Judge Tinley and Commissioners,
I am passing this information on to you for your consideration.
Kerr County is eligible for this program and it could bring some
external funding to our area. Our existing Kerr County Historical
Commission is the means to obtain this designation. Our current
Bylaws, operative regulations and membership are all in place,
The County would not need to adopt any new regulations or, in
fact, do anything more than we are currently doing to fulfill our
stated mission.
In Texas, counties may be designated as Certified Local
Governments through the county historical commission, thus
becoming eligible for federal grants to carry out their
preservation programs.
The Certified Local Government (CLG) Program is a local, state
and federal government partnership for historic preservation. It
is designed to help cities and counties develop high standards of
preservation to protect a wide range of important historic
properties-from ornate courthouses to working-class
neighborhoods. Local governments that participate in the CLG
Program act independently to develop and maintain n successful
preservation program. The Texas Historical Commission
administers the program at the state level and the National Park
Service is the responsible federal agency.

In Texas, a city or a county may apply to become a Certif ied Local
Government (CLG). To qualify as a CLG, a local government must:
1. Enforce state or local legislation that protects historic
properties (current activity of KCHC)
2. Establish a qualif ied review commission composed of
professional and lay members (current KCHC membership).
3. Maintain a system for surveying and inventorying historic
properties (current KCHC activity).
4. Provide for public participation in the historic preservation
process, including recommending properties to the National
Register of Historic Places (current KCHC activity).
To pursue designation, follow these steps:

Certified Local Government (CLG) grants provide funding to enable local communities to develop quality
programs and fully participate in the state's preservation process. CLG grants require a cash or in-kind

• Training for local preservation commissions
• Completing or updating surveys of historic resources
• Producing historical walking or driving tour brochures, videos or other educational materials
• Preparing preservation plans
• Preparing National Register of Historic Places nominations
Who Can Apply?
Cities or ceunties officially designated as a CLG by the Texas Historical Commission (THC).
Deadlines:
Applications are due in the summer each year.
Review Process:
Applications are reviewed by an interdisciplinary panel of agency staff and approved by the THC.
Source of Funding:
CLG grants are funded with money appropriated from Congress for preservation efforts through the National
Park Service Historic Preservation Fund (HPF). By federal law, the THC must set aside at least 10 percent
of its HPF appropriation for CLG grants each year.
Funding Amount:
Typically, grants range from $250 to $10,000.

