This program plays a vital part of helping the feral cab in Kerr County. It traps, innocnlate's, spays/neutera and returns them to their colony. It is then monitored by a volunteer. This promotes better health for oar City/County and has proven to reduce the number of anwanted Idttens/cab that are destroyed yearly. The Big Fiz was: organized by Pamela Warner and with the help of s few volunteers has successfully continued to redace colonies. She has done this with donations from our community and help from oar local veterinarians. We, at the Hamane Society, totally support what she is doing. This helps as, our Animal Control and Animal Welfare, and moat importantly our City of KerrviUe~ in keeping the numbers of cats/kittens surrendered to ns. We noticed a difference in cat population last year. With the spay/neater program the Humane Sodety has in effect since 2001 and The Big Fiz, along with other clinics, Kerr County might one day have complete control on the unwanted cat population. The Big Fiz continoes to receive calla from our community for help in controlling colonies and they have a few "large" colonies that desperately needs help before breeding time again. Within #hese laws are clauses that can and do affect cat colony caretakers, but which are generally ambiguous and open to interpretation. Here are some of the issues present in many ordinances, not necessarily Kerr County's. . The definition of "Ownership" To assist TNR: Cats in managed colonies (fixed, with rabies shots, and eartipped) are not owned • Mandatory Ongoing Rabies Vaccinations To assist TNR: Ongoing rabies vaccinations not required because nationally homeless cats live 3-5 years, most rabies vaccines protect for more than 1 year after inoculation, catching cats is difficult and time consuming, and the best rabies control is stopping the breeding. • Mandatory Identification To assist TNR: No mandatory identification on the cat, such as collars with tags, because they are not safe on free roaming and feral cats. Micro chipping is done in some places. Its cost is a burden for low budget TNR programs. • Mandatory Registration (licensing) To assist TNR: No mandatary registration of individual cats that have been subjected to TNR, though some places register managed cat colonies with non-profit TNR groups like The Big Fix. • Cat Limitation (restriction on number per household) To assist TNR: No restriction since the cats are not pets • Definition of Abandonment and Neglect To assist TNR: Managed cat colonies continue to be fed and monitored so the cats aren't abandoned when they are returned after TNR. • Cat control -anti-roaming or leash laws To assist TNR: Anti-roaming and leash laws are impractical for all free roaming cats and totally unenforceable for feral cats ~r~u«~ ra From the Code of Qrdinances -City of Alamo Heights httpJ/W ww. alamohelghtstx gov/admin/city_codes. htm Feral cat shall mean a cat that exists in a wild or untamed state, either due to birth or reversion to a wild state from domestication. The usual and consistent temperament of a feral cat is extreme fear and resistance to contact with humans. Feral cats are completely or substantially unsocialized to humans. Feral cat caregiver shall mean a vohwteer, uncompensated person who agrees to facilitate the trap- neuter-return program in accordance with this chapter and any rules and regulations established by the chief of police. Feral cat colorry shall mean a group of cats that congregates, more or less, together as a unit. Although not every cat in a colony may be feral, any non feral cats that congregate with a colony shall be deemed a part of ft. Trap-Neuter-Return Program means a program pursuant to which feral and stray cats are trapped, evaluated, neutered or spayed, vaccinated against rabies and returned to the area where they congregate. Sec. 4-15. Feral cats/l`rap-neuter-retum program In order to effectively and humanely control feral cat populat~ns within its jurisdictional boundaries, the