LAWERFNCE OAKS, GXECUI'IVF D1R1iC"I'OR January 9, 2009 Dear Judge: This month county commissioners courts in Texas will make appointments to their county historical commissions (CHC) in keeping with Chapter 318 of the Texas Government Code. This statute states that at least seven residents of the county should be appointed, but we urge you to appoint more if you feel it would help facilitate a more effective preservation program. Please consult your CHC bylaws to adhere to any language that may further specify the appointment process for your county and member status, i.e., officer, ex- officio, or member emeritus; appointee status becomes particularly important when determining the opportunity to vote on CHC issues. Your CHC bylaws should also address whether the Court appoints officers of the historical commission, or if they are elected and recommended by the membership. The individual selected to serve as CHC Chair should be committed, creative and competent in fulfilling the duties of leadership and working with the public. Since appointments are made every odd-numbered year as per the statute, the appointment term is considered to be 2 years. While reappointment is of course helpful in providing experience and consistency, please ensure that those being considered for re-appointed remain willing and able to serve. We also recommend that your commissioners court make a special effort to appoint citizens who live in all parts of your county, people of varied ages and ethnic backgrounds and those who demonstrate an active interest in historic preservation. By appointing a diverse CHC membership, you will enhance the overall appreciation for and interest in preserving all aspects of your county's history and historic resources. Please provide current appointee contact information so the THC can update our records. SeG 318.003. COMPOSITION; TERM. (a) The commission must be composed of at least seven residents of the county. Members of the commission must be individuals who broadly reflect the age, ethnic, and geographic diversity of the county. (b) The members of the commission shall be appointed during the month of January of odd-numbered years and are appointed for a term of two years. The commissioners court shall fill a vacancy on the commission for the remainder of the unexpired term. (c) Each commission member must have an interest in historic preservation and an understanding of local history and resources. (d) The commissioners court shall provide to the Texas Historical Commission a list of appointed members and the mailing address of each member. The methodology for appointing county historical commissions may vary somewhat from county to county, however, the criteria stated within the CHC statute must be met. To provide the most complete representation of cultural and historical resources throughout your county, it is important that the group selected reflect county demographics and geography. When selecting CHC appointees, keep in mind the following skills and abilities. CHC members should: ^ Be a positive influence for the cause of preservation in your county and throughout the state. ^ Be able and willing to provide service beyond attending the required 4 meetings per year, and participate in cultural and heritage events. ^ Be willing to work and partner with people and organizations for the good of the county. ^ Ensure information collected today will be accessible in the future. ^ Provide ongoing updates on CHC activity to county commissioners court. ^ Be able to receive, and respond to, inquiries about historic resources oftheir county in a timely manner. ^ Be able to provide site visits to historic properties around county to update surveys, update property inventories, and provide current information on site conditions for THCstaff_- _ ----------------------------------- -------- ^ Provide necessary stewardship over all county cultural and historic resources. ^ Have a working knowledge of history, be able to identify gaps or untold stories, and understand the need to address and promote a diverse interpretation of the county. ^ Be willing to attend preservation education opportunities outside oftheir county. The time and energy provided by your CHC is a true service to the vitality of your county. The mission of the Kerr County Historical Commission is to protect and preserve the County's historic and prehistoric resources for the use, education, enjoyment and economic benefit of present and future generations. This mission will be implemented through the Texas Statutes pertaining to County Historical Commissions and Historical Preservation and the programs as promulgated by the Texas Historical Commission. (TX Gov Code, Chapter 442. Texas Historical Commission; TX Local Gov Code, Chapter 318, Historic Preservation by Counties) By charter, the Historical Commission is to report annually to the Court on the following: • Membership • Leadership • Activities This Annual Report is being presented for the records of Kerr County on 9 February 2009. Previously submitted are separate documents: • Membership list of new and approved members of the Historical Commission. • Revised Bylaws of the Kerr County Historical Commission. MEMBERSHIP Current membership of the Kerr County Historical Commission stands at 33. The revised bylaws made changes creating four categories of membership: • Appointed • Associate • Emeritus • Ex-Officio The membership roster includes 26 members to be appointed or reappointed by the Commissioners' Court. There are six Associate Members and one Emeritus