Haw to become a Gertified Local Government

Q. Once the application to become a CLG is submitted, how long does it take to become
certified?
The Texas Historical Commission (THC) will respond to the request for certification within sixty (60) days of
receipt of an adequately documented request for certification. If approved by the THC, the application is then
forwarded to the Secretary of the Interior, who has fifteen (15) working days to respond. If no comment is
received, the local government will be considered certified.
Q. What must be included in a historic preservation ordinance?
At a minimum, a local ordinance must include:
• A statement of purpose substantially similar to the language in the purpose Gause of the state enabling
legislation, Chapter 211 of the Texas Local Government Code Sections 211.001, 211.003, 211.005.
- A clear delineation of any designated historic district boundaries
• Definitions of appropriate terms used in the ordinance, i.e., alteration, area of influence, ordinary
maintenance, etc.
• Specific membership and duties of the historic district commission
• Mandatory review of exterior alterations and demolitions of designated historic properties
• Adoption of the Secretary of the Interior's Standards for Rehabilitation to be used by the Commission in
reviewing applications for Cert~cates of Appropriateness
Provision for procedural due process including public hearings and public notification.
• Specific time frames for reviews and consideration of alternatives
• Provisions for noncompliance
Q. Who can be a member of a landmark commission or architectural review board?
Members of the local commission or board must meet certain qualifications. These include:
- Having demonstrated interest, competence or knowledge in historic preservation
• To the extent available in the community, members should be preservation-related professionals.
• Must be residents of the county or municipality for which they serve.
Q. What if my community does not have the requisite number of preservation related
professionals?
In this case, the local government must demonstrate that it has made a reasonable effort to fill these
positions with apreservation-related professional.
Q. What are the duties of a landmark commission or architectural review board?
At a minimum, duties of a local commission or board must include:
• Conducting a continuing survey of cultural resources in the community according to guidelines established
by the THC
• Establishing written guidelines for the preservation of structures designated as historic under local or state
legislation. Also judging compatibility of requests for permits of alteration or demolition of designated historic
properties. The Secretary of the Interior's Standards for Rehabilitation shall be the basic guidelines for
review
• Acting in an advisory role to other officials and departments of local govemment regarding the protection of
local cultural resources
• Acting as liaison on behalf of the local govemment to individuals and organizations concerned with historic
preservation
• Working toward the continuing education of rtizens within the CLG's jurisdiction regarding historic
preservation issues and concerns
• Reviewing all proposed National Registration nominations for properties within the boundaries of the CLG's
jurisdiction.
Q. How often must a landmark commissioner or architectural review board meet?
The THC requires the landmark commission or architectural review board of a CLG community to meet once
a month unless no business is at hand.
Q. What can I, an average citizen, do to help establish a historic district in my area?
To begin with, you will need to gain the support of both your elected officials and the citizens of your
potential historic district. Take time to speak to the citizens, hold a public meeting, and explain the
advantages of historic districts.
Remember, a historic district is established to benefit the public. The public is always welcome at meetings
and should be encouraged to attend and participate.
Q. What role does a CLG play in the National Register of Historic Places process?
One of the minimum duties of a landmark commission is to review alt proposed National Registration
nominations for properties within the boundaries of the CLG's jurisdiction (CLGs can be administered by a
city or county).
To which laws must CLGs and landmark commissions or architectural review boards pay specific attention?
Of course, all State and Federal laws are applicable, but specific attention must be paid to Texas Open
Meetings laws, the Freedom of Information Act, gift laws and, naturally, the local historic district ordinance.
Q. What does "Section 106 Review" mean?
Section 106 refers to a particular part of the National Historic Preservation Act of 1966 that requires every
Federal agency to "take into account" how each of its undertakings could affect historic properties.
Section 106 Review refers to the federal review process designed to ensure that historic properties are
considered during federal project planning. The review process is administered by the Advisory Council on
Historic Preservation, an independent agency, in consultation with the State Historic Preservation Officer.
The Council must be afforded a reasonable opportunity to comment on such projects. Any project involving
federal funds is subject to Section 106 Review.

KERB COUNTY HISTORICAL COMMISSION
KCHC MEMBERS QUALIFICATIONS
Joseph Luther, Ph.D., is Chairman of the Kerr County Historical Commission.
He is a professor emeritus and former Associate Denn of the College of
Architecture at the University of Nebraska. He holds a Master's and
Doctoral degree from the College of Architecture at the Texas A&M
University. He taught planning and architecture for more than 33 years at
the university level. He is a member of the Texas State Historical
Association, the National Trust for Historic Preservation, the Texas
Archeological Association and the Hill Country Archeological Association.
Juliana Mosty Leonard, Historical Marker chairman. While living in Oklahoma
City, she was the Prevent Blindness State Chairman for vision screening
program and co-chairman for the "Swing for Sight "benefit. She was
awarded the society's "Distinguished Service Award". She also served
several years as an officer in Delta Gamma Alumnae and vision screened over
2000 pre-school children. For her service, she was honored with the
chapter's "Rosebud Award ". She is a member of the Daughters of the
American Revolution and the Daughters of the Republic of Texas.
Julia Stehling, who is interested in the natural beauty of the area along with
its people and architecture, is currently KCHC Treasurer Chairman of the
Finance Committee and the Archives Committee. She has served on the Main
Street board.