city shall sponsor atrap-neuter-return program in an effort to reduce the feral cat population over t time without the necessity of wholesale capture and euthanization. The°crty may establish a fund or provide services to off-set the costs of trapping, ~utering, ate vaccinating captured feral cats that can be returned to an appropriate, controlled, protected, and authorized colony site. Caregivers for colonies, whether one (1) ar several feral cats, may be aided by the city in providing traps, transportation to a spay/neuter facility and off-setting costs, to t~ exteirt that fining is available. Ear-tipping will be used on feral cats in order to be idemified as spayed or neutered and vaccinated member of a managed colony. A photographic record adequate to identify the cat shall be obtained for all cats part of the city trap-neuter-return program. Caregivers of feral cat colonies shall implement proper management and sterilization practices and seek the assistance of animal care services personnel and/or the chief of police in order to: (1) Sterilize (spay/neuter) all adult cats that can be captured. (2) Vaccinate, as required by law, all cats that can be captured against rabies, preferably with a three (3) Year vaccine and against any other infectious disease as may be mandated by law (3) Make every attempt to remove kittens from the colony before eight (8) weeks of age for domestication and placement. (4) Make every attempt to remove sick or injured cats from the colony for immediate veterinarian care or humane euthanasia. (5} Assure responsibility and arrangement for feeding the cat colony regularly throughout the year. Feeding of feral cat colonies managed by a caregiver shall not constitute a violation of this chapter. Animal care services personnel shall maintain all records relating to authorized managed feral cat colonies in the city trap-neuter-return program to include proof of sterilization, vaccination, ear-tipping, and medical care records. Other responsibilitiesinclude: (1) Authorization of managed feral cat colonies in the citytrap-neuter-return program (2) Help to resolve complaints over the conduct of a colony caregiver or of cats within a managed colony. (3) Maintain records on the size and location of the colonies as well as the vaccination and spaylneuter records of managed feral cat cobnies. (4} Maintain records and prepare monthly reports on the following: (a) Number of managed colonies in the city; (b) Total number of cats in colonies; (c) Number of cats and kittens spayed and neutered pursuant to thetrap-neuter-return program; acid (d) Number of cats and kittens placed in permanent homes. Enforceirent: The city shall retain the following rights: (1) The right to seize or remove cats from a colony that have not been vaccinated against rabies and which are demonstrating signs of the disease; (2} The right to seize/remove a cat from a colony that is creating a nuisance as de$ned in this chapter a$er the caregiver has been afforded thirty (30) days to remove and relocate the cat and has failed to do so; and (3) The right to seize and remove a colony of cats when a caregiver is unable to provide care aixi management of the colony and has not been able to obtain a replacement or substitute caregiver. This presumption can be rebutted only by a current rabies vaccination certificate signed by a veterinarian or issued by an approved government agency. (2) EXCEPTION FOR EAR-TIPPED FERAL CATS. A FERAL CAT THAT HAS BEEN EAR TIPPED IS PRESUMED TO HAVE BEEN VACCINATED AT LEAST ONCE. - § 10-308. Impounding animals - In general. (a) Scope of section. This section applies to: (1) any dog or cat that is unlicensed, not wearing a val'~d identification tag while outdoors, or otherwise in violation of § 10-207 {"Prohibited conduct"} of this subtitle; and (2) any animal that is not restrained as required by § 10-307 { "Restraints required"} of this subtitle or otherwise by law. (b) Seizure of animal. DA. (2) For this purpose, these