family medical leave. Safety Officer- Keep safety prevention plan and safety policy up-dated. Hold quarterly meeting, manage and audit all monthly reports. Complete all workers compensation forms and track on a regularly basis status of such claims. HIPAA Safety Officer - As Hipaa officer it is my responsibility to insure the county has a privacy action in place when dealing with medical information of our employees. These non constitutional duties have been recently been performed my me and a chief deputy. With the new computer system in place I feel I can perform these duties myself. I would propose to delete my chief deputy position and replace it with apart-time position. This part-timer will help with the overflow of my duties and those of Jacqui as well. I estimate that over 50 percent of Kerr County households have access to the Internet, either directly or via friends and family. Most governments and business's ezpect electronic access to the county. Prudent use of the new software systems will allow the move from intensive counter operations; foot traffic for the few, to larger scale and more efficient access for the many. A recent ezample of Kerr e-Government is the primary election. The county clerk implemented a voting system via a state grant (and federal mandate) that tabulates votes electronically. The printed tally was available to the press and interested persons at the courthouse starting at 7pm election night. The counter provided results for those present or verbally by telephone. The county web site published detailed reports electronically at 7:Olpm. Estimate of unique calls at the counter, less than 50. Unique computer users that viewed the election results to date, 1,178. Encourage cooperation from the Districts Attorneys, Coarts and the Cities to integrate court and law enforcement functions. Encourage all computer users to attend training on the new software systems. County data is only as good as that input by the operators. It is impossible to determine the number of man- hours spent each week on each duty because of the constant activity of this office and the Court. The classification grade of the employee assigned to these duties is 19.3. Maintain and control the criminal docket and calendar for the Court. 2. Attend docket call, check on absentees and reset cases when necessary. Set, prepaze and distribute various dockets for pleas, pre-trials, review heazings, jury trials, trials before the court, contested motions hearings and weekly jail docket to the County Attorney, jail staff, Court at Law clerks, Probation, attorneys. A special weekly docket is prepared for the Sheriff s office to assist them in scheduling officers for the court in a more efficient manner. 4. Maintain monthly and yeazly statistical information on criminal cases, including type of case, number of cases filed, number of cases disposed, etc. Prepare and distribute various orders and notifications to attorneys, defendants, county attorney, clerks and jail staff, including but not limited to order settings, resets, order appointing counsel and bond reductions. 6. Maintain and control the civil and family dockets and calendars for the Court. Communicate with attorneys and pro-se litigants to coordinate and set heazing dates for trials before the court, motions hearings, jury trials, etc. Coordinate and set telephonic hearings for cases with out-of--town attorneys whenever possible. 8. Prepare and distribute various orders to attorneys and all parties in case, which includes, but is not limited to order settings, mediation orders, and dismissals. Responsible for jury management: Plan and summons adequate number of jurors from the standpoint of both economy and efficiency based on the court's schedule. Enter juror excuses/exemptions in computer. Plan the re-use and reassignment of jurors to meet the court's needs after qualification of the central panel. Plan and provide for the comfort and convenience of the jurors during and after the selection process. Be prepared to answer numerous inquiries from prospective jurors. After trial, prepare and mail "thank you" letters to jurors who served. Prepare and submit post jury report for the purpose of permanently exempting those who are disabled or over the age of 70. 10. Listed below are the major responsibilities of the County Court at Law Court Reporter. The number of man-hours spent on thcsc activities varies constantly, depending on the type of case, the duration of the hearing or trial, whether the attorneys aze requiring a court record and any number of other factors involved. The classification grade of the employee performing these duties is Exempt. Attends all session of designated court, regular sessions and special-called sessions, and makes a full record of examination, testimony, judicial opinions, judge's chazge to jury, judgment or sentence of court, evidence, objections, rulings, voir dire of jury duty, azguments, comments and/or votes taken or other proceedings in court of law by machine shorthand notes. Performs court-reporter duties in all criminal matters before the court: pleas, arraignments, pre-trials, pre-trial conferences, contested- and other motions hearings, trials before the court and jury trials. Performs court- reporter duties in civil and family law cases as required/requested: final hearings, motions hearings, trials before the court and jury trials. Performs court-reporter duties in mental health, probate, juvenile, tax and appeal cases as required/requested. 3. Preserves all machine shorthand notes taken in all courts for future use and prepares accurate transcripts of court proceedings as instructed. 4. Maintains log of court sessions, records and exhibits. 