Items for consideration in ETJ agreement between Kerr County and the City of Kerrville Note: these items were agreed to at a meeting 7/27/09 attended by Bruce Motheral,lonathan Letz, Todd Parton and Kevin Coleman and have not been approved by Commissioners Court or City Council July 28, 2009 It is understood that if the City of Kerrville develops or revises and rural subdivision standards that will apply to subdivisions with a minimum lot size of greater than 5 acres, the City of Kerrville will consult with Kerr County prior to the adoption of such rural standards. All roads constructed in subdivisions in the ETJ shall be built to Kerr County road standards. Kerr County will revise its road standards to permit the option for developers to install ribbon curbs or curb and gutter drainage only for subdivisions with minimum lot sizes less than 5 acres as long as such subdivision will have a central water system and privately maintained roads. Such roads will not be eligible to be accepted for county maintenance. Any proposed subdivision in the ETJ that falls within the boundary of both jurisdictions shall be only subject to the standards of the City of Kerrville. The City of Kerrville and Kerr County shall each be responsible for floodplain review and necessary permits for subdivisions within their respective areas of jurisdiction. Any plat where the lots are to be served by on site septic facilities (OSSF) shall be approved by Kerr County Environmental Health Department on the preliminary and final plat. Kerr County will amend its subdivision rules and regulations to require new central water systems within new subdivisions in the ET1 to construct such systems to the standard to provide for fire flow protection or another alternative method of fire protection agreed to by the city. A 100' buffer will be included around the entire city limits that will be within the city area of jurisdiction. In areas where the county area of jurisdiction is not defined by a physical boundary noted on the jurisdiction map, the area of county jurisdiction shall extend 3,280' from the ETJ boundary towards the city limits. It is the intent of this agreement that city subdivision rules, as may be amended, will apply to the areas of city jurisdiction and county subdivision rules as may be amended, will apply to areas of county jurisdiction.
