EXTENSION FOR DEPOSITING FUNDS WITH THE COUNTY TREASURER
Came to be heard this the 24th day of September, 2007, with a motion made by
Commissioner Letz, seconded by Commissioner Oehler. The Court unanimously
approved by vote of 4-0-0 to:
Authorize the County Clerk to make deposits monthly to the County Treasurer
through the end of the year, and then come back to the Court with a plan on how
long to extend it beyond that.

RE: Depositing funds with Treasurer
Dear Colleague:
This memorandum is provided to refresh your memory on the statutory requirements to
deposit funds with the treasurer. This subject was discussed at a recent Commissioners Court
meeting. Because many of you were attending to your duties and not at the meeting the Court
requested I forward a reminder.
Local Government Code Section 113.022 states that a county officer who receives funds
shall deposit the funds with the county treasurer on or before the next regular business day after
the date on which the funds are received. If this deadline is not met, the officer must deposit the
funds, without exception, on or before the seventh business day after the day the on which the
funds are received.

TGC ~ 113.022. TIME FOR MAKING DEPOSITS. A county officer
o receives funds shall deposit the funds with the county
~reasurer on or before the next regular business day after the date
on which the funds are received. If this deadline is not met, the
officer must deposit the funds, without exception, on or before the
seventh business day after the day on which the funds are received.
However, in a county with fewer than 50,000 inhabitants, the
commissioners court may extend the period during which funds must
be deposited with the county treasurer, but the period may not
exceed 30 days after the date the funds are received.