Jeanie Webb is Secretary of the Kerr County Historical Commission. The
descendant of 5 generations in Kerr County, Jeanie graduated from Tivy
High School, earned a B.A. degree in Political Science from San Jose State
University, taught social sciences at Tivy High School, and served for over
20 years as professional support staff and academic advisor at the
University of Texas at EI Paso. She is currently Vice President of the
Kerrville Branch of the American Association of University Women, an
officer in the Kerrville Newcomers Club, and a member of the Kerrville
Police Department's Citizens Police Academy.
Francelle Collins an active member of the Kerr County Historical Commission
and is Chairman of the Ornl History Committee. She currently interviewing
Kerr County residents and recording their oral histories for the History
Center and also providing them to Schreiner University to be put on n
website entitled "Voices of the Hill County". This is an ongoing collaborative
project with interviews scheduled monthly.
Jeanne Sutton is a member of the Archives Committee and Chair, Cemetery
6PS Committee. She is athird-generation Kerr County native and
avid genealogist. She honed her project management and organization
skills as program manager of major weapon systems in the United States Air
Force.
Bryant Saner is Chairman of the Archeology Committee, active in recording,
documenting, teaching and preserving archeology in the Hill County. He is an
active member of the Texas Archeological Society and the Hill County
Archeological Association. He has served a four year term as n Steward
with the Texas Historic Commission. Bryant is employed as a field
archeologist by the Center for archeological Research at the University of
Texas at San Antonio.
Francis H. "Fuzry" Swayze is a member of the Archives Committee. Born in
Center Point in 1919 and lived in Kerrville since 1923. A retired professional
photographer, he is one of the few left in the County of that generation
that can identify things as they were at that time.

Irene Van Winkle (B. S. degree) is n writer at the West Kerr Current. She
has been writing a series of historical articles on families, places and events
in the Texas Hill Country for the past 2-1/2 years, and has also had n
collection of 50 stories put into a special edition, Family Chronicles. She
continues to interview individuals and do research in this ongoing project,
which has added and contributed to knowledge of the local history of the
area, as well as placing them in a wider context historically.
Lanza M. Teague is the Center Manoger for the Kerr Arts and Cultural
Center, anon-profit organization housed in the historic post office building
in downtown Kerrville. Her professional background is in journalism,
technology and marketing. Lanza's ancestors settled in Kerr County in the
1890s and her recent work in researching/archiving family photos and
stories has sparked a keen interest in the history of Kerrville and the
surrounding area. She is a volunteer for the Kerr County
Genealogical Society and has recently joined the Kerr County Historical
Commission as a general member.
Laura L. Rhodes retired teacher of math at Tivy High School for 29 years.
Education -two Bachelor of Science degrees from SWTXSU one in math and
one in home economics. Was part of the starting of an annual Schellhase
Reunion. Was secretary of the committee for the Comfort Jubiliem in 2004.
Am currently co-chair of the "Beginnings of Cypress Creek". Family settled
in Cypress Creek Comfort area in 1852. Immediate family names include
Wiedenfeld, Pfeiffer, Saur, Schellhase,

SUMMARY
The Kerr County Historical Commission (KCHC) is a county agency made up of
volunteer residents for the purpose of initiating programs suggested by the
Texas Historical Commission (THC) nt Austin for the preservation of the
historical heritage of the county. The mission of the Kerr County Historical
Commission is to protect and preserve the County's historic and prehistoric
resources for the use, education, enjoyment and economic benefit of
present and future generations. This mission will be implemented through
the Texas Statutes pertaining to County Historical Commissions and
Historical Preservation and the programs as promulgated by the Texas
Historical Commission. (TX Gov Code, Chapter 442. Texas Historical
Commission; TX Local Gov Code, Chapter 318, Historic Preservation by
Counties)

2.3.Institute and carry out a continuing survey of the county to
determine the existence of historic buildings and other historical and
archeological sites, private archeological collections, important
endangered properties, or other historical features within the
county, and to report the data collected to the Kerr County
Commissioners' Court and the Texas Historical Commission.
2.4. Develop and maintain an inventory of surveyed individual properties
and districts in accordance with standards established by the Texas
Historical Commission_
2.5.Establish a system for the periodic review and assessment of the
condition of designated properties in the county, including Recorded
Texas Historic Landmarks, State Archeological Landmarks, and
individual historic properties or districts listed in the National
Register of Historic Places.
2.6. Report the results of the review and assessment to the Texas
Historical Commission, Division of Archeology.

