Also included with this correspondence is a copy of the standard as it applies to tents, copies of the Kerr County jail population reports for the last ten (10) years, and an informational sheet on Maricopa, Arizona tent jail facility. This should give us talking points for the Commissioners' court meeting. The Texas Commission on Jail Standards was established by the 64th Legislature in 1975 with the Texas Revised Civil Statutes Annotated Article 5115.1. The Commission was enacted after the 1960's era U.S. Supreme Court began to determine that the conditions in prisons and jails were violating inmate 1St 5th 8th and 14th amendment civil rights. As a result, many Texas county jails, including Harris, Dallas, EI Paso, Travis, Hidalgo, Lubbock, Cameron, Ector, Potter, were the subjects of inmate class action lawsuits. Confident that a Texas agency, rather than federal courts, was the best solution, the Texas Sheriff's Association and the State Bar of Texas organized to draft and support legislation in the creation of the Texas Commission on Jail Standards. Many of the standards drafted by the inaugural commission were based and revised upon both state and federal court decisions. After the establishment of the Texas Commission on Jail Standards, many subsequent court decisions referred to the jail standards as a guidepost for the courts. Local Government Code 351, first enacted in 1957, states that "county commissioners shall provide for the safe and suitable jails for their respective counties." Secure storage space shall be provided for disposition of weapons. RULE §259.504 Construction Approval The site shall be of sufficient size to provide for adequate spacing of tents and support structures to facilitate access of emergency and service vehicles and equipment. Site shall provide adequate drainage to maintain sanitary and safe conditions. RULE §259.506 Construction Materials Tent fabric shall he of durable, waterproof, and fire-resistant material and shall be maintained in good condition. Tent supports shall be structurally sound and fire-resistant. Tent floors shall be constructed of fire-resistant solid material. Tent floors shall be raised or constructed to prevent site runoff water from entering tents. Tent construction shall incorporate measures which protect against the entrance and infestation of vermin. According to a Maricopa County Sheriff's Office spokesman. the department receives "hundreds" of lawsuits, resultin~~ i~rum j~iil ~unclitiuns, in~ludin~~ deaths ,tnd .~5~~iults occurring in the j~iil. There have been numerous settlements awarded against Maricopa County Sheriff's Office. There is reported to be at least one lawsuit by a female inmate housed in tent city stemming from a possible miscarriage due to excessive heat and poor nutrition. The family of one inmate was awarded $8.25 million following his death after being shocked with a stun gun and strapped to a restraint chair. The inmate died in the restraint chair soon afterward after having a towel thrown over his head and his head pushed downward toward his chest to the point of suffuratiun. I__ast April a federal fury ~iw~u-dcd $9 million to the family of Charles Agster III. In 2002, an Arizona Appeals Court affirmed a $635,532 settlement against Sheriff Arpaio, stating, "The evidence concerning unsafe conditions in Tent City was essentially undisputed, even by jail authorities. The evidence was abundant that authorities were aware of and ignored grave risks to life and limb." The same court held that the actions of Sheriff Arpaio made the department and the County liable for damages. Since Sheriff Arpaio has been Sheriff, The M~u-icopa Sherill~'s Ofticc has been sued by Amnesty International and the United States Department of Justice for jail conditions. The federal suit forced Maricopa County into a building program, the first phase of which was completed in July 2005. This project, including programming cost was almost $400,000,000 (four hundred million, not a typo) and provided a total of 4,100 beds and all of the supporting services.
