Based on Martin Marietta changing their price after we awarded the bids, we
cancel the award to Martin Marietta and award the bid for cold mix and
black base to the next low bidder which, is Vulcan Materials.

We sent out a summary of the Annual Bids that were awarded in Court Order # 29629. In
response to that mailing we received the attached letter form Martin Marietta explaining an error
in their bid.
Therefore, we ask the Court to change the award of the bid of Cold Mix and Black Base to
Vulcan.

Mr. Schwartz for equipment by the hour, who is low bid, and we
recommend as first contractor, but to retain that option for the
others in case there's certain equipment that we need that's
bigger sizes and all.

I am writing this letter to rescind Martin Marietta's bid referenced above submitted on 3/23/06, due to a
gross error on my part. I have included with this letter the work sheet I used to ftgure the prices I
submitted. In the process of transferring the prices to the bid submitted, I inadvertently left the freight
dollars out of the Black Base Type AA and Cold Mix Type CC. I am truly sorry for this error and I accept
full responsibility for it. I am resubmitting the .Material prices stated above including the freight The
following prices are the revised prices.