3.1.Oversee the management and preservation of documents pertaining
to the Kerr County Historical Commission.

4. ENDANGERED PROPERTY COMMITTEE =Chair, Joe Luther.
4.1. The Texas Historical Commission's (THC) Historic Endangered
Landmarks Program (HELP) is an effort to identify, track and
publicize endangered historic properties in Texas, and to help our
local preservation partners address threats to historic properties in
their communities.
4.2. Inventory and document existing surveys of historic resources.
4.3. Undertake new or update existing surveys.
4.4. Annually update surveys of historic resources and submit to THC.
4.5. Establish n system for the periodic review and assessment of the
condition of designated properties in the county, including Recorded
Texas Historic Landmarks, State Archeological Landmarks, and
individual historic properties or districts listed in the National
Register of Historic Places. The commission should report the
results of the review and assessment to the Texas Historical
Commission.
4.6.Monitor actions of federal agencies, local government, and developers
to ensure the plans for future projects (roads, new construction,
housing, etc.) will not endanger a historic property or area.
4.6.1. Advise the County Commissioners' Court and the THC on citizen
thinking as a direct channel for the expression of citizen concern.
4.6.2. Monitor legal notices in the local newspaper for announcements
of public hearings or pending projects and notify the THC when
appropriate.

zoning boards, and councils of government.

7.1. The Kerr County Historical Commission is an arm of the county
government. Therefore, funds from any and all sources must be
deposited with the county treasurer but may be placed in a special
KCHC account.
7.2.Direct allocations from the Kerr County Commissioners' Court in
accordance with Chapter 118 of the Local Government Code are the
chief funding source for the KCHC.
7.3.The KCHC, as n branch of county government, is a tax-free entity,
under the provisions of Chapter 31$ of the Texas Local Government
Code.
7.4.A11 donations, to the extent allowable by law, are tax deductible.
7.5.Any real property and museum collections are the property of Kerr
County and are governed by the Commissioners' Court. The county
judge and commissioners' court must approve acceptance of donations
of real property and collections by the KCHC.
7.6.The Finance Committee is responsible for all matters relating to the
Kerr County Historical Commissions fiscal responsibilities.
7.6.1. Management of budget and funds must be in accordance with
the procedures of Kerr County government.
7.7.The Grant Writing Group for KCHC is to serve as part of KCHCs
overall fund raising effort for projects approved by the Board of
Directors.
7.7.1.1. The Grant Writing Group will work with The Friends
KCHC, the nonprofit organization formed to raise funds for
KCHC by helping to plan fund raising strategies for the wide
variety of projects undertaken by KCHC
7.7.1.2. The Grant Writing Group will: (1) research foundations as
possible funding sources (2) gather information for the
preparation of grant proposals (3) write the grant proposal.

and (4) after the President has signed the proposal, mail the
proposal to the foundation or funding source.

8.Z.The GPS Committee use digital satellite photography, USGS maps,
and local knowledge to find unmarked cemeteries across the county.

