This machine has enabled all law enforcement agencies in the county to have fingerprirs of anyone they arrested submitted immediately to both the Department of Public Safety in Austin and the Federal Bureau of Investigation for positive identification of the individual, and for immediate update of the individual's criminal history. Prior to this, it took upwazds of six months to get this accomplished. Due to the checks and balances with the Live Scan, this also prevented poor quality inked prints from being mailed in and rejected. In most cases, by the time our agency was notified, the individual had already been released from custody and better prints could not be obtained. This resulted in the individual never being positively identified, and the arrest charges never being added to his/her criminal record, even if the charge was as serious as sexual assault of a child or murder. Having the chazges added to a person's criminal history immediately is of extreme importance to the criminal justice community. The criminal history is used by the courts and prosecutors in determining the extent of punishment allowed by law. For example, the "three strikes, you're out" rule. Criminal histories aze also used to determine an inmate's eligibility to participate in the Sheriffs Department outside trustee programs. This trustee program allows the Sheriff, under the Code of Criminal Procedure Article -- 43.10, to use inmate labor to provide maintenance and related services to a non-profit organization that qualifies for a tax exemption under 501 (a), Internal Revenue Code of 1986, as an organization described by Section 501 (c) 3 of that code, and determined by the Commissioners' Court, to provide a public service to the county. The Sheriff must have accurate and up to date information to insure that no inmate who could be a danger to the community is used. The criminal histories are also extremely important to officer safety. Officers across our nation must be able to rely on criminal history "hits" for their safety in traffic stops or other encounters with individuals. Since the purchase of the current Live Scan 2000 system, the Texas Department of Public Safety has changed their operating system to an Internet-based system. Kerr County has also just updated the countywide system to an Internet-based system. This is causing some non-compatibility problems with the Live Scan 2000 system. Ken County has had to spend a little over one million dollazs to upgrade the countywide system Further, the Sheriff's Department has been notified that the maintenance contract will no longer be honored by Live Scan 2000 due to the technology changes and parts not being made any longer. In sununary, this will cause the area law enforcement agencies to have to revert to the old and ineffective way of submitting inked fingerprints within the next few months. The scanning glass is one part that wiU no longer be produced. This scanning glass has to be °° replaced approximately 2 to 3 times per yeaz, depending on the number of prints taken. This grant application is in the amount of $153,830. This amount will allow the Sheriffs Department to purchase the equipment and softwaze to remain capable of immediately sending fingerprints to the Texas Department of Public Safety and Federal Bureau of Investigations for identification purposes. The new system will also allow for the following that was not available with the current system: 1) A local AFIS (Automated Fingerprint Identification System). This allows the Sheriff's Department, or any other agency desiring to participate, to request free of charge from the Texas Department of Public Safety all fingerprints that have ever been submitted to DPS by that agency to be loaded into the local data base. This will allow for immediate scanning of fingerprints found at crime scenes and a comparison to be made within minutes. With the current process, you must submit the print and the compazison is then made at the (APIs) lab in Austin, which is a state wide database. Since this is where the majority of the latent or lifted prints aze made throughout the state, this process is now taking up to one yeaz. Almost all crimes committed aze committed by local criminals and the local database will allow these crimes to be solved in minutes instead of a year. 2) The current system also required us to have the person to be identified brought to the jail to be fingerprinted on the machine. This has been done successfully ~- and surrounding counties such as Kimble and Kendall have transported people here to be identified. The drawback has mainly been with deceased persons and persons that were not already under arrest. This new system solves this problem in two different ways. The first is that a fingerprint cazd may be scanned into the system for immediate identification. This system also has four (4) remote ,wireless, handheld mobile devices that may be used by placing one finger on the device for immediate identification. This can be very helpful in identifying persons with Alzheimers and dementia or other problems without having to transport those people to the jail. 3) The new system will also place a terminal at the Kerrville Police Department enabling them to scan in prints that they lift from crime scenes themselves for immediate comparison. 4) Neither DPS or the FBI currently have a palm print database, even though a large number of prints lifted at crime scenes aze palm prints. The new system allows us to start a palm print database for comparing and identifying palm prints. 5) DPS and the FBI do not accept fingerprints from persons arrested for Class "C" misdemeanors. This means that persons arrested for charges such as Disorderly Conduct, Public Intoxication, Theft under $50.00 and hundreds of other offenses aze never entered into the state wide database. Without a local database, these people cannot be positively identified. 6) Currently, fingerprints that aze taken from juveniles, concealed handgun Applicants and persons needing background checks performed for certain job "~' applications have to be printed the old way using ink and mailing in the print cazds. This system will add these persons to our local database and do away with the necessity of mailing in inked prints and having the chance of those prints being rejected due to poor quality. As is shown in the AFIX tracker material, this system will also print courtroom displays that area agencies may use during trials, to show the positive compazison and how they are made to juries.