Member, who will not be appointed members. Associate and Emeritus members do not have voting privileges. KCHC members live in communities widely distributed throughout Kerr County, including Kerrville, Center Point, Cypress Creek, Turtle Creek, Mountain Home, Ingram and Hunt. These members represent a wide range of ages up to and including 94. In 2008, these volunteers donated a total of approximately 2,150 hours of their time in support of the activities of the Kerr County Historical Commission. This is valued in excess of $60,000.00. IMPLEMENTATION OF A NEW PLANNING AND BUDGETING METHODOLOGY. In this year, 2008, the KCHC developed and presented a Plan of Work based on a Planning, Programming and Budgeting (PPBS) methodology. A Plan of Work was developed, with each Committee identifying its goals, objectives, activities, tasks and resources requirements -all functionally linked together. From this Plan of Work, a Programmatic Budget was developed. This Programmatic Budget was presented to the Commissioners' Court last September. This was a significant change in the planning and operating of the KCHC. In this approach, ends and means are firmly connected; the desired outcomes are linked to activities; activities are linked to tasks; tasks are used to identify needed resources; and resource requirements are the basis of the annual budget request. This established an annual cycle with the Annual Plnn of Work, the Annual Budget, and the Annual Report providing a continuous process and program management. 3 2. COLLABORATIVE AGREEMENT WITH SCHREINER UNIVERSITY. This Agreement establishes procedures for the safeguarding and public access provided by Schreiner University for the Kerr County Historical Commission's archives and artifacts. The Kerr County Historical Commission is charged with the protection and preservation of Kerr County's historic and prehistoric resources for the use, education, enjoyment and economic benefit of present and future generations. In fulfilling this mission, this commission has accumulated oral histories from notable county citizens, sponsored historical markers and national registry buildings, and fulfilled projects that promote the county's history. Records of these projects are stored in various formats including books, paper, photographic, video and electronic. These historical archives and artifacts are not conveniently available to the public. Few of these items are digitized and their paper condition will continue to deteriorate over time from age and environmental conditions. Schreiner University seeks, beyond its academic mission, to enhance current and create new partnerships within the Hill Country community. The Texas Hill Country Special Col%ction within the Logan Library at Schreiner University houses a selection of books, photographs, documents, papers and other archival material about the history of the Texas Hill Country. The Sam Lanham Digital Library of Texas Hill Country History, a digital repository, allows broader access of archives and artifacts while protecting the original items. Schreiner University seeks to attract the attention and support of residents of the Texas Hill Country who have one-of-a-kind historical items as documented in private or business records, manuscripts, journals, diaries, letters and photographs among their family archives. At Schreiner University, these historical archives and artifacts are safeguarded in an environmentally controlled, secure facility, digitized as time permits and made available for viewing by the public with controlled access. We believe this collaborative venture is the first of its kind in this state and perhaps in the country, serving as a model for other county historical commissions. As part of this archival activity, the KCHC Archives Committee has identified, inventoried, catalogued and filed a great mess of loose files and photographs stored in the basement of the Courthouse and in the library annex. These will be transferred to Schreiner University. 4 3. REVISION OF KCHC BYLAWS. The Bylaws of the Kerr County Historical Commission were significantly revised this year to conform to THC requirements for application as a "Certified Local Government." A copy of these revised Bylaws has submitted for approval by the Commissioners' Court. Major changes in these Bylaws include: • Established of four categories of membership: Appointed, Associate, Emeritus and Ex-Officio. • Established participation/attendance requirements. • Deleted the term "Board of Directors" in reference to the body of Appointed Members of KCHC. • Detailed the role of the "Executive Committee" -- which will have general supervision of the affairs of the Commission between its business meetings, fix the hour and place of meetings, make recommendations to the Commission, and shall perform such other duties as are specified in these bylaws. 4. HISTORIC MARKERS. In 2008, the Kerr County Historical Commission researched, prepared and submitted applications for the following subject markers: • Apelt Armadillo Fnrm -approved Feb 2009 • Old Spanish Trail -approved Feb 2009 • Great Western Trail -approved Feb 2009 • Starkey Cemetery (HTC approved last year) -marker approved Feb 2009 The following markers were approved in 2008. • Mnsonic Building -yet to be dedicated • Kerrville Daily Times -dedicated • Mary Ann Morriss -yet to be dedicated, scheduled for 8 March 2009. • Starkey Cemetery (Registered Historic Cemetery) -yet to be dedicated. 