9. MARKER COMMITTEE =Chair, Julie Leonard.
9.1. The Marker Committee manages four types of designations to
recognize and protect historic and prehistoric properties in Kerr
County:
9.1.1. Recorded Texas Historic Landmarks
9.1.2. State Archeological Landmarks
9.1.3. National Register of Historic Places
9.1.4. Historic Texas Cemeteries
9.2.The KCHC chair or marker chair (duly appointed by the KCHC chair)
serves as the sole liaison with the Texas Historical Commission (THC)
throughout the marker process, from the online submittal of the
application to the review and approval of the inscription. In general,
the responsibilities are as follows:
9.2.1. Survey the existing Official Texas Historical Markers in your
county to determine their condition; report any missing or
vandalized markers to the THC.
9.2.2. Notify the THC and provide a completed request form for any
proposed relocation of a marker.
9.2.3. Analyze the existing markers within the context of the county's
history to determine where there might be gaps or untold, but
significant, stories. Develop a proactive program for addressing
any deficiencies and to promote a more diverse interpretation
through future applications.

9.2.4. -Communicate with potential sponsors to explain the THC and
CHC procedures, and to answer any questions they might have.
9.2.5. Review applications for historical accuracy and for compliance
with THC procedures and standards.
9.2.6. Verify documentation, where feasible, to ensure accuracy and
thoroughness. Work with sponsors to develop their applications to
ensure a quality submittal to the THC.
9.2.7. Communicate with the THC marker team about any concerns,
questions or suggestions for program improvements. Keep the
THC posted on successes, which serve to encourage other CHCs.
9.2.8. Serve as the liaison between the THC and KCHC and between
the KCHC/THC and the sponsors.
9.2.9. Respond to all THC inquiries on behalf of the sponsors or KCHC
and disseminate copies to others as needed.
9.2.10. Review marker inscriptions for accuracy.
9.2.11. Promote the marker program at the county level through
training workshops and materials, public information meetings and
marker dedication ceremonies.
9.2.12. Monitor the Recorded Texas Historic Landmarks (RTHL)
in the county on n regular basis and work with property owners to
understand their legal obligations under the designation
procedures. Notify the THC of any exterior work on RTHL
properties.
9.2.13. Post marker dedication ceremonies to the THC's web site
calendar and publicize them in your community.

ARTICLE I
The name of this organization shall be the KERB COUNTY HISTORICAL
COMMISSION.
ARTICLE II -Mission
The mission of the Ken County Historical Commission is to protect and preserve the
County's historic and prehistoric resources for the use, education, enjoyment and
economic benefit of present and future generations. This mission will be implemented
through the Texas Statutes pertaining to County Historical Commissions and Historical
Preservation and the programs as promulgated by the Texas Historical Commission. ~Tx

Counties)
ARTICLE III -Members
Section 1. The Kerr County Historical Commission shall consist of the Board of
Directors, which is the governing body, and the General Membership. Members of the
Commission must be individuals who broadly reflect the age, ethnic, and geographic
diversity of the county. Each Commission member must have an interest in historic
preservation and an understanding of local history and resources.
Section 2. The membership of the Board of Directors of this Commission shall be
limited to appointments by the Kerr County Commissioners' Court. The Board of
Directors must be composed of at least seven residents of the county.
Section 3. General Membership is available to individuals or representatives of
cooperating organizations in Ken County working to achieve the goals of Kerr County
Historical Commission and the Texas Historical Commission. Such individuals and
representatives may be invited to participate in meetings and activities of the
Commission as a General Member -without appointment to the Board of Directors by
the County Commissioners' Court. Such invitation is subject to review and. approval by
the Board of Directors.
Section 4. Any appointed member of the Commission desiring to resign from the
Commission shall submit his or her resignation in writing to the Chairman who shall
present it to the Kerr County Commissioners' Court for action at the end of the current
month.
ARTICLE IV -Officers
Section 1. The Board of Directors of the Commission shall consist of at least seven (7)
directors appointed by the Kerr County Commissioners' Court, and from this governing
body shall be elected an Executive Committee consisting of the Chairman, First Vice-
Chairman, Second Vice-Chairman, Secretary, and Treasurer. These officers shall perform
the duties prescribed by these bylaws and by the parliamentary authority adopted by the
Commission.
Section 2. At the regular meeting held on the third Thursday in October, a Nominating
Committee of five (5) members shall be elected by the Board of Directors It shall be the
duty of the Committee to nominate, from the Board of Directors, a slate of officers to be
elected. After such November election, the names of the elected directors shall be
presented to the Commissioners' Court for confirmation and appointment.
Section 3. The Kerr County Commissioners' Court shall appoint the Directors in
January and such appointments will commence in January for atwo-year term.
Section 4. For any vacancy or resignation of any officer, the Commissioners' Court
shall fill a vacancy on the Commission for the unexpired term of such officer at the first
directors' meeting following notice of resignation.
Section 5. The Commissions' Court shall provide the Texas Historical Commission a
list of appointed members and mailing addresses of each member.
ARTICLE V -Duties of Officers
Section 1. The Chairman shall preside at all meetings; call special meetings as required,
appoint Committee Chairmen as approved by the Board of Directors; serve as a member
of all committees; approve or disapprove all awards for submission to the Texas
Historical Commission or return to the originator; render an annual report and plan of
work to the Kerr County Commissioners' Court at end of the calendaz year; make
awards presentations; appoint Liaison Officers to other organizations in Kerr County and
other special officers as may be necessary from time to time and as approved by the
Board of Directors.
Section 2. The First Vice-Chairman shall serve as the Chairman of the Finance
Committees

