Pending ETJ Issues
Dear Todd,
I appreciate meeting with you and discussing the referenced and other matters. I believe
we now have a plan to work through the governance issues in the ETJ and think a draft
proposal can be prepared for the city /county committee to review within a couple of
weeks.
During the interim period, it seems appropriate to evaluate each proposed development
and determine if the county or city should be the approving entity. While there is not an
inter-local agreement in place between Kerr County and the City of Kerrville at this time,
we believe it is counter-productive to have any developer have to work through both the
county and city plat approval process. Further, it is against the intent of State law to have
a developer do so. Despite which entity is designated to handle the approval process,
communication between the city and county will be critical as developments must
comply with both the city and county subdivision platting regulations.
Concerning the Concept Plan for the development proposed by Mr. Colvin, as
Commissioner Williams and I conveyed at our meeting last week, we believe the county
should be the lead entity during the platting process. In most areas such as drainage,
roads, platting process and inspections the city and county rules are very similar. Hence,
regulation compliance should not be an issue. This development is not a standard urban

subdivision and is actually more similar to a manufactured home or condominium
development, both of which the county has experience handling from a platting
standpoint outside a municipality. Roads in this development are proposed to be private.
As this development is currently proposed, floodplain regulations will fall under county
jurisdiction. Water and wastewater matters will fall under .the authority of TCEQ or
county authority. Overall, we feel the county is the proper entity to handle the plat
approval and the city would certainly be involved in the process.
Based on our conversations, there are two main areas of concern from compliance with
the City of Kerrville regulations. First, the issue of fire protection flow capabilities within
the development. This is a concern that Commissioner Williams and I share and
compliance with the city standard needs to be discussed with the developer.
The second is was whether or not the city could require, or the developer could request,
water and wastewater connection to the city utility system. This issue is out of the
purview of county jurisdiction and if this course of action is required, then we believe the
City of Kerrville should be the lead entity during the plat approval process.
In summary, during this interim period communication between the city and county will
be essential for all development plat approvals in the ETJ. The rules of both jurisdictions
need to be followed. As development proposals are submitted we need to determine
which governmental entity will take the lead based on the specifics of each development.
We look forward to continue working with the City of Kerrville on this issue
