Information Technology Bi-monthly Report for July 10, 2006 -September 11, 2006 . Replaced six computers at the courthouse. Installed one new laptop. Replaced five computers at the Sheriffs Office. Installed one new laptop. Installed three new document scanners for the county clerk / county court at law. Responded to an average of two 'work-stoppage' call per day. . Responded to three or more calls per day from the Sheriffs office. . Converted to the Ingram City Marshall Office to a new Internet service provider connection to the county network. . Connected the 216`h District Attorney's office to a full time connection to the county network. Installed at home access to the county network for the JP4 clerk. . Completed implementation of Desktop computer backups to a central location. . Evaluated software and services for converting the county clerks land records to electronic format and filing. . Conducted a power down of the data center and the courthouse for routine maintenance by KPUB. KPUB found and replaced a damaged power cable in the courthouse transformer. . Assisted the collections department with financial reporting. . Tested electronic time reporting with the Sheriffs Office. Electronic reporting of time cards was rejected. . Responded to an average of three 'calls for service' per day. . Conducted routine maintenance of the county databases. Hours per week required = 18 Hours worked during this period were 660 averaging 83 hours per week. . Kerr County Information Technology requires three full time persons to fufill it's duties. . Contractor time 120 hours for Odyssey implementation and follow up training. I have been subpoenaed to appear in District Court as a witness regarding a computer that I was previously ordered to examine. IT Report Addendum: Collections Financial Report Issues The new court software, Odyssey Case Manager, has brought to light issues with the collection department's financial report. Assessing court costs when the a criminal case is filed is the root cause of the issues that the collection department has and will have with filing financial reports with this court. I have been brought into this issue by the collections department, and because this is a financial issue, I will point out for the court that the procedures in place that assess court costs when a case is filed is likely in violation of the Texas code of criminal procedure Article 102.002(c). This also causes reporting problems with local government code. Past issues with accounting of court financials is the other problem in the collection department financial report. Before the conversion to Odyssey the probation department fees were mismanaged. Probation time-payment fees that should have been removed from disposed court cases caused an imbalance in the financial report from the collections department. The 'fix' for this was a special report that disregarded the probation fees. This financial report was likely a violation of the Texas code of criminal procedure article 102. This report should not be re-created in Odyssey. Recommended Solutions: 1. Stop imposing court costs when a criminial case is filed. Work with software support to make this change. Fees should be assessed in accordance with Article 102.002(c) upon disposition, not when the case is filed with the county clerk. 2. The county clerk should account for the community supervision (probation) fee balances remaining on cases prior to April 7, 2006 Note: Software can remove or zero out solution 2's numbers. This would be a drastic measure and there would be no accounting. Tyler- Technologies were asked by me with the consent of the county clerk to prepare the special programming to remove the probation fees from all county court at law cases. CODE OF CRIMINAL PROCEDURE CHAPTER 102. COSTS PAID BY DEFENDANTS SUBCHAPTER A. GENERAL COSTS Art. 102.002. [1055, 1078-1082] [1188-1192] [1138-1142] WITNESS FEES. (a) Repealed by Acts 1999, 76th Leg., ch. 580, Sec. 11(a), eff. Sept. 1, 1999. (b) The justices of the peace and municipal courts[0] shall maintain a record of and the clerks of district and county courts[0] and county courts[O] at law shall keep a book and record in the book: (1) the number and style of each criminal action before the court[0]; (2) the name of each witness subpoenaed, attached, or recognized to testify in the action; and (3) whether the witness was a witness for the state or for the defendant. (c) Except as otherwise provided by this subsection, a defendant is liable on conviction for the fees provided by this article for witnesses in the defendant's case. If a defendant convicted of a misdemeanor does not pay the defendant's fines and costs[0], the county or municipality, as appropriate, is liable for the fees provided by this article for witnesses in the defendant's case. (d) If a person is subpoenaed as a witness in a criminal case and fails to appear, the person is liable for the costs[0] of an attachment, unless he shows good cause to the court[0] why he did not appear. The roads we are unable to complete will be the first done out of next yeaz's funds. The Town Creek Project was completed Aug 31, 2006, taking only 57 days. The realignment of Upper Turtle Creek is completed, but we aze still waiting on the paperwork to be completed so that we can open it. Doug has finished placing concrete curbing and black base on Ball Drive to take out a large dip. New signs have been placed in hopes of slowing down the traffic, because without the dip the speed will increase. The only thing it needs for completion is a seal coat. Matter's Crew has been working at Keith and Upper Turtle Creek clearing brush, cutting back the hill and installing new fences to make a better line of site. One was Stephens who they reported last month; they wanted to know if what he had was in compliance. He obtained a permit to work on his dam and has 6 months to complete the work. The other was a property just west of the city limits that is not in the floodplain, therefore we have jurisdiction. Employees: We have one employee out on Workers Comp. He hurt his back while shoveling asphalt on Ball Drive project and will be reevaluated for return to work Sept 15, 2006.