Section 3. The Second Vice-Chairman shall serve as the Chairman of the Historic
Markers Committee
Section 4. The Secretary shall report proceedings of all meetings, process
correspondence; keep necessary public files; and post notice of meetings in accordance
with Open Meeting law
Section 5. The Treasurer shall account for all monies received and disbursed; and make
an annual fmancial report.
Section 6. Any chair of standing committees shall work with the Executive Committee
and the Board of Directors of the Commission to perform assigned duties of a
committee. If the Chair cannot continue duties as assigned, the Commission Chairman
shall assign duties to another member.
Section 7. The Board of Directors shall process and approve or disapprove all
applications for State awards and forward to the Texas Historical Commission; and carry
on the business of the Commission, including recommending budgets and other action
for consideration of the general membership.
ARTICLE VI -Meetings
Section 1. The Regular Meeting of the Kerr County Historical Commission shall be
held at least quarterly at a time and place designated by the Chairman. All meetings of
the commission shall be conducted in accordance with the open meetings law, Chapter
551, Government Code.
Section 2. The Regular Meeting in November shall be for the purpose of electing
directors and officers; of receiving reports of officers and committees; and for any other
business that may arise.
Section 3. The first Regular Meeting of each year shall be for the purpose of preparing
and reviewing the Annual Report and Plan of Work
Section 4. Special Meetings can be called by the Chairman as needed or upon written
request of five members of the Commission. The purpose of such Special Meeting shall
be stated in the call, and notice shall be given to all appointed members of the
Commission. Except in case of emergency, at least three (3) days notice shall be given.
Section 5. Four appointed members of the Commission shall constitute a quorum. At a
membership meeting a motion, other than a motion to amend the by-laws, shall pass by
simple majority of those present and voting.
ARTICLE VII -Board of Directors
Section 1. The appointed members of the Commission shall constitute the Board of
Directors. A representation of the Kerr County Commissioners' Court may serve as a
member of the Board of Directors at the discretion of the Court.
Section 2. The Executive Committee shall be elected from the Board of Directors and
shall have general supervision of the affairs of the Commission between its business
meetings, fix the hour and place of meetings, make recommendations to the Board of
Directors, and shall perform such other duties as aze specified in these bylaws. The
Boazd shall be subject to the direction of the Texas Historical Commission and the Kerr
County Commissioners' Court and none of its acts shall conflict with their direction.
Section 3. Three (3) members of the Executive Committee shall constitute a quorum at
Executive Committee meetings. At an Executive Committee meeting a motion shall pass
by simple majority of those present and voting.
ARTICLE VIII -Standing Committees
Section 1.There shall be Standing Committees which are permanent committees
specializing in the consideration of particular subject areas. There are currently 14
standing committees for the Kerr County Historical Commission. Committee chairmen
will be appointed by the Chairman and approved by the Board of Directors. Individuals
of the General Membership may be invited to serve on committees_

