This parcel was sold in May 2000 granting access with a 1 %z mile - 30ft road easement between Love Road and the property. The developer wishes to divide the tract of land into 5 or fewer parcels. We have several questions to address today. 1) Since the easement was established before Dec. 11, 2000, is it "grandfathered?" 2) Can we required the 1 '/z miles of 30 ft. easement to his property be upgraded? 3) The road inside this tract can be an Unpaved Country Lane if the following two items aze met: A) 7.06.14(bb) Unpaved Country Lane: An "unpaved country lane" is one used primarily for access to abutting residential property with a small number of lots and minimal traffic volume. A country lane may serve eight (8) lots or less or serves an expected average daily traffic count of 60 vehicles per day or less. All lots must be a minimum often (10) acres. This road shall be a privately maintained road and shall be signed, "Privately Maintained Road. " B) 7.08. (d) Restrictive covenants shall be imposed on all of the Resulting Tracts with frontage or access onto the unpaved road prohibiting any future re- subdivision of any tract into lots smaller than ten (10) acres unless the road is first constructed to the County's standards then in effect for paved roads and accepted for maintenance by the County. 4) With 5 lots or less can this property be developed under the alternate plat process with only a fmal and no preliminary as stated in Kerr County Subdivision Rules, 6.035.A. The Commissioner of the precinct in which the proposed subdivision is located may approve an alternate process for plat approval for any subdivision with less than five (5) lots as set forth in Th rockin bar S this section. If the commissioner does not approve the alternate plat process, the plat process for the subdivision shall be as set forth in Sections 6.01, 6.02, 6.03, and other applicable provisions of these regulations. 5) The developer has material on his property that he feels will be good road base.
