RECITALS WHEREAS, pursuant to the Interlocal Agreement for Emergency Medical Services and Management of the County First Responder Program dated _ _, 2006, between City and County ("Agreement"), City agreed to, in part, provide emergency medical services to the unincorporated areas of Kerr County ("Service Area") in order to serve and protect the County's citizens; and WHEREAS, residents of the both Falling Waters and Reserve residential subdivisions, which are located in the extreme northeastern portion of Kerr County have requested, via representatives of their homeowner associations, that the Kendall County EMS serve their areas due to the proximity of Kendall County to these areas; and WHEREAS, Kendall County EMS has agreed, pursuant to the terms of a sepazate agreement between the Kerr County and Kendall County; to provide emergency medical services, both emergency and transport, to Kerr County residents living within the Falling Waters and Reserve subdivisions; and WHEREAS, based upon the requests of the residents of the two subdivisions, the County requests that the Agreement be amended to remove these azeas from the Service Area served by the City's EMS; and NOW THEREFORE, for and in consideration of the recitals set foKh above and the agreements and conditions set forth below, City and County agree as follows: 1. Article iI, Section A. of the Agreement is amended by revising the Service Area specified and depicted within Exhibri A, an amended versioa of which is attached hereto and Included herein for all purposes. The parties hereto have revised the Service Area found at Exhihit A by removing the residential subdivisions called Falling Waters and the Reserve from the Service Area served by the City's EMS. Said areas are located generally in the extreme northeast portion of Kerr County; in an area bordering Interstate 10 and State Highway 87. Upon receipt of a calf for EMS service in this area, the Kerrville dispatch service wild forward such calls to Kendall County dispatch, which will then be responsible for dispatching Kendall County EMS and any First Responder to the area. The parties agree that within this described service azea, Kerrville EM5 shall have no duty to respond pursuant to this Agreement. Any response by Kerrville EMS that may occur ptusuant to any lnterlocal Mutual Aid Agreement between Kerrville and Kendall County will be at the direction of and on behalf of Kendall County EMS. 2. I reside at 140 Lookout Point Road, Comfort, TX 78013, which is located in Falling Water Subdivision approximately 5 miles out of Comfort North on Hwy 87 towazds Fredericksburg. The entrance to the subdivision is in Kendall County; however, the large majority of the subdivision is located in Kerr County. Bemazd Selensky who is President of the POA and a resident of Kendall County and I aze here representing the Kerr and Kendall County Falling Water POA. I am currently serving as their Vice President. Currently there are 72 homes located in Falling Water, of which 54 aze located in Kerr County. Our problem: In the event of a medical emergency in Falling Water, where a resident residing in the Kerr County portion of the Subdivision would need to be transported, we would need to wait for the EMS Unit from Kerrville to arrive, even though it is quite possible that a first responder from Kendall County EMS Unit, that is located in Comfort, could arrive & transport the patient by as much as 20to 25 minutes sooner than that of the EMS Unit from Kerrville. We have discussed this matter with both the Kerr & Kendall County Commissioners and members of the Kerrville Fve Department, Chief Raymond Holloway, Assistant Chief Mark Beavers & EMS Director Eric Maloney and have been told that we must have your approval to improve upon the current method of handling. After meeting with Chief Holloway, the Reserve at Falling Water has asked that they be a part of this arrangement. We have submitted similaz data for their sub-division that includes 16 homes occupied or under constmction. We believe the solution to this problem would be for an "inter-local agreemen[° to be drawn between Kerr & Kendall Counties whereby the Kendall County EMS unit would be given permission to transport providing that their unit was in the Comfort area. If the Kendall EMS unit was not present in the Comfort area, we would of course understand that the nearest available EMS unit would have to make the call and transport if necessary. We believe this method of handling would be a superior way to serve the citizens than the present system being used. It is our understanding that a similar agreement is currently in place serving the citizens of West Kerr County in the YO Ranchlands area by Kimble County. During the past two and a half yeazs we have known of only two EMS calls to the subdivision. One call was in Kerr County and the other in Kendall. Our POA supports the Comfort Voluntary Fire Department with a substantial monetary gift each year and our residents aze paying sizeable county taxes to both counties. We trust that the Kerr County Commissioner's Court will help us solve this problem before some emergency situation occurs at one of our doorsteps. We understand Fire Chief Halloway and Commissioner Letz have been working with the Kemille City Manager Paul Hofftnann and they have a draft inter-local agreement ready for your consideration. Also, the Board of Directors of Falling Water has passed a resolution requesting the inter-local agreement be enacted. A copy is included.
