GUADALUPE RIVER W'HEKEAS the G-.-adalupe River is an extremely important asset to Kerr County and the surmundin~f community as it provides water for municipal use and a variety of ~~atcr related recr-catio-~al opportunities; and WHEREAS the Texas Commission on Environmental Quality ('`TCEQ") and the 11.5. [;nvironmental Protection A~~ency ("EPA") have designated a segment of the Guadalupe River within the Kerr County area as impaired stemming from tests indicating elevated bacterial levels: and WHEREAS in response to this designation by TCEQ and the EPA, the Upper Guadalupe R1Ve-' .Authority (`UGRA") initiated a study of the river's conditions and causes of the elevated bacteria levels and has developed a plan to address and reduce such levels: and WHEREAS UGRA also plans to submit a grant application to TCEQ for a three year grant funded under the }~ederal Clean Water Act; and WHEREAS if awarded, the TCEQ grant will cover approximately 60% ofi the costs of the pla-1 developed b_y UGRA; and WHEREAS under the grant program, local entities, including UGRA and Ke--r County, will need to agree to supply the remaining 40`% of the costs of the program, though such contribution, may result from in-kind services, such as staff time used to review and implements plansto reduce the nesting of birds under bridges and other wa,~rfowl mana~~ement pr~-ctices: and' WHEREAS the Kerr County's Commissioners' Court, finds it to be in the public interest to authorize Kerr County's support and participation with UGRA with respect to the submission of a ~~rant application to TCEQ for funding to address and implement UGRA's plan to red-Ere bacteria levels in the Guadalupe River; NOW, THEREFORE, BE IT RESOLVED BY THE KERR COUNTY COMMISSIONER'S' COURT: l~he County Judge is authorised to take whatever actions are necessa-y to evidence the County°'s support and participation with UGRA with respect to UGRA's submission of a grant application to~TCF~:Q fl~~r f~mdin~~ to address and implement UGRA`s plan to reduce bacteria levels in the Guadalupe River.
