October 30, 2007 and the information provided to date this property subdivision is not subject to KC Subdivision Rules. I have visited with Mr. Don Voelkel, surveyor, about this matter. It is my understanding that this property subdivision is exempt from platting based on Section 1.03.8., 1.03.C., 1.03.G. and 1.03.H. While I understand there are some ROW concerns on the access to the property from Lane Valley these issues exist prior to this property division and this division do not change the current legal access. Further, the owners are not dividing all of the property where they own an undivided interest and the final ROW to subject property crosses the remaining undivided interest which provides legal access to the subject property. October 30, 2007 and the information provided to date this property subdivision is subject to KC Subdivision Rules and should be platted. I have not visited with Mr. Brandenburger, surveyor, about this matter; however, it appears the laying out of the access road to this tract requires the subdivision to be platted.