5 In addition, the KCHC applied for and received permission to relocate three historical subject markers: • One Mile to Ruins of Cnmp Verde - to be relocated to Camp Verde, intersection of SR 173 and FM 480 in area of excess TxDOT ROW. • Camp Verde C.S.A. Marker #682- to be relocated to Camp Verde, intersection of SR 173 and FM 480 in area of excess TxDOT ROW. • Kerr County -Marker #2929 - to be relocated to front of Courthouse. 5. EXHIBITS. The Kerrville Arts and Cultural Center hosted the KCHC Annual Exhibition in March 2008. This year, the exhibit was entitled INDIGENOUS PEOPLE OF KERR COUNTY, 1730 - 1880. Following the exhibit, the major work of art was presented to the Commissioners' County and today is displayed in the Courthouse. Other materials from this exhibit are in the KCHC display cases in the Courthouse. 6. COLLABORATIONS. ARTICLE I I -Mission The mission of the Kerr County Historical Commission is to protect and preserve the County's historic and prehistoric resources for the use, education, enjoyment and economic benefit of present and future generations. This mission will be implemented through the 'Texas Statutes pertaining to County Historical Commissions and Iistorical Preservation and the programs as promulgated by the "I~exas Historical Commission. Appointed Members of the Commission shall be appointed for two-year terms beginning January 1. In-term appointments shall serve only until the KCHC next regular appointment date. Appointed Members of the Commission shall be voting members. Attendance requirements apply. See Section 4 below. Section 3. Associate Membership is available to individuals or representatives of cooperating organizations in Kerr County working to achieve the goals of Kerr County Historical Commission and the Texas Historical Commission. Such individuals and representatives may be invited to participate in meetings and activities of the Commission as an Associate Member - without appointment to the Historical Commission by the County Commissioners' Court. Attendance requirements do not apply to Associate Members. Such invitation is subject to review and approval by the Executive Board. Section 4. Any appointed member of the Commission desiring to resign from the Commission shall submit his or her resignation in writing to the Chairperson who shall present it to the Kerr County Commissioners' Court for action. Section 5. If an appointed member of the Commission fails to attend at least NINE regular meetings of the Commission during the first calendar year of the appointed term or during the second calendar year of the appointed term, without a valid excuse (personal excuse or health reasons) then such Member 1) At the end of the first calendar year may be automatically removed from the Commission; Or 2) _At the end of the second calendar year may not be nominated for another term. An Appointed Member with personal circumstance or health problems may request to he reclassified as an Associate Member with no voting rights. 2 KCHC Section 6. Members Emeritus: The category "member emeritus" may be accorded to an active member who has served at least three terms, but can no longer be active because of age. health, or demands of occupation. Nomination to emeritus status must he authorized by a majority vote of members present at a regular meeting. Section 7. Ex-Officio Members: Ex-officio, non-voting members shall include the County Judge and the County Commissioners. ARTICLE I V -Officers Section 1. The Appointed Members of the Kerr County Historical Commission shall consist of at least seven (7) members appointed by the Kerr County Commissioners' Court, and from this governing body shall be elected an Executive Committee consisting of the Chairperson, First Vice-Chairperson, Second Vice-Chairperson, Secretary. and Treasurer. These officers shall perform the duties prescribed by these bylaws and by the parliamentary authority adopted by the Commission. Section 2. At the regular meeting held on the third Monday in October, a Nominating Committee of five (5) members shall be elected by the appointed members. It shall be the duty of the Committee to nominate, from the appointed membership, a slate of officers to be elected. In the event that more thali one person is nominated for an office, the vote shall be by secret ballot. A majority of those present, qualified to vote, and voting shall constitute election. Proxy or Absentee Voting will not be allowed in the election of officers. Section 3. After such November election, the names of the elected officers shall be presented to the Commissioners" Court for confirmation and appointment. Section 4. The Kerr County Commissioners' Court shall appoint the Members in January and such appointments will commence in January for atwo-year tend. 3 KCHC Section 5. For any vacancy or resignation of any officer, the Commissioners' Court shall fill a vacancy on the Commission for the unexpired terns of such officer at the first directors' meeting following notice of resignation. Section 6. The Commissions' Court shall provide the Texas Historical Commission a list of Appointed, Associate, and Emeritus members and mailing addresses of each member. ARTICLE V -Duties of Officers Section 1. The Chairperson shall preside at all meetings; call special meetings as required, appoint Committee Chairmen as approved by the Commission; serve as a member of all committees; approve or disapprove all awards for submission to the Texas Historical Commission or return to t11e originator_ render an annual report and plan of work to the Ken County Commissioners' Court at end of the calendar year; make awards presentations; appoint