See Agenda Request Rules Adopted by Commissioners' Court. ,~ . #31121 STATE OF TEXAS § § COUNTY OF KERR § INTERtOCAL AGREEMENT BY AND BETWEEN KERR COUNTY, TEXAS AND ALAMO AREA COUNCIL OF GOVERNMNETS (AACOG) FOR THE PROVISION OF AACOG COLLECTING DATA RELATIVE TO THE GROWTH IN KERR COUNTY THIS tNTERLOCAL AGREEMENT (this "Agreement") is entered into by and between the Kerr County, Texas, a political subdivision of the State of Texas (hereafter referred to as "COUNTY") and Alamo Area Council of Governments, a regional council of governments (hereafter referred to as "AACOG") shown below as Contracting Parties, pursuant to the authority granted and in compliance with the provisions of the Interlocal Cooperation Act, Chapter 791, Texas Government Code. Contracting Parties The Receiving Agency: Kerr County, Texas The Performing Agency: Alamo Area Council of Governments (AACOG) II. Statement of Services to be Performed: COUNTY recognizes the growth that has occurred in Kerr County, Texas since the Census Bureau's 2000 Census. AACOG is willing to assist COUNTY with the collection and processing of data from the Kerr Appraisal District's 2008 Certified Roll for Kerr County, Texas, in order to provide to COUNTY the necessary growth information for planning purposes. AACOG wilt collect the data and then present said data in two meetings with designated representatives of COUNTY. After presenting the data to COUNTY's representatives, AACOG will work with COUNTY to process the results by designating census tracts consistent with COUNTY's planning purposes. AACOG wilt be responsible for collecting the data from designated COUNTY agencies, including but not limited to the Kerr Appraisal District and Kerr County Engineer's Office. COUNTY wiff make alt reasonable efforts to ensure said COUNTY agencies promptly provide the necessary data to AACOG. AACOG wiff process said data in order to identify and ensure specific addresses are geocoded to the proper census tract. Page 1 of 3 *, After collecting the requisite data, AACOG will use Census software to divide tracts based on Census standards. Thereafter, AACOG will meet with COUNTY's designated representatives to review each tract and make any needed changes based upon COUNTY's planning purposes. AACOG will then produce a final map for submittal to the Census Bureau electronically. III. Basis for Calculating Reimbursable Costs The AACOG Board of Directors has set the approved amount of allowable reimbursement cost for the above-stated project at forty five dollars ($45.00) per hour. The maximum estimated time for the above-stated service by AACOG is thirty (30) hours. IV. Agreement Amount The total allowed billable cost to COUNTY for the above-stated service by AACOG is One Thousand Three Hundred and Fifty Dollars ($1,350.00). Said amount shall not exceed $1,350.00 and AACOG pledges to take all reasonable efforts to complete the above stated services in less than 30 hours if possible. V. Payment for Services COUNTY shall remit payment for the above-staged services to AACOG within 30 days of receipt of invoice. Term and Termination This Agreement shall begin on the date executed and shall terminate when the services are complete. Said services to be provided by AACOG shall be completed not later than February 28, 2009. With regard to termination of this Agreement, both parties are entitled to all rights and remedies afforded pursuant to state and federal law. VII. Certifications The undersigned Contracting Parties do hereby certify that each is authorized to perform the services required by this Agreement and that such services further a governmental function of both agencies. Payment for the services performed by the Performing Agency will be made from current revenues available to the Receiving Agency.
