See Agenda Request Rule Adopted by Commissioners' Court. reg4 July 20, 2006 We the undersigned land surveyors request that the Subdivision Regulations for Kerr County be amended to include an additional exemption to the platting process. The exemption concerns the relocating of a division line between two lots or properties. This exemption can be similar to the one that already exists within the City of Kerrville Subdivision Ordinance (see attachment). The exemption could read as follows: "A lot line or property line between two properties may be altered as long as no additional building site is created by said relocation. Property owners are cautioned to use care that such alteration does not create a problem with a set back line for an onsite wastewater system, well or building. Furthermore, property owners should be aware of minimum lot sizes as may be required by subdivision restrictions. " In a effort to remove government involvement in a private matter and to stream line the process land owners need to follow to achieve their goal, we _.. ask that this exemption be made part of the Subdivision Regulations for Ken County. //~. Approval ................................................. .... -17- Subdivision Ordinance Updated Oc[ober22, 1999 --~ The Citv of Kerrville to set2tre coordinated site plans to minimize the financial burden of urban development upon the City to assure the accuracy of land records to address the needs of sensitive lands that would be adversely affected by the strict application of this ordinance SECTION (B) PLATS. Except as otherwise provided below, the owner of land located within the city limits or in the extra-territorial jurisdiction (ETJ) of the city who subdivides the land and/or who owns previously subdivided land which was not platted in accordance with the current City Subdivision Ordinance, must have a plat of the subdivision or lot approved as provided in this ordinance. No improvements to the subdivision or lot shall be commenced until compliance with this ordinance is fulfilled. 2. The following are exempted from the above stated plat requirement: a. A conveyance of land by dedication, lease or sale to a public agency for a roadway, utility lines or drainage facility, provided that said conveyance is `~ accepted and approved by the public agency. '~l~ b. The conveyance of parcels of land between owners of ad}olning and contiguous land, provided that no additional building lot or substandard lot is created. Any lease of public property at the Kemiile Airport. d. Any property subdivided prior to January 1, 1981, provided that each part of the subdivided property was adequately served by the following after the subdivision: (1) Streets constructed and previously accepted for maintenance by the City or County, whichever is applicable; (2) Water improvements as currently required by this or other applicable ordinances; (3) Sanitary sewer or individual on-site sewage disposal system as ,~ cunently required by this or other ordinances; Subdivision Ordinance Updated October 22, 1999 -2-
