This was originally posted as an emergency meeting under the tentative approval that it did meet the criteria for an emergency; however, I'm going to turn it over to the County Attorney at this time. MR. EMERSON: Thank you, Judge. After careful reconsideration of all the facts, I think that this meeting probably does not meet the standards for an emergency. It was posted under the "unreasonably foreseeable circumstances" clause of the Open Meetings Act, and I think since the Trustees acted Monday with the understanding that the Juvenile Board had to approve the plan that was proposed, that a reasonable person could say the Juvenile Board may or may not have approved it, and as such, it should have been anticipated. It's my understanding that we do have an employee at the Juvenile Detention Facility that meets the standards to be able to step in as interim administrator, and 9-12-OG M.cjfbt 3 1 2 3 9 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 therefore the doors do not have to close, and therefore you don't have an imminent threat to the health or safety of the kids out there. And I think the proper action at this time would be to post it for 72 hours and have a regularly scheduled meeting. JUDGE TINLEY: Thank you, sir. We won't go forward with the agenda item at this time. What do we have in the way of availability of members of the Court so that we might work on getting something posted? COMMISSIONER WILLIAMS: 72 hours would be, at earliest, Monday; is that correct, Judge? JUDGE TINLEY: Yep. COMMISSIONER WILLIAMS: I'm available. COMMISSIONER BALDWIN: I'm available. COMMISSIONER NICHOLSON: Are you available Monday? COMMISSIONER LETZ: S thought we started at 2:00. COMMISSIONER NICHOLSON: The County Attorney just shut us down. COMMISSIONER BALDWIN: This meeting's over. COMMISSIONER LETZ: Oh. No, I'm not available Monday. I'm not -- I'll be out of town Monday. JUDGE TINLEY: How about Tuesday? COMMISSIONER LETZ: I will be here Tuesday. JUDGE TINLEY: You'll be here Tuesday? I've got a mental health docket in the morning. COMMISSIONER WILLIAMS: If we did it in the afternoon, Commissioner Letz and I have a late Airport Board meeting, but that's 5 o'clock, so anytime before that, far as I'm concerned, is okay. JUDGE TINLEY: 1:30, 2 o'clock Tuesday afternoon? COMMISSIONER LETZ: 2 o'clock will be fantastic. JUDGE TINLEY: Okay. COMMISSIONER NICHOLSON: Don't have to make two trips to town. COMMISSIONER LETZ: You understand. JUDGE TINLEY: Okay. COMMISSIONER WILLIAMS: 2 o'clock April 18th?