5. Marks and files with the appropriate clerk's office, all court exhibits introduced into evidence during trials or hearings. 6. Your advice to the Commissioners' Court on how the County's work can be better organized to improve productivity and/or improve the quality of service: A review of the statistical records in the County Court at Law comparing the number of disposed cases versus the number of filed cases since 1/1/91 has revealed that, as of the end of 2005, the Court has a disposition rate of 102%. The Court has consistently maintained a 100%+ disposition rate since 1999. Many old cases have been disposed and with the assistance of the County Attorney's office, we are experiencing quicker disposition of new cases, which fulfills the defendants' "rights to justice". I feel that the numbers tell the story of the productivity and efficiency of this Court. The Commissioner's Court may want to entertain the idea of visiting the County offices and seeing for themselves the work that each office does and the dedication exhibited by the employees. In addition, it may prove fruitful to employ a personnel manager who could devote time to taking caze of such issues as reviewing job descriptions, solving insurance problems, updating personnel manuals and the like, which would allow the commissioners to direct more of their time and efforts toward the issues of Kerr County outside the courthouse. Const. Art. VIII, Sec. 14). In smaller counties the office may be created y a majority of the voters, or, as is the case in some Texas counties, the sheriff may {perform the duties (Tex. Const. Art. VIII, Sec. 16, 16a). In the past, the tax assessor-collector determined the value of property and collected ~'. taxes within the county. This office could also contract with other governmental units to perform the same services. Description of Office: Justice of the Peace Justice of the Peace The justice of the peace is the legal jurisdiction closest to the average citizen. Section 19 of Article 5 of the Texas Constitution provides that: justice of the peace courts have original jurisdiction in criminal matters of misdemeanor cases punishable by fine only and such other jurisdiction as may be provided by law. Original jurisdiction is the authority to accept a case at its inception, try it and pass judgment based upon the laws and facts. (f) A county that has a contract under Subsection (b) may impose an additional fee to a person paying a fine, fee, or tax to the county after it is past due. The additional fee maybe used only to reimburse the department for its expenses for providing services under the contract. (g) In this section: (1) a fine, fee, or tax is considered past due if it is unpaid 90 or more days after the date it is due; and (2) registration of a motor vehicle includes renewal of the registration of the vehicle. This bill clarifies that Section 502.185, Transportation Code, relating to the refusal to register a vehicle in certain counties, does not apply to the registration of a vehicle under Section 501.0234, Transportation Code, relating to the responsibilities of a vehicle dealer on the sale of certain vehicles. PORPOSE As enrolled, S.H. 401 clarifies Section 502.165, Transportation Code, to confirm that this section does not apply to vehicle registration under Section 501.0234, Transportation Code. Motor Vehicle Registration (a) Registration. Unless otherwise exempted by law or this chapter, a vehicle to be used on the public highways of this state must be registered in accordance with Transportation Code, Chapter 502 and the provisions of this section. Transportation Code, Chapter 501, Subchapter E and Subchapter D of this chapter prohibit registration of a vehicle whose owner has been issued a salvage or nonrepairable vehicle title. These vehicles may not be operated on a public roadway. (b) Initial application for vehicle registration. (1) An applicant for initial vehicle registration must file an application on a form prescribed by the department. The form will at a minimum require: (A) the signatwe of the owner; (B) the motor vehicle description, including, but not limited to, the motor vehicle's year, make, model, vehicle identification number, body style, manufacturer's rated carrying capacity in tons for commercial motor vehicles, and empty weight; (C) the license plate number; Page 1 (D) the odometer reading, or the word "exempt" if the motor vehicle is exempt from federal and state odometer disclosure requirements; (E) the name and complete address of the applicant; and (F) the name, mailing address, and date of any liens. (2) The application must be accompanied by the following documents: (A) evidence of vehicle ownership as specified in Transportation Code, §501.030, unless the vehicle has been issued a nomepairable or salvage vehicle title in accordance with Transportation Code, Chapter 501, Subchapter D; (B) registration fees prescribed by law; (C) any local fees or other fees prescribed by law and collected in conjunction with registering a vehicle; (D) evidence of fmancial responsibility required by Transportation Code, §502.153, unless otherwise exempted by law; and (E) any other documents or fees required by law (3) An initial application for registration must be filed with the tax assessor-collector of the county in which the owner resides, except that an application for registration as a prerequisite to filing an application for certificate of title may also be filed with the county tax assessor-collector in the county in which the motor vehicle is purchased or encumbered. (4) The recorded owner of a vehicle that was last registered or titled in another jurisdiction and is subject to