He states that a new well is needed and in the past the Court has abandoned road easements back to the property owner when the easement no longer serves a purpose for the public. We don't see why this could not be done as long as Mr. Wiedenfeld pays for the revision of plat and no cost is incurred by the County. If the Court agrees, we will need to set a public hearing. Supporting information: Oak Ridge Estates is located approximately 2 miles north of Hwy 27 off Stoneleigh Road, Centtr Pint, TX. Wiedenfeld Water Works, Incorporated purchased the Oak Ridge Estates Water System in December 2006 and now find a deeper "replacement well" is needed to continue providing potable water to the 42 existing customers. The original platting includes 48 residential lots and a well lot. The well lot is 50' x 50', but CCN boundaries are conterminous with the subdivision. There is no better property within the CCN for which a new well catZ be placed, considering all set-backs, rules, (local and state) and desires by the grantees of'tl~P Sanitary Control Easements (see attached maps). Also, greater separation to existing well reduces potential for contamination. A purpose for this request is that I need to own the land for which the proposed well is to be located, which is now a platted 50' wide road easement (see attached maps). This road easement only serves to access my well site. After abandonment is completed, I have represented to the owner of Lot 13 that we could evenly split the 50' wide easement. A 25' wide access is sufficient for access to my well lot. Also, beneficial to county is that approximately 0.4 acres (by my calculations) will be added to the tax rolls. ;~ a ~~~~~. R. " Since those records were not attached I cannot definitively tell you who owns the easement . In general terms, road and utility easements are typically given to the County and not the land owner and therefore are not available to be purchased from the land owner. There are multiple legal issues and elements to be proven potentially involved in the proposed scenario and by statute we cannot provide legal advice to private individuals. I would recommend that Mr. Wiedenfield retain private legal counsel to navigate through this issue.
