The proposed installation is a standard treatment system with a low pressure dosing drainfield for septic disposal. TAC § 285.3(h)(1) specifically states that a variance can be granted if the RS demonstrates that conditions being proposed give equivalent or better protection to the public health and the environment than that required by a standazd installation. One variance requests to use a soil application rate of 0.2 gaUsq ft/day instead of the required 0.1 galfsq ft/day for Class IV soils. The soil at the HCTC proposed drainfield site is Class IV soil which is not disputed by anyone. Low presswe dosing systems can work well in Class IV soils if they are properly sized. If we grant the request to use an application rate of 0.2 gallsq ft/day then the drainfield size will be reduced by one-half. This would reduce the evapotranspiration and soil absorption rates over a conventionally sized drainfield. During rain events when the soil is saturated and the field is undersized, septic is likely to surface thus causing a health and environmental hazard. The rationale used to justify this variance request is that the current drainfield installed in Class IV soil works, so the proposed system should work, too. This ignores the fact that the current system is not working otherwise there wouldn't be a request to install a new system. We believe that the proposed system does not give equivalent or better protection than a properly sized drainfield would, therefore we cannot grant the variance. The second variance requests to use a 93 foot long lateral line rather than limit the length to 70 feet as recommended by a North Carolina State University study done on LPD systems. The TAC rules recommends that LPD systems be installed using the North Carolina State University guidelines unless atherwise directed by the state permitting authority. This 70 foot length is recommended to reduce pressure losses in the LPD drainfield which operates at a relatively low head pressure (2 - 4 feet of pressure head). Mr Wiedenfeld has stated that the pressure drop in the 1 %4 inch lateral pipe is about 1.4 feet of pressure head. As long as the header pressure is maintained at the recommended 2-4 feet of head ,then this pressure loss should not be detrimental to the operation of the system.