persons may pursue the animal onto any public or private property. (3) THE COMMISSIONER MAY ADOPT RULES AND REGULATIONS TO GOVERN THE CIRCUMSTANCES AND PROCEDURES UNDER WHICH FERAL CATS ARE SEIZED. (c) Impoundment. (1) An animal seized under this section must be taken to an animal shelter and impounded there in a humane manner. (2) If the owner or keeper of the animal can be identif~d, the animal shelter must immediately notify the owner or keeper by telephone or mail. (3) An impounded anrtnal, OTHER THAN A FERAL CAT, must be kept for at least 3 working days, unless sooner reclaaned by its owner or keeper. (4) AN IMPOUNDED FERAL CAT MUST BE KEPT FOR AT LEAST 3 WORKING DAYS, UNLESS SOONER RECLATMED IN ACCORDANCE WITH RULES AND REGULATIONS ADOPTED BY THE COMMISSIONER. § 10-402. Abandonment of animal. (A) IN GENERAL. No person may desert or abandon any animal that the person owns, keeps, restrains, or confines, whether as a pet or for any other purpose. (B) EXCEPTION. Recently, Dallas Animal Services amended our laws to allow a feral cat colony to exist under the definition listed below: Dallas City Ordinance Art. III, Care and Treatment of Animals Sec. 7-3.1.~ Proper Restraint (a) An owner of an animal commits an offense if he fails to restrain the animal at all times in a fenced yard, in an endosed pen or structure, or by a tether or leash. (b) No animal may be restrained by a leash unless the animal is in the immediate possession of and accompanied by the animal's owner. (c) It is a defense to prosecution under Subsection (a) that the animal was: (1) a dog in an off-leash site established under Section 32.6.1 of this code; or (2) a feral cat participating in a trap, neuter, and return program approved by the director. "FERAL CAT CAREGIVER" MEA COMMI ONER T,O TRAPAALTERDVACCINATE FOR PROGRAM APPROVED BY THE RABIES AND DISTEMPER, EAR TIP, AND RETURN FERAL CATS: (I j PROVIDES CARE, INCLUDING FOOD, SHELTER, OR MEDICAL CARE, TO THE CAT; OR Z m (2) HAS TEMPORARY CUSTODY OF THE CAT. ~ w ~ d n (k) Keeper. (1) [N GENERAL. "Keeper" means any person: ({) [(1)] who has legal title to, a property interest in, or permanent custody of any animal regulated by this subtitle; or (II) [(2)] who, for 3 days or more, has temporary custody of, keeps, possesses, regularly feeds, or exercises control over any animal. (2) EXCEPTION. "KEEPER" DOES NOT INCLUDE A PERSON KEEPING A FERAL CAT AS A FERAL CAT GAREGI VER. (I) Kennel. (l) !N GENERAL. "Kennel" means any premises or part of any premises where 3 or more dogs or cats over 6 months vld are boarded or maintained. (2) EXCEPTION. "KENNEL" OGS OR NON FERAL CATS OVER 6 MONTHS OLD ARE BOARIDED~OR LESS 3 OR MORE D MAINTAINED ON THE PREMISES. (L-1) OWNER. "OWNER" DOES NOT INCLUDE A PERSON KEEPING A FERAL CAT AS A FERAL CAT CAREGIVER. ~al~t- ~g3 10-104. Rules and regulatans The rules and regulations that the Commissioner adopts under § 2-106 of this article may include provisions: (l) for the issuance of permits and licenses under this title; (2) requiring the humane care of all animals; (3) governing the general care and control of animals; [and) (4) governing the operatan of facilities subject to this title; (5) PROVIDING FOR THE APPROVAL OF PROGRAMS TO TRAP, ALTER, VACCINATE FOR RABIES AND DISTEMPER, EAR TIP, AND RETURN FERAL CATS; AND (6) GOVERNING THE CIRCUMSTANCES AND PROCEDURES UNDER WHICH FERAL CATS ARE SEIZED, IMPOUNDED, AND RECLAIMED. § 10-301. Rabies -vaccinations. (c) Unlicensed dog or cat presumed unvaccinated. (I) IN GENERAL. Any unlicensed dog or cat that is older than 4 months is presumed to be unvaccinated. This presumption can be rebutted only by a current rabies vaccination certificate signed by a veterinarian or issued by an approved government agency. (2} EXCEPTION FOR EAR-TIPPED FERAL CATS. A FERAL CAT THAT HAS BEEN EAR TIPPED IS PRESUMED TO HAVE BEEN VACCINATED AT LEAST ONCE. 10-308. Impounding animals - In general. (a} Scope of section. This section applies to: (I) any dog or ca[ that