Section 2. The Board of Directors shall promptly at the January meeting of the year
prepare the Annual Plan of Work of the Commission, in consultation with the Chairs of
the Standing Committees.
Section 3. The Finance Committee shall coordinate external fund raising through grants,
gifts and other means as appropriate and shall audit the Treasurer's account at the close
of the fiscal year and shall report its findings to the Board of at the December meeting.
Section 4. The Commission shall file a full and complete Annual Report and Plan of
Work, including activities, a budget, and recommendations to the Kerr County
Commissioners' Court and the Texas Historical Commission before the end of each
calendar year.
Section S. The Commission shall make recommendations to the Commissioners' Court
and the Texas Historical Commission concerning the acquisition and designation of
property that is of historical and archeological significance.
Section 6. The records and files that are accumulated by the Commission are public
records and as such they are subject to use or inspection by the public. They shall be
saved and maintained in the Commission's archive room in the County Courthouse or
other approved location.
ARTICLE IX -Resource Identification.
(a) The Commission should institute and carry out a continuing survey of the county to
determine the existence of historic buildings and other historical and archeological sites,
private archeological collections, important endangered properties, or other historical
features within the county, and should report the data collected to the Commissioners'
Court and the Texas Historical Commission.
(b) The Commission should develop and maintain its inventory of surveyed individual
properties and districts in accordance with standards established by the Texas Historical
Commission.
(c) The Commission should establish a system for the periodic review and assessment of
the condition of designated properties in the county, including Recorded Texas Historic
Landmarks, State Archeological Landmarks, and individual historic properties or
districts listed in the National Register of Historic Places. The commission should
report the results of the review and assessment to the Texas Historical Commission.
Article X -Parliamentary Authority
The rules contained in the current edition of Robert's Rules of Order Newly Revised
shall govern the Commission in all cases to which they are applicable and in which they

are not inconsistent6 with these bylaws and any special rules of order the Commission
may adopt.
ARTICLE XI -Amendment of Bylaws
These bylaws can be amended at any Regular Meeting of the Commission by a two-
thirds vote, provided that the amendment has been submitted in writing at the previous
regular meeting and distributed by mail to all members.

§ 318.001. DEFINITION. In this subchapter,
"commission" means the county historical commission.

county may appoint a county historical commission for the purpose
of initiating and conducting programs suggested by the

with the statewide preservation plan. In suggesting programs, the
Texas Historical Commission shall consider the fiscal and human
resources the county has to conduct the programs.

§ 318.004. APPOINTMENT BY STATE. If the commissioners
court fails to appoint a commission by April 1 of each odd-numbered
year, the Texas Historical Commission may appoint the commission
after 30 days' written notice to the commissioners court of its
intention to do so. The county judge shall serve as commission
chair during any interim period.

§ 318.005. MEETINGS. (a) The commission shall meet at

§ 318.008. REPORTS AND RECOMMENDATIONS. (a) In order
to inform the commissioners court and the Texas Historical
Commission of the commission's needs and programs, the commission
shall make an annual report of its activities and recommendations
to the commissioners court and to the Texas Historical Commission
before the end of each calendar year. The commission may make as
many other reports and recommendations as it sees fit.
(b) The commission shall make recommendations to the
commissioners court and the Texas Historical Commission concerning
the acquisition and designation of property, real or personal, that
is of historical or archeological significance.

§ 318.009. FISCAL AND HUMAN RESOURCES. (a) The
commissioners court may pay the necessary expenses of the
commission.
(b) The commissioners court may make agreements with
governmental agencies or private organizations and may appropriate
funds from the general fund of the county for the purpose of
(1) erecting historical markers and monuments;
(2) purchasing objects and collections of objects that
are historically significant to the county;
(3) preparing, publishing, and disseminating, by sale
or otherwise, a history of the county;
(4) hiring professional staff and consultants;
(5) providing matching funds for grants; and
(6) funding other programs or activities as suggested
by the Texas Historical Commission and the commissioners court.

