ORDER NO. 30981 FEES FOR USE OF HILL COUNTRY YOUTH EXHIBIT CENTER Came to be heard this the 8th day of September, 2008, with a motion made by Commissioner Letz, seconded by Commissioner Oehler. The Court unanimously approved by a vote of 4-0-0 to: Approve authorizing the changes as discussed, and that the actual language will be brought back to the next Commissioners' Court meeting: 1. That anytime there is an organization, nonprofit or otherwise, that partners up with aCounty-sponsored or nonprofit organization, and in so doing, either organization derives some benefit from the proceeds, that whatever rate is applicable, as in the case of a free user such as 4-H, and the partnering organization is a nonprofit that the commercial rate would apply; and 2. Whatever the split arrangement is as between the two organizations, i.e. 4- H/Lions, and they are going to split it 50/50, then the Lions should pay one-half of what the nonprofit rate should be; 3. And that nonprofits or anyone who is not putting up a deposit, that as soon as they have one event that they do not clean up, that from then on deposits will be required. 30~ g~ f~~°' COMMISSIONERS' COURT AGENDA REQUEST PLEASE FURNISH ONE ORIGINAL AND TEN (10) COPIES OF THIS REQUEST AND DOCUMENTS TO BE REVIEWED BY THE COURT MADE BY: Bruce Oehler, Pct.4 MEETING DATE: September 8, 2008 OFFICE: County Commissioner TIME PREFERRED: SUBJECT: Consider, discuss and take appropriate action regarding the fees paid for the use of the Hill Country Youth Exhibit Center, and address possible consequences to groups that do not clean up after their events. See Agenda Request Rules Adopted by Commissioners' Court. 5:00 PM previous Tuesday Item 1: A fee has never been charged for the 4-H /Sunrise Lions Club Wild Game Dinner which °~ takes place in October of each year. They should be charged, at a minimum, the non- profit rate. Item 2: The Kerr County Fair has never been charged for use of the facility. If the consensus is to continue letting them use the facility free of charge, we should have a Court Order stating that. Item 3: Many times the 4-H groups do not clean up after their events, and our maintenance department must do the clean up. Being that they are not charged anything for the use of the facility, there is no cleanup deposit that is "forfeited" when they do not clean up. Therefore, they need to be informed that they must clean up after their events, or face consequences which could include not being allowed to use the facilities free of charge anymore.