registration in this state may apply for registration if the owner cannot or does not wish to relinquish the negotiable out-of--state evidence of ownership to obtain a Texas certificate of title. Code tit. 43, § 17.22 receipt of a form prescribed by the department and payment of the statutory fee for a title application and any other applicable fees, the department will issue a registration receipt to the applicant. (A) Registration receipt. The receipt issued at the time of application may serve as proof of registration and evidences title to a motor vehicle for registration purposes only, but may not be used to transfer any interest or ownership in a motor vehicle or to establish a lien. (B) Information to be included on the form. The form will include the: registration receipt is assigned to the applicant, an application for registration purposes only will not be processed. The applicant must apply for a certificate of title under Transportation Code, Chapter 501. (c) Vehicle registration insignia. (1) On receipt of a complete initial application for registration with the accompanying documents and fees, the deparhnent will issue vehicle registration insignia to be displayed on the vehicle for which the registration was issued for the current registration period. (i) out-of--state title number, if applicable; (ii) out-of--state license plate number, if applicable; (iii) state or country that issued the out-of--state title or license plate; (iv) lienholder name and address as shown on the out-of-state evidence, if applicable; (v) statement that negotiable evidence of ownership is not being surrendered; and (vi) signature of the applicant or authorized agent of the applicant. (C) Accompanying Documentation. An application for registration under this paragraph must be supported, at a minimum, by: (i) a cumpleted application for registration, as specified in pazagraph (1) of this subsection; (ii) presentation, but not surzender of, evidence from another jurisdiction demonstrating that legal evidence of ownership has been issued to the applicant as the motor vehicle's owner, such as a validated title or registration verification from the other jurisdiction, a registration receipt, a non-negotiable title, or written verification from the other jurisdiction; and (A) If the vehicle has a windshield, the symbol, tab, or other device prescribed by and issued by the department shall be attached to the inside lower left corner of the vehicle's front windshield within six inches of the vehicle inspection sticker in a manner that will not obstruct the vision of the driver. (B) If the vehicle has no windshield, the symbol, tab, or other device prescribed by and issued by the department shall be attached to the reaz license plate. (C) If the vehicle is registered as a Former Military Vehicle as prescribed by Transportation Code, § 504.502, the vehicle's registration number shall be displayed instead of displaying a symbol, tab, or license plate. (i) Former Military Vehicle registration numbers shall be displayed on a prominent location on the vehicle in numbers and letters of at least two inches in height. (ii) To the extent possible, the location and design of the Former Military Vehicle registration number must conform to the vehicle's original military registration number. (2) Unless otherwise prescribed by law, each vehicle registered under this subchapter must display two license plates, one at the front and one at the reaz of the vehicle. (A) The alpha-numeric sequence conflicts with the department's current or proposed regulaz license plate numbering system. (B) The executive duector finds that the alpha-numeric pattem may be considered objectionable or misleading by one or more members of the public for any reason, including that [he pattern may be viewed as having, dueclly or indirectly: (i) a sexual connotation; (ii) a vulgarity; (iii) one or more words that are not generally considered appropriate for all audiences, including children; (iv) a derogatory reference to any individual or group; (v) a reference to alcohol or to illegal activities or substances; or (vi) a misrepresentation of a law enforcement or other governmental entity. (C) The alpha-numeric sequence is currently issued to another owner. (4) The provisions of pazagraph (1) of this subsection do not apply to vehicles registered with annual license plates issued by the departrnent. (d) Vehicle registration renewal (1) To renew vehicle registration, a vehicle owner must apply, prior to the expiration of the vehicle's registration, to the tax assessor-collector of the county in which the owner resides. (2) The department will mail a license plate renewal notice, indicating the proper registration fee and the month and yeaz the registration expires, to each vehicle owner approximately six to eight weeks prior to the expiration of the vehicle's registration. Page 3 (3) The license plate renewal notice should be returned by the vehicle owner to the appropriate county tax assessor-collector or to the tax assessor-collector's deputy, either in person or by mail. The registration renewal notice may be used in connection with the renewal of registration at selected county tax assessor-collector offices via the Internet. The renewal notice must be accompanied by the following documents and fees: (A) registration renewal fees prescribed by law; (B) any local fees or other fees prescribed by law and collected in conjunction with registration renewal; and (C) evidence of financial responsibility required by Transportation Code, §502.153, unless otherwise exempted by law. (4) If a renewal notice is lost, destroyed, or not received by the vehicle owner, the vehicle may be registered