(c) The Texas Historical Commission may make grants
available to the commission, subject to the budgetary authority and
approval of the commissioners court, to carry out the purposes of
this chapter.

§ 318A10. RESOURCE INTERPRETATION. (a) The
commission shall review applications far Official Texas Historical
Markers to determine the accuracy, appropriateness, and
completeness of the application.
(b) The commission should establish a system for the
periodic review, assessment, and maintenance of Official Texas
Historical Markers in the county.
(c) The commission should work to promote historic and
cultural sites in the county to develop and sustain heritage
tourism.
(d) The commission may:
(1) operate and manage any museum owned or leased by
the county;
(2) acquire artifacts and other museum collections in
the name of the museum or the commission; and
(3) supervise any employees hired by the commissioners
court to operate the museum.
(e) In operating museums, the commission shall adhere to
professional standards in the care, collection, management, and
interpretation of artifacts.

partnership with other preservation entities in the county to

§ 318.0102. LEADERSHIP AND TRAINING (a) The Texas
Historical Commission shall make orientation materials and
training available to all county historical commissions.

(b) The commission should strive to be represented at
informational or educational meetings sponsored by the Texas
Historical Commission at least twice each year.
(c) The commission, with assistance from the Texas
Historical Commission, shall carry out board and volunteer
training.

§ 318.012. HISTORIC SITE TAX EXEMPTION. (a) The
commissioners court may establish a program under which the
commission:
(1) receives and reviews applications that are filed
with the county and that request a property tax exemption under
Section 11.24, Tax Code; and
(2) recommends to the commissioners court whether to
grant the exemption and, if the grant of the exemption is
recommended, how much of the property's assessed value should be
exempt from taxation.
(b) The commission may examine the property that is granted
the exemption on recommendation of the commission and recommend to
the commissioners court whether the exemption should be withdrawn
because of changed circumstances involving the property.
(c) A person is entitled to appear before the commissioners
court and state any objections to a recommendation made by the
commission under this section regarding property owned by the
person.
(d) The commissioners court may require a person whose
property is granted the exemption to notify the commission of any
plans the person may have to modernize the property or change it in
any other manner.

§ 318.013. CONTRACTS FOR LEASE OR MANAGEMENT OF
LANDMARKS. (a) The commissioners court rnay, on recommendation of
the commission or other interested persons, contract with a private
person for the lease or management of any county-owned real estate
or structure that is designated by the Texas Historical Commission
as a Recorded Texas Historic Landmark considered worthy of
preservation because of its history, culture, or architecture.
(b) The contract must be drawn in consultation with the
commission and must specify the duties of the contracting party,
including duties as to:

(1) maintenance and repairs;
(Z) providing public access;
(3) restricting inappropriate commercial uses; and
(4) promoting preservation of the historic, cultural,
or architectural aspects of the landmark.
(c) The contract may be handled in the same manner as a
contract for professional services rendered to a county, such as a
contract for architectural or engineering services, if the contract
is with a nonprofit organization chartered in this state.
(d) The contract may be for a period of years as determined
by the commissioners court.

SUBCHAPTER B. SUPPORT OF PRIVATE ORGANIZATIONS
§ 31$.021. APPROPRIATIONS TO HISTORICAL FOUNDATIONS:
CERTAIN COUNTIES. The commissioners court of a county with a
population of 239,000 to 825,000 may appropriate money from the
general fund of the county to a historical foundation or
organization in the county for the purpose of purchasing,
constructing, restoring, preserving, maintaining, or
reconstructing historical landmarks, buildings, and furnishings
that are of historical significance to the county. The foundation
or organization must be incorporated under the law of this state as
a nonprofit corporation.