is unlicensed, not wearing a valid identificatbn tag while outdoors, or otherwise in violation of § 10-207 {"Prohibited conduct"} of this subtitle; and (2j any animal that is not restrained as required by § 10-307 {"Restraints required"', of this subtitle or otherwise by law. (b) Seizure of animal. ~c . ~ ~ ~s << ~,y~. (I) An animal described in subsection (a) of this section may be seized by the Bureau or by any pol~:e officer, h~~n~ane officer, designated empbyee of the Department, or other person contracting with the City to do so. (2) For this purpose, these persons may pursue the animal onto any public or private property. (;} THE COMMISSIONER MAY ADOPT RULES AND REGULATIONS TO GOVERN THE CIRCUMSTANCES AND PROCEDURES UNDER WHICH FERAL CATS ARE SEIZED. (c) Impoundment. (I) An animal seized under this section must be taken to an animal sheher anti impounded there in a humane manner. v (2) If the owner or keeper of the animal can be identified, the animal sheher must immediately notify the owner or keeper by telephone or mail. (;} An impounded animal, OTHER THAN A FERAL CAT, must be kept for at least 3 working days, unless sooner reclaimed by its owner or keeper. (4) AN IMPOUNDED FERAL CAT MUST BE KEPT FOR AT LEAST 3 WORKING DAYS, UNLESS SOONER RECLAIMED IN ACCORDANCE WITH RULES AND REGULATIONS ADOPTED BY THE COMMISSIONER. I 0-402. Abandonment of animal. (A) IN GENERAL. \o Iversen may desert or abandon any animal that the person owns, keeps, restrains, or contines, whether as a pet or for any other purpose. B) EXCEPTION: A i=ERAL CAT CAREGIVER WHO PROVIDES CARE TO OR HAS TEMPORARY CUSTODY OF A FERAL CAT iN ACCORDANCE WITH AN APPROVED PROGRAM TO TRAP, ALTER, VACCINATE, EAR TIP, AND RETURN FERAL CATS IS NOT DEEMED TO HAVE DESERTED OR ABANDONED THE FERAL CAT. Most agree that this populaton Is growing. On December 5, 2007 the Houston city council adopted an ordinance proven to reduce the cat population. Tha Ordinance -Chapter 6 Sectbn 6-3 of the city ordinance makes it a defense to prosecution that the animal Is: (b- 2): A tera! cat that has been subJected fo a trap, neuter and return program approved by the health department director. What Is a trap, neuter and roturn programs This means a program approved by the dlredor In which feral cats are humanely trapped, evaluated, vaccinated, sterilized, and marked by an Identifying notch In the left ear by a veterlnarlan and returned to the trap location. What is a feral catP A feral cat K any homeless, wild or untamed cat. Why. not trap and euthanb:e these catst The method of trapping and euthanizing has been empbyed by BARC for decades. This method Is not effective In controlling the cat populatbn. The sudden depletbn in numbers creates a vacuum that Is filled by cats Prom outside the cobny. The result Is your neighborhood ends up wtth more unsterilized cats. A managed trap, neuter, and return feral cat cobny will not be able to reproduce and will keep newcomers out. (Reference: "Understanding Cats: Their History, Nature and Behavior") Who Is responsible for taking care of those animab? Every feral cat cobny that has been subjected to a trap neuter and return program approved by the health department director, wlli have a cobny manager. The colony manager will be responsible for trapping the cats, getting them sterilized, vaccinated, evaluated, and ear notched. This person will apply to BARC, to be a colony manager. The colony manager will be trained In feral cat colony management. BARC will partner with bcal feral cat agences, to provkle trapping expertise and ongoing training on colony management. The agences will assist BARC in educating Indlviduai residences and neighborhood assoctatbns who have nuisance complaints. The agencies wlli also assist In providing or referring bw cost sterilizatlons, vaccinations and mkrochips. Whlie some assistance may be available, ultimately It Is the cobny manager's responsibility to pay whatever costs are Incurred, while they are managing the colony.
