Whereas, Kerr County inadvertently over-paid Edward Martin employment compensation in the total amount of seven thousand four hundred forty nine dollars and twenty four cents($7449.24); and Whereas, Edward Martin previously acknowledged the error and agreed to repay the overcompensation on October 24, 2006 at the rate of $150 per pay check and has in fact repaid $1800.00 thus far leaving a balance due of $5649.24. NOW THEREFORE, Edward Martin agrees to pay two hundred dollars($200) per month to County until paid in full with first $200 payment due and payable to County on or before November 30, 2007 and a like amount due before the 30`h each month thereafter until paid in full. County agrees to modify October 24, 2006 agreement in the interest of equity in an effort to accommodate Martin. It is expressly understood and agreed by the parties that this agreement may be enforced in a Court of competent jurisdiction in Kerr County, Texas. This agreement cannot be modified unless agreed to in writing and approved and signed by both parties.