Liaison Officers to other organisations in Kerr County and other special officers as may be necessar}~ from time to time and as approved by the Executive Committee. The First Vice-Chairperson shall serve shall preside the meetings in the absence of the Chairperson; and, in the event the Chairperson is no longer able to serve in that capacity, shall possess all the duties and responsibilities of the Chairperson. The First Vice-Chairperson shall serve as the Chairperson of the Finance Committee: Section 3. The Second Vice-Chairperson shall serve as the Chairperson of the Historic Markers Committee. Section 4. Any chair of standing committees shall work with the Executive Committee and the Commission to perform assigned duties of a committee. The Commission should institute and carry out a continuing survey of the county to determine the existence of historic buildings and other historical and archeological sites, private archeological collections, important endangered properties, or other historical features within the county, and should report the data collected to the Commissioners Court and the Texas historical Commission. ARTICLE II -Mission The mission of the Kerr County Historical Commission is to protect and preserve the County's historic and prehistoric resources for the use, education, enjoyment and economic benefit of present and future generations. This mission will be implemented through the Texas Statutes pertaining to County Historical Commissions and Historical Preservation and the programs as promulgated by the Texas Historical Commission. (TX Gov Code, Chapter 442. Texas Historical Commission; TX Local Gov Code, Chapter 318, Historic Preservation by Counties) ARTICLE III -Members Section 1. The Kerr County Historical Commission shall consist of Appointed Members, Associate iVlembers and Emeritus Members. Members of the Commission must be individuals who broadly reflect the age, ethnic, and geographic diversity of the county. Each Commission member must have an interest in historic preservation and an understanding of local history and resources. Section 2. The membership of the Appointed Members of this Commission shall be limited to appointments by the Kerr County Commissioners' Court. The Appointed Members of the Kerr County Historical Commission must be composed of at least seven residents of the county. Appointed Members of the Commission shall be appointed for two-year terms beginning January L In-term appointments shall serve only until the 1 KCHC next regular appointment date. Appointed Members of the Commission shall be voting members. Attendance requirements apply. See Section 4 below. Section 3. Associate Membership is available to individuals or representatives of cooperating organizations in Kerr County working to achieve the goals of Kerr County Historical Commission and the Texas Historical Commission. Such individuals and representatives may be invited to participate in meetings and activities of the Commission as an Associate Member - without appointment to the Historical Commission by the County Commissioners' Court. Attendance requirements do not apply to Associate Members. Such invitation is subject to review and approval by the Executive Board. Section 4. Any appointed member of the Commission desiring to resign from the Commission shall submit his or her resignation in writing to the Chairperson who shall present it to the Kerr County Commissioners' Court for action. Section 5. If an appointed member of the Commission fails to attend at least NINE regular meetings of the Commission during the first calendar year of the appointed term or during the second calendar year of the appointed term; without a valid excuse (personal excuse or health reasons) then such Member 1) At the end of the first calendar year may be automatically removed from the Commission; Or 2) _At the end of the second calendar year may not be nominated for another term. An Appointed Member with personal circumstance or health problems may rcqucst to be reclassified as an Associate Member with no voting rights. 2 KCHc Section 6. Members Emeritus: The category "member emeritus" may be accorded to an active member who has served at least three terms, but can no longer be active because of age, health, or demands of occupation. Nomination to emeritus status must be authorized by a majority vote of members present at a regular meeting. Section 7. Ex-Officio Members: Ex-officio, non-voting members shall include the County Judge and the County Commissioners. ARTICLE IV -Officers Section 1. The Appointed Members of the Kerr County Historical Commission shall consist of at least seven (7) members appointed by the Kerr County Commissioners' Court, and from this governing body shall be elected an Executive Committee consisting of the Chairperson, First Vice-Chairperson, Second Vice-Chairperson, Secretary, and Treasurer. At the regular meeting held on the third Monday in October, a Nominating Committee of five (5) members shall be elected by the appointed members. It shall be the duty of the Committee to nominate, from the appointed membership, a slate of officers to be elected. In the event that more than one person is nominated for an office, the vote shall be by secret ballot. A majority of those present, qualified to vote, and voting shall constitute election. Proxy or Absentee Voting will not be allowed in the election of officers. Section 3. After such November election, the names of the elected officers shall be presented to the Commissioners' Court for confirmation and appointment. Section 4.
