It is up to the Commissioner of the Precinct to make that determination. Commissioner Nicholson has agreed to his request. If I am interprefing the new rules correctly, these aze the items that need to be considered: 1) Lot Size: An existing subdivision with a Community Water System (approved by TCEQ) is allowed to divide until it reaches an average of 3 acres, with the smallest lot being 1 acre. Wood Trails is 506 acres and currently has 125 lots, giving them an average of 4.04 acres, this additiona121ots will make it 3.98 acres. This Revision of Lot 60 is acceptable if they use Wood Trails Water System. However, Wood Trail Water is not currently approved for any new water connections, but may be in the future. 2) HGCD (Headwaters) current rules still support the 5 acre rule, therefore should you approve this plat the landowner will not be allowed to drill a well without a variance. 3) OSSF has approved. 4) All lots meet the Lot Frontage of 150 8. 5) Two of the proposed lots are in Special Flood Hazazd Area and the finished floor has been set on each lot. 6) There is a structure on Lot 60 as shown on the aerial, and it will be shown on the final plat. 7) Date for Public Hearing: May 22, 2006, 10.30 a.m. Th woodtraiF 60 ~dC~Gd l~oa~c~o~ c~ ~~r~~ro~. Voelkel SUB3ECT: Revision of Plat for Lot No. 60, Wood Trails Ranch Dave: Mr. Joe Siff, owner of the above-referenced tract would like to be on the agenda for the April 10°i meeting of Commissioners Court to set a date for a public hearing to approve the revision of plat. If you will recall, I met with you and Mr. Odom a few weeks back to discuss platting --- issues. At that time we discussed "water" issues. Presently the lot is served by one water tap from the Wood Trails Water Supply Company. As promised, I am enclosing a letter from the water company addressing additional taps and a letter from Headwaters addressing a "shared" well. It appears from these letters that Mr. Siff will have the option to either use the water system or drill his own well to be shared by all lots. I an~ also enclosing a copy of the routing slip which shows distribution of the plat and fees paid, a copy of OSSF preliminary plat approval, and a copy of Mr. Siffs well application. This scenario would not be acceptable to Headwaters under present rules. The shared well issue is not governed by Headwaters rules and would be a private issue between property owners. Once a shared well serves 15 residential connections or 25 residents on a year- round basis it becomes a "Community Water System" and would come under the regulation of TCEO.