if the owner presents personal identification acceptable to the tax assessor-collector. Failure to receive the notice does not relieve the owner of the responsibility to renew the vehicle's registration. (5) Renewal of expired vehicle registrations. (A) In accordance with Transportation Code, § 502.407, a vehicle with an expired registration may not be operated on the highways of the state after the fifth working day after the date a vehicle registration expires. (B) A 20% delinquency penalty is due when registration is renewed if the owner has been arrested or cited for operating the vehicle without valid registration. (C) If the county tax assessor-collector determines that a registrant has a valid reason for being delinquent in registration, the vehicle owner will be required to pay for twelve months' registration. Code tit. 43, § 17.22 (D) If the county tax assessor-collector determines that a registrant does not have a valid reason for being delinquent in registration, the full annual fee will be collected and the vehicle registration expiration month will remain the same. (E) If a vehicle is registered in accordance with Transportation Code, §502.164, §502.167, §502.188 §502.203, §504.315, §504.401, §504.405, § 504.411, or §504.505, and if the vehicle's registration is renewed more than one month after expiration of the previous registration, the registration fee will be prorated. (F) Any delinquent registration submitted directly to the department for processing will be evaluated [o verify the reason for delinquency. If the department determines that a registrant has a valid reason for being delinquent in registration, the vehicle owner will be requved to pay for 12 months' registration. Renewal will establish a new registration expiration month that will end on the last day of the 11th month following the month of registration. If the department determines that a registrant does not have a valid reason for being delinquent in registration, the full annual fee will be collected and the vehicle registration expiration month will remain the same. Valid reasons for delinquency include those reasons set forth in Transportation Code, §502.176(e). (6) License plate reissuance and recall program. (A) The county tax assessor-collectors are authorized to issue new multi-year license plates at no additional chazge on request by the owner at the time of registration renewal, provided the current plates are over five yeazs old. assessor-collector as prescribed by law. (2) • To obtain a replacement, the owner must properly execute an affidavit containing the vehicle description, the original license plate number, and a sworn statement that the license plate, symbol, tab, or other registration device famished for the described vehicle has been lost, stolen, or mutilated, and will uut be used ou auy ulher vehicle. (3) If the owner remains in possession of any part of the lost, stolen, or mutilated license plate, symbol, tab, or other registration device, that remaining part must be removed and surrendered to the department on issuance of the replacement and request by the county tax assessor-collector. (f) Out-of--state vehicles. A vehicle brought to Texas from out-of--state must be registered within 30 days of the date on which the owner establishes residence or secures gainful employment, except as provided by Transportation Code, §502.0025. Accompanying a completed application, an applicant must provide: (i) an application for certificate of title as required by Transportation Code, Chapter 501, if the vehicle to be registered has not been previously titled in this state; and (2) any other documents or fees required by law. (g) The owner of an electric personal assistive mobility device, as defined by Transportation Code, Section 551.201, is not required to register it. The device may only be operated on a residential street, roadway, or public highway in accordance with Transportation Code, Section 551.202. (B) The county tax assessor-collectors shall issue new multi-year license plates at no additional chazge at the time of registration renewal provided the current plates are over eight years old. (e) Replacement of license plates, symbols, tabs, and other devices. (1) When a license plate, symbol, tab, or other registration device is lost, stolen, or mutilated, a replacement may be obtained from any county tax (h) Enforcement of traffic warrant. The departrnent or a county tax assessor-collector may, pursuant to the provisions of a contract entered into under Transportation Code, §702.003, refuse to register a vehicle owned by a person for whom a warrant of arrest is outstanding for failure to appeaz or pay a fine on a complaint involving a violation of a traffic law. (1) To place or remove a registration denial flag on a vehicle record, the county must submit a magnetic tape or other acceptable submission medium as determined by the department in a format prescribed by the department. (2) The information submitted by the county will include, at a minimum, the vehicle identification number and the license plate number of the affected vehicle. (3) If a county data submission contains bad or corrupted data, the submission medium will be returned to the county with no further action by the department. (4) The magnetic tape or other submission medium must be submitted to the department from a single source within the county, as approved by the county commissioner's couR. (5) County submission of a magnetic tape or other submission medium to the department constitutes a certification that the county has notified owners of vehicles whose records appeaz on the tapes that past due fines, fees, or taxes are owed to